June 23, 2009 MinutesCOUNTY COUNCIL Tuesday, June 23, 2009 The Elgin County Council met this day at the Administration Building, at 9:00 a.m., in accordance with adjournment, with all members present. Warden Warwick in the Chair. Moved by Councillor Marks Seconded by Councillor Mennill THAT the minutes of the meeting held on May 26, 2009 be adopted. - Carried. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF - Councillors McIntyre, Vowel, and Wilson declared a conflict with regard to Closed Meeting Item #2 concerning a lease at 99 Edward Street, as it might prejudice their position as a Council appointee on the Board of Health. At the appropriate time the Councillors vacated the Council Chambers and refrained from discussing and voting on the item. DELEGATION Grace McGartland, Monique Lunn and Jonathan Kochis of The Arts & Cookery Bank attended at 9:05 a.m. to present information on the CAR Map Project and to discuss the progress made with the Cultural Advisory Roundtable consisting of four municipalities; West Elgin, Dutton/Dunwich, Southwest Middlesex and Newbury. As well as three business organizations; Dutton/Dunwich Chamber of Commerce, West Elgin Chamber of Commerce and Southwest Middlesex Business Network. Jonathan Kochis introduced the BETA test of the CAR Map Project, via power point presentation showing a sample of what will appear live on the internet. Warden Warwick thanked the delegation for the presentation and the group left the meeting at 9:20 a.m. Ron Elliott and Vicki Goodlett of Elgin St. Thomas RAISE (Reducing Addictions - Increasing Safe Environments) Coalition attended at 9:20 a.m. to present background information on their organization. The group presented facts and figures regarding substance abuse in Elgin County via PowerPoint presentation. Moved by Councillor Hofhuis Seconded by Councillor McIntyre THAT we the Corporation of the County of Elgin recognize the Elgin St. Thomas RAISE (Reducing Association - Increasing Safe Environments) Coalition and their work on substance misuse issues in our community. We support the efforts of the Elgin St. Thomas RAISE Coalition to work towards achieving a community free of problems associated with the harmful effects of substance misuse; and, - THAT the Council of the County of Elgin hereby appoints Warden Warwick to the Elgin St. Thomas RAISE Coalition and further that the Coalition be authorized and permitted to utilize County facilities for their purposes. - Carried. Ministry of Health and Long Term Care - Staffing Plan Field Testing - Director of Senior Services Bobier Villa and Terrace Lodge Moved by Councillor McIntyre Seconded by Councillor Marks THAT staff provide Council with a follow-up report on the findings and recommendations from the Field Test; and, THAT the report "Ministry of Health and Long Term Care - Staffing Plan Field Testing" dated June 8, 2009 be received and filed. - Carried. Olympic Torch Committee Representation - Director of Community and Cultural Services Moved by Councillor Habkirk Seconded by Councillor Vowel THAT the Director of Community and Cultural Services be appointed to serve as a representative of the County of Elgin on the Planning Committee for the 2010 Olympic Torch Community Celebration taking place on December 22, 2009. - Carried. * see page 3 for amendment to this motion County Council June 23, 2009 Community Adiustment Fund Applications - Director of Community and Cultural Services Moved by Councillor Marks Seconded by Councillor Wilson THAT Council hereby supports applications made on behalf of the County of Elgin to the Community Adjustment Fund. - Carried. Council took a break at 10:00 a.m. and reconvened at 10:17 a.m. Point of Order Moved by Councillor Habkirk Seconded by Councillor Wilson THAT Council reconsider the motion in regards to the Olympic Torch Committee. - Carried. Moved by Councillor Habkirk Seconded by Councillor Wilson THAT an amendment to the original motion be made whereby Councillor Marks is appointed to the 2010 Olympic Torch Committee in addition to the Director of Community and Cultural Services . - Carried. Moved by Councillor Hofhuis Seconded by Councillor Vowel THAT the original motion be approved as amended. - Carried. Warden Warwick reported on the luncheon with the City of St. Thomas. The City hosted the County of Elgin for lunch as the County was the victor in the United Way Challenge. Warden Warwick wished to thank the City of St. Thomas for their generosity and sportsmanship. Event: "Water Wind and Fire" - IPM and Events Coordinator The County of Elgin has contributed $5,200 in marketing for the event in addition to arranging billeting for the performers. To date 26 of the 40 performers have been billeted. Transportation has also been arranged through Aboutown Transportation Ltd. Shuttles will leave the County Administration Building and take guests to Port Stanley beginning one hour prior to the event and returning one hour after the event. County Council 4 June 23, 2009 Full Depth Reclamation with Expanded Asphalt Stabilization - Calton Line, Contract No. 6200-09-01 (A) - Deputy Director of Engineering Services Moved by Councillor Marks Seconded by Councillor Acre THAT Roto-Mill Services Limited be selected to provide Full Depth Reclamation with Expanded Asphalt Stabilization - Calton Line, Contract No. 6200-09-01 (A) at their submitted price of $928,809.00 inclusive of all taxes, no contingency allowance; and, THAT if the cost increases above the tender amount approved by Council by more than 10%, the Director will prepare a further report to Council outlining the expenditures; and, THAT, the Warden and Chief Administrative Officer be authorized to enter into an agreement with Roto-Mill Services Limited for the Full Depth Reclamation with Expanded Asphalt Stabilization - Calton Line, Contract No. 6200-09-01 (A) Tender. - Carried. Procurement of Natural Gas - Director of Financial Services, Financial Analyst, Purchasing Coordinator Moved by Councillor Habkirk Seconded by Councillor Acre THAT the County of Elgin enter a three year contract with Comsatec on the daily average spot market rate; and, THAT any spot market rate performance be booked to the Corporate Services account, and usage performance be booked to the operating departments. THAT the authority to make all future Natural Gas related decisions for the Corporation of the County of Elgin be delegated to the Director of Finance and the Chief Administrative Officer. - Carried. CORRESPONDENCE Items for Consideration Betty de Haan, CMO, CAO/Clerk, Township of South Stormont, with a resolution requesting the provincial government to provide for simultaneous dispatch for EMS and Fire Response. 2. Brenda J. Tabor, Clerk, Oxford County, with a resolution requesting the provincial government to grant municipalities the authorization to effectively eliminate capping in any or all of the protected property classes. 3. Kerry Costello, Town Clerk, Smiths Falls with a resolution petitioning the provincial government to increase its annual grants to 15% of library revenue. 4. Carolyn J. Kett, A.M.C.T. Town Clerk, with a resolution petitioning the Premier of Ontario to amend the Ombudsman Act to include hospitals under the jurisdiction of the Ombudsman. 5. County Council Items for Information (Consent Agenda) June 23, 2009 Association of Municipalities of Ontario, Member Communication ALERT; 1) "Province Passes Green Energy Act"; 2) "Ministry of Municipal Affairs and Housing Signs $1.2 billion Housing Agreement with Federal Government". 2. Joe Preston, M.P. Elgin-Middlesex-London, supporting the County's submission of the Enabling Accessibility Fund Application. 3. Hon. Steve Peters, M.P.P., Elgin-Middlesex-London, announcing provincial government funding for new school accommodations and improvements. 4. Paul Bode, President, St. Thomas Elgin General Hospital Foundation thanking County Council for 6-year financial commitment. Hon. Peter Julian, M.P., thanking council for supporting the ban of polybrominated diphenyl ethers (PBDE's). William Shurish, Executive Director, Quad County Support Services, thanking Council for the $2,000.00 grant. 7. Hon. Steve Peters, M.P.P., Elgin-Middlesex-London, expressing concerns to Minister of Energy & Infrastructure and Minister of Finance regarding Lake Erie shoreline erosion in Elgin County. OTHER BUSINESS Statements/Inquiries by Members Councillor Wilson noted he had received a letter from Middlesex County Councillor Doug Reycraft whereby Councillor Wilson agreed to become a member of their Community Schools Alliance. The group is questioning the actions of the school boards across the province, particularly the closing of rural schools. Councillor Wilson also noted that from July 8 - 11, 2009 the Canadian Horseshoe Pitching Championships will be taking place at the East Elgin Community Complex. Councillor Wilson extended an invitation for all County Councillors to attend opening ceremonies. Councillor Marks asked the Director of Engineering about the status of the Jamestown Bridge. The Director of Engineering replied the best estimate puts completion of the bridge approximately 3 - 4 months away. Councillor Habkirk extended an invitation to a special meeting for SCOR on June 30, 2009 in Tillsonburg, where all five county partners will be in attendance.
