Reports for Information and Immediate Consideration 9.1 Warden Jones - Warden's Activity Report (June 2025) Warden Jones presented a report detailing his activities during the month of June 2025. The Warden stated that a correction to the report is that he did not attend the SWIFT AGM, but that Councillor Giguere attended on his behalf. The Curator and the Archivist presented the report detailing the activities of the Museum and Archives in 2025. CW25-44 E I g i n GO iUty' Director of Community and Cultural Services - Response To Aylmer Town Council's Letter of Intent Regarding Aylmer Library Expansion at Old Town Hall Location Tuesday, July 8, 2025 Moved by: Councillor Noble Seconded by: Councillor Giguere RESOLVED THAT the correspondence titled "Letter of Intent — Town of Aylmer - Elgin County Library Branch Construction Policy" from the Town of Aylmer dated May 22, 2025 be received and filed; and THAT Aylmer Town Council be requested to confirm the approximate size of the area to be designated for Aylmer Library use in a future expansion to the Old Town Hall, along with a proposed date to commence construction at that location, in order to be considered a "Letter of Intent" under the County of Elgin's Library Branch Construction Policy; and THAT copies of this report be circulated to the Councils of the Town of Aylmer and the Township of Malahide. Introduction: At the July 8, 2025 meeting, Elgin County Council under Committee of the Whole endorsed the following resolution: "THAT staff prepare a summary report of the exploration of the move of the Aylmer Branch of the Elgin County Library to the East Elgin Community Complex to be presented to County Council at the next meeting of County Council." This report fulfils this staff direction. The Board discussed this matter. Prior to voting upon a proposed motion, the floor was again opened to the members of the public to speak upon the matter. Kirk Barons addressed the EECC Board. His comments included but were not limited to the following, highlighted the past decision to not move the library to the EECC, outlined that the EECC had insufficient space to fulfill what the County was seeking in terms of space, indicated strong opposition from community groups in Aylmer and Malahide to moving the library from downtown Aylmer. Chair Giguere sought further comments from the public in attendance. Seeing none the public meeting was concluded. Resolution No. 73-24 That the EECC Board direct the Co -Chairs to contact the Director of Cultural Services of Elgin County respecting the potential for County Services to be provided in EECC space. Moved by Councillor Couckuyt, Seconded by Councillor Giguere RESOLVED THAT Elgin County Council endorses in principle the relocation of the Aylmer branch of the Elgin County Library to the East Elgin Community Complex; and THAT Aylmer Town Council be requested to endorse in principle the relocation of the Aylmer branch of the Elgin County Library to the East Elgin Community Complex; and Page 26 of 197 THAT the Director of Community and Cultural Services report back to County Council regarding next steps in the process to accommodate the Aylmer branch of the Elgin County Library at the East Elgin Community Complex, including opportunities for public consultation; and THAT Aylmer Town Council's request "to establish a committee to advance the matter of a Greater Aylmer area Library" be received and filed based on the information contained in the report titled "Relocation of the Aylmer Library to the East Elgin Community Complex" from the Director of Community and Cultural Services dated January 28, 2025; and THAT copies of this report be circulated to the Councils of the Town of Aylmer and the Township of Malahide. (9 to 0) ➢ Authorization from Elgin County Council to engage in a community consultation process for the potential relocation of Aylmer Library to EECC Hyperlink to report: Elgin County Council Meeting Report "Community Consultation Process for Relocation of Aylmer Library Branch" —March 11, 2025 The Director of Community and Cultural Services presented the report that seeks Council's authorization for library staff to lead a community consultation process regarding the future location of the Aylmer Branch of the Elgin County Library. Moved by Councillor Couckuyt, Seconded by Councillor Noble RESOLVED THAT the motion be amended to include an additional public consultation at a different time than the East Elgin Community Complex consultation with regard to the future accommodation of the Aylmer library branch in a downtown location. Moved by Deputy Warden Ketchabaw, Seconded by Councillor Hentz RESOLVED THAT Elgin County Library staff be authorized to lead a community consultation process regarding future accommodation of the Aylmer branch of the Elgin County Library at the East Elgin Community Complex before the end of May 2025 as outlined in the March 11, 2025 report titled "Community Consultation Process for Page 27 of 197 Relocation of Aylmer Library Branch" from the Director of Community and Cultural Services and in response to the resolution on this matter approved by Township of Malahide Council; and THAT a summary of the outcome of this consultation process be provided to County Council and Councils of the Township of Malahide and Town of Aylmer as soon as feasible; and THAT recommendations received from Aylmer Town Council as contained in Town of Aylmer CAO Report 09-25 as attached be received and filed; and THAT copies of this report be circulated to the Councils of the Town of Aylmer and Township of Malahide. Motion Carried. ➢ Adoption of leasing and space needs for Aylmer Library HYper i n k to report: ,r,Council ., fi d i i n,ii u i r "Aylmer Library Expansion — Lease and Space Needs Analysis" — April 22, 2025 (subsequently adopted at the May 13, 2025 meeting) [Note: Through this report, County Council established minimum space needs of 10,000 square feet plus additional considerations (such as adequate parking).] The Director of Community and Cultural Services and the Director of Legal Services presented a report on the County authority of library locations and a space needs and leasing analysis for future expansion opportunities to be considered for the Aylmer Branch of the Elgin County Library. Cynthia Grant, a Member of the Public, spoke to the report voicing her preference for a downtown location for the Aylmer Library. Introduction: The Terrace Lodge pool was closed at the onset of the COVI D-19 pandemic, for renovations and addition of change rooms available for attendees of the pool programs. Staff training, public health inspections and reopening of the Terrace Lodge pool was successfully implemented in August of 2024. Background and Discussion: A one-year agreement with the YWCA St. Thomas -Elgin is in place for the use of the Terrace Lodge pool, and the current agreement for community swimming programs expires August 31, 2025. The Life After Stroke Adult Day program operates at Terrace Lodge as part of the Multi - Sector Service Accountability Agreement which includes the use of the pool/provision of aquatic therapy by County of Elgin Staff. County legal staff and the Director of Homes and Seniors Services entered into negotiations with YWCA St. Thomas -Elgin for the 2025-2026 agreement. Negotiations were successful to include the provision of annual "Swim to Survive" standard observations of designated County of Elgin Life After Stroke staff by YWCA Page 32 of 197 St. Thomas -Elgin, at no cost to the County. The "Swim to Survive" standard observation is in addition to the aquatic therapy training provided to County of Elgin Life After Stroke staff. Financial Implications: A (1) one-year agreement incorporating a modest increase of 2 % for pool rental fees, fees of up to $500 for the term of the agreement related to after hours staffing costs for potential pool fouling, combined with the provision of "Swim to Survive" standard observation by YWCA St. Thomas -Elgin for designated County of Elgin staff providing aquatic therapy for the Life After Stroke Adult Day Program is recommended to support the costs associated with the Terrace Lodge pool maintenance and operations. THOMAS-ELGIN (Hereinafter referred to as "YWCA") OF THE FIRST PART OF THE SECOND PART WHEREAS Elgin is the owner of certain lands and premises known as Terrace Lodge at 49462 Talbot Line, Aylmer, Ontario, which premises include a swimming pool and related equipment and facilities; AND WHEREAS YWCA wishes to arrange for use of the swimming pool on various days and at various times for purposes of conducting supervised Aquatic Programs (the "Programs") to the public at large; AND WHEREAS Elgin and YWCA have agreed upon the terms and conditions under which YWCA shall have use of the swimming pool for the Programs and now wish to reduce such terms and conditions to writing; NOW THEREFORE, in consideration of payment of the sum of TWO DOLLARS ($2.00) now paid by each Party to the other and the promises and covenants hereinafter set forth, the sufficiency and receipt of which consideration is hereby acknowledged, Elgin and YWCA hereby agree as follows: 1.0 General 1.1 Subject to the terms and conditions below, YWCA is granted a non- exclusive licence to use the swimming pool at Terrace Lodge for purposes of conducting the Programs, which are to be available to the public at large. 1.2 In conjunction with the use of the swimming pool as provided herein, the YWCA, including Aquatic Program staff, representatives, and participants shall be permitted access to and use of equipment and facilities related to the said swimming pool, including but not limited to change room facilities (the pool, equipment, and facilities hereinafter referred to as the "Facilities"), at the agreed -upon times pursuant to s. 3.0 herein. 1.3 The YWCA shall, in accordance with the below, observe the ability of Elgin employees to meet the "Swim to survive" standard. 2.0 Term 2.1 This licence agreement shall commence on September 1, 2025, and end on August 31, 2026. 3.0 Dates/Terms of Use 3.1 YWCA agrees to submit to Elgin a proposed schedule for access to and use of the Facilities at least thirty (30) days prior to the commencement of any proposed program session. Elgin shall promptly review and consider said proposal and, if acceptable, approve it. Once approved, any such schedule (the "Schedule") shall determine the licenced access of the YWCA to the Facilities. Elgin's discretion to approve or deny proposed Schedules shall be absolute and unfettered. Page 34 of 197 Page 1 of 7 3.2 YWCA Aquatic Program staff, representatives, and participants shall have access to and use of the Facilities as is reasonably required to operate the Programs in a safe and reasonable fashion. Access shall be granted in accordance with the Schedule, which must be approved by Elgin prior to the commencement of any program session. YWCA may access the Facilities for the duration of the time allotted in the Schedule, and for such short periods before and after the scheduled time as are reasonably required to set up or tear down programming, to use the change room, etc. YWCA Aquatic Program staff, representatives, and participants shall not have access to any part of Terrace Lodge other than the Facilities and the means of ingress thereto and egress therefrom. YWCA shall ensure that participants only access the permitted portions of Terrace Lodge and shall be responsible for the conduct of all persons accessing Terrace Lodge for purposes related to the Program. 3.3 Should circumstances require cancellation of any scheduled use of the Facilities, the cancelling party shall notify the other in writing as soon as possible and in every instance prior to the date of the scheduled use to be cancelled. No party shall incur any liability, claim, or charge arising out of a cancellation, except as specifically provided by this Agreement. 4.0 Payment to Elgin 4.1 In consideration of the use of the Facilities as provided for herein, YWCA shall pay to Elgin a fee of TWO THOUSAND THREE HUNDRED AND FIFTY DOLLARS ($2,400.00), exclusive of taxes. 4.2 On or before August 31, 2025, Elgin shall prepare and deliver to YWCA an invoice, as contemplated by section 4.1 above, which shall additionally list the applicable taxes. Within thirty (30) days of receipt of said invoice, YWCA shall pay to Elgin the amount invoiced plus applicable taxes. 5.0 Responsibilities of YWCA 5.1 During the term of this agreement, YWCA shall: 5.1.1 Arrange for and conduct all Programs in a safe and prudent manner, in accordance with established operating standards, including but not limited to standards and procedures established by the Lifesaving Society; 5.1.2 Ensure that the Aquatic Programs contemplated by this agreement shall be conducted under the supervision of a sufficient number of qualified swimming instructors; 5.1.3 Take all reasonable steps to ensure the safety of persons participating in the Aquatic Programs contemplated by this agreement. Such steps shall, at a minimum, comply with the training and supervision requirements of the Health Protection and Promotion Act, R.S.O. 1990, c. H.7 and specifically with s. 17 of Reg. 565, passed thereunder, as amended or replaced from time to time. For clarity, for the purposes of the Programs, the Facilities operate as a "Class `A"' Pool, as defined by Reg. 565. The Pool's emergency procedure is attached to this agreement as Appendix "A" and forms a part of this agreement. YWCA shall ensure that all its staff and instructors are trained in the emergency procedure as required by Reg. 565 and shall not permit any Program to proceed where such training has not been performed in accordance with applicable law nor where adequate supervision cannot be provided; 5.1.4 Take all reasonable steps to ensure that the swimming pool and related equipment facilities will not suffer damage through the course of Aquatic Programs contemplated by this agreement; 5.1.5 Be responsible for any and all damage caused by or attributed to the negligent act or omission of YWCA, including its staff, Page 35 of 197 �age2of7 representatives, and instructors and further including the persons participating in the Aquatic Programs contemplated by this Agreement. For clarity, the YWCA shall not be responsible for damage attributed to normal wear and tear of the said swimming pool and related equipment and facilities; 5.1.6 Take all reasonable steps required to ensure that its staff, representatives, and instructors and any persons participating in the Aquatic Programs contemplated by this agreement shall comply with and abide by any and all regulation, including police, fire, and sanitary regulations imposed from time to time by any federal, provincial, or municipal authority; 5.1.7 At its sole expense, obtain and keep in force during the term of this Agreement a general liability insurance policy or policies satisfactory to Elgin and underwritten by an Insurer licensed to conduct business in the Province of Ontario. The policy or policies shall include but not be limited to: (a) A limit of not less than FIVE MILLION DOLLARS ($5,000,000.00) per occurrence; (b) Add Elgin as an additional insured with respect to the operations of the YWCA as Named Insured; (c) The policy shall contain a provision for cross liability and severability of interest in respect of YWCA as Named Insured; (d) The policy or policies shall cover/include: 1. Bodily Injury, Death, Property Damage, and Personal Injury; 2. Products and completed operations; 3. Broad Form Property Damage; 4. Contractual Liability; 5. Owners and Contractors Protection; 6. Hostile Fire; 7. Physical / emotional / psychological abuse and, without limiting the generality of the foregoing, specifically related to child participants in programs contemplated by this Agreement. 8. Non -owned automobile coverage, which shall include contractual non -owned coverage (SEF 96); (e) The policy or policies shall provide 30 days prior notice of change or cancellation, which notice shall be likewise provided by the YWCA to Elgin. 5.1.8 Obtain from each participant in the Programs contemplated by this agreement a written release and waiver, signed by the participant or his or her legal guardian. Said acknowledgement is attached to this agreement as Appendix "B" and forms a part of this agreement. 5.1.9 Dismiss from the Programs and/or refuse further services at the Facilities to any person who, in Elgin's unfettered discretion, has caused unacceptable damage or disruption to Terrace Lodge and/or the facilities. 5.1.10 At a mutually agreed -upon time or times, provide an observation of the "Swim to Survive" standard to designated employees of Elgin. Page 36 of 197 �age3of7 Said test(s) shall be staffed and supervised by the YWCA at a location to be provided by the YWCA at its expense. The YWCA shall report its observations to Elgin. (a) The Lifesaving Society defines the minimum skills needed to survive an unexpected fall into deep water. These are expressed in a skill sequence in the Canadian Swim to Survive standard, which includes demonstration of the following skills: 1. roll into deep water, 2. tread water for one minute, and 3. swim 50 metres; (b) The YWCA is specifically not conferring a confirmation or qualification of staff competency to instruct or supervise aquatic activities. Rather, the "Swim to Survive" standard outlines the minimum skills needed to survive an unexpected fall into deep water. 6.0 Responsibilities of Elgin 6.1 During the term of this agreement, Elgin shall 6.1.1 clean and maintain the swimming pool and related equipment facilities in a sanitary condition suitable for safe use by persons participating in Aquatic Programs; 6.1.2 test the water within the subject swimming pool on a regular basis, adjust chemical requirements in response to the results of said tests, and deliver the results of said tests to the YWCA. 7.0 Termination 7.1 In the event that either party is in default of any term of this Agreement or obligation created thereby, which default continues for at least fifteen (15) days after written notification of same to the defaulting party, the non - defaulting party shall have the right to terminate this Agreement upon a further thirty (30) days written notice to the defaulting party, which right shall be exercised without recourse by or remedy to the defaulting party. 7.2 Notwithstanding that set forth in Section 7.1 above, Elgin at all times shall have the absolute and unfettered discretion to terminate this Agreement, without default on the part of YWCA, upon ninety (90) days written notice to YWCA, which right of termination is exercisable without recourse or default. 8.0 Release/Indemnification 8.1 YWCA shall defend, indemnify, and save harmless Elgin, its elected officials, officers, employees, and agents from and against any and all claims of any nature, actions, causes of action, losses, expenses, fines, costs (including legal costs), interest or damages of every nature and kind whatsoever, including but not limited to bodily injury, sickness, disease or death or to damage to or destruction of tangible property including loss of revenue or incurred expense resulting from disruption of service, arising out of or allegedly attributable to the negligence, acts, errors, omissions, misfeasance, nonfeasance, fraud or willful misconduct of YWCA, its directors, officers, employees, agents, contractors and subcontractors, or any of them, in connection with or in any way related to the Programs authorized or otherwise contemplated by this Agreement. This indemnity shall survive this Agreement indefinitely. For clarity, this indemnity includes the actual costs incurred by Elgin where damage to or contamination of the Facilities are caused by any Program or Page 37 of 197 �age4of7 staff, agent, or participant thereof, including the costs of paying overtime wages to Elgin staff where they are required to attend the facilities after hours to address damage to or contamination of the facilities. Without limiting the generality of the foregoing, where staffing costs arise solely out of the fouling of the pool by blood, vomit, or feces, the costs that Elgin may recover from the YWCA relating to the payment of overtime wages to Elgin's staff across the initial term of the life of this Agreement shall be limited to the lesser of the actual wages paid to such staff and $500. YWCA further agrees to defend, indemnify, and save harmless Elgin from and against any and all claims of any nature, actions, causes of action, losses, expenses, fines, costs (including legal costs), interest or damages of every nature and kind whatsoever arising out of or related to the status of YWCA with WSIB. The YWCA may not transfer or assign this licence nor any right or obligation hereunder without first obtaining the written consent of Elgin. 9.5 In this agreement, words importing the singular include the plural and visa versa and words importing gender include all genders. 9.6 The insertion of headings and a division of this agreement into sections are for convenience of reference only and shall not affect the interpretation thereof. 9.7 This agreement constitutes the entire agreement between the parties pertaining to the subject matter hereof and supersedes all prior agreements, understanding, negotiations, and discussions with respect to the subject matter hereof, whether oral or written. No supplement, modification, or waiver of this agreement shall be binding unless executed in writing by both parties. 9.8 The invalidity or unenforceability of any provision of this agreement or any covenant herein contained shall not affect the validity or enforceability of Page 38 of 197 �age5of7 any other provision or covenant hereof or herein contained. Any such invalid provision or covenant shall be deemed to be severable. 9.9 This agreement shall be construed in accordance with the laws of the Province of Ontario. The parties agree to attorn to the jurisdiction of the appropriate Courts of the Province of Ontario. 9.10 This Agreement may be executed in one or more counterparts and thereafter exchanged by scanned, emailed or facsimile transmission methods, each of which document, once executed, shall constitute an original thereof and all of which together shall constitute one and the same Agreement. Introduction: Council approved the 2025 budget and corresponding staff operational budget plans earlier this year. This report serves to provide information to Council relative to: - Progress on the budget/business plan as at end of June 2025 (see Appendix A) Forecasted financial information for 2025 year end - A Q2 update related to employee metrics Background and Discussion: In the 2024 budget, new budgeting software was approved to replace over 200 spreadsheets that were being maintained by the Finance Department on a daily basis. The goal of this software was to provide one place where the budget would be developed and maintained without redundancy resulting in a more efficient budget development process aligned with the corporate business plan, ability to forecast financial positions, and a greater ability for more comprehensive reporting to Council and the community. Additional to this, it was also necessary for our management team to be able to access comparison reports to monitor the progression of departmental spend throughout the year. In 2024 a software program was approved, selected, purchased and has been under development since May of 2024. Changes to finance staffing have caused some delay in moving this initiative forward but we moved through that with the help of our software development team. Staff inevitably did carry the bulk of the implementation load and have been working to ensure that the budgets align as approved. It was imperative that historical information was captured as accurately as possible and focus was put on the Page 41 of 197 2024 and 2025 budget years as we had comparator information using our old system to lean on for this purpose. Integrations to existing accounting software was required to ensure that actuals could be updated nightly and checks and balances have been developed to ensure that the two systems stay in alignment with each other. In many cases, there was some need to rethink old habits that did not align with the way that the software processes information and generates reporting. Beginning, in Q2, Managers were given access to the new software to review their budgets to actuals directly from the system. We also now have had the opportunity to trial the quarterly forecasting that is available in this system. New reporting has been developed that complements this process and provides a complete picture of the department from both the Capital, Operating, and Personnel sides. Managers have been hands on with their budgets and have had direct input in producing the results that you see in Appendix A. Financial Implications: The Q2 reports provide two points of view for the reader. In the first three columns are the full year that includes Actuals up to end of June added to the projections input by Managers relative to their area of business. These are identified as Forecast in their titles. In the last three columns, Council has been provided with the June 2025 Year to date which includes the Actuals as they currently sit in the accounting system. The budget has been distributed equally throughout the year resulting in �/2 of the current year's 2025 budget landing in June. During the Q2 financial review, managers were able to use the software system and reports to provide projections on their year-end expected spend. System generated financial data was left as coded and Managers have been able to identify department coding errors and bring them to our attention. Due to turn around times, finance will circle back to move these items during Q3. The current result is that some department lines may seem out of the ordinary. Within the variance reporting, there remains a need for the budget to be re-calendarized to better reflect spending related to wages/benefits and other areas of spending. Conversations and learning will be ongoing during Q3 about these processes as we begin to prepare for the next budget cycle which will be the first one generated by the system itself. The current report provided in Appendix A identifies that the forecasted spend and anticipates that Capital funds will either be used in the current year or carried forward to a future year except for $1.8M. This is a reasonable assumption as it relates to the recently awarded contract for the Exterior of the building and a possible projected surplus. As per our Reserve Policy, any Capital surplus would be slated to go into the Capital Reserve at year end. Page 42 of 197 Operations performance in June includes amortization performance of $7.2M that will be booked later in the fiscal year. As an example of this, the Engineering department shows performance related to budget with the largest amount being $5M in amortization performance that has not yet been booked and $800 in negative performance on CCBF funding not yet received at end of June. People and Culture Metrics: The People and Culture Metrics provided below is an overview from January 2025- June 2025. The total head count including Part time and fulltime employees is currently at 536. There are currently 34 open requisitions. Once these positions are filled the total headcount is 570. From January 2025-June 2025, Elgin County saw 45 employees' turnover. 57% of these resignations were from SEIU which directly impacts the homes. 73% of those employees were PSW's and RPN's. 26% of the turnover was nonunion employees. With a new HR Resource in the home, we are working on actions to reduce turnover and will be rolling out the employee engagement survey in the coming months. 151 requisitions have been submitted for recruitment in Dayforce. 117 of these positions have been closed. This includes a mix of internal transfers and external hirings. We are developing a solution to distinguish internal transfers versus external hires to provide a clear picture of the amount of recruitment taking place. The average time to fill is 54.8 days. We have now hired a talent acquisition partner and will be working on a new recruitment strategy to reduce the number of days it takes to fill positions. There were 120 health and safety incidents submitted and of those 60 were lost time claims. 55 of these lost time claims were related to outbreaks at the long term care homes. During the first 6 months of 2025, there have been 86 Non occupational claims. Currently, 31 of these claims remain active and 9 have moved to LTD. 26 of the active claims come from the long-term care homes and is made up of unionized staff. With the recent changes to the People and Culture team, the claims process is being reviewed for improvements to the process, financial impact and service delivery. We have seen an increase in mental health claims. Mental Health claims make up 29% of the active claims. The people and culture team will be making a wellbeing program a priority for the second half of the year and will have an increased focus on mental health and mental health supports. There have been 25 grievances submitted to the management team. All 25 grievances are SEIU grievances and coming from homes. 52% of grievances come from Elgin Manor and 40% come from Terrace lodge. The top 2 grievance reasons include 68% related to discipline and 20% for pay issues. 11 of the grievances are closed and 5 have been referred to arbitration. The remaining grievances are still working through the grievances process. As of June, a new grievance process was introduced to ensure more communication between the managers and the employees. Feedback has been well received, and we are seeing improvements in resolutions. By encouraging staff to interactively use the developed software daily, we will increase efficiency as users become more independent as they will be empowered to find the information at their fingertips when it is required for decision making purposes. Conclusion: Overall, the Q2 forecasting process was a great opportunity to proceed through a live training scenario well in advance of the budget process. The system seems to be well received in general by those now using it. Finance staff are very happy with the system but there is still more work to do to proceed through one whole cycle of the budget process.
