"BEING A BY-LAW TO AMEND BY-LAW 26-13 AND AUTHORIZE THE REMOVAL OF
CERTAIN HIGHWAY SEGMENTS FROM THE COUNTY OF ELGIN HIGHWAY NETWORK
AND TRANSFER JURISDICTION TO THE APPLICABLE LOWER -TIER MUNICIPALITY"
WHEREAS section 52(3) of the Municipal Act, 2001, S.O. 2001, c 25 (the "Act') sets out that if
a highway forms part of the upper -tier highway system, the upper -tier municipality has
jurisdiction over the highway;
WHEREAS section 52(4) of the Act provides that an upper -tier municipality may remove a
highway, including a boundary line highway, from its system.
WHEREAS section 52(5) of the Act provides that if a highway is removed from an upper -tier
highway system, it is under the jurisdiction of the lower -tier municipality in which the highway
is located.
WHEREAS section 30 of the Act provides that a highway is owned by the municipality that has
jurisdiction over it, subject to any rights reserved by a person who dedicated the highway or
any interest in the land held by any other person.
NOW THEREFORE BE IT RESOLVED THAT the Municipal Council of the Corporation of the
County of Elgin enacts as follows:
THAT the highways, or portions thereof, identified in Schedule "A" to this by-law are
hereby removed from the County of Elgin highway system and transferred to the
applicable lower -tier municipality having geographic jurisdiction over such highway or
portion thereof.
2. THAT the structures identified in Schedule "A", forming part of the highway identified
therein, and any approach to the structure under the jurisdiction of the County of Elgin
by reason of statute, agreement or title are hereby removed from the County of Elgin
highway system and transferred to the applicable lower -tier municipality having
geographic jurisdiction over such highway or portion thereof.
3. THAT By-law 26-13 is hereby amended to remove the highway segments and
structures identified in Schedule "A" from the County of Elgin highway system; and
4. THAT this by-law may be registered in the Land Registry Office for the Land Titles
Division of Elgin No. 11.
