"BEING A BY-LAW TO ADOPT OFFICIAL PLAN AMENDMENT NO. 01-26 TO THE
COUNTY OF ELGIN OFFICIAL PLAN 2024"
WHEREAS, Subsection 17(22) of the Planning Act, R.S.O. 1990, Chapter P. 13, as amended,
states that council may by by-law adopt an official plan; and
WHEREAS the County of Elgin did adopt by-law 24-17 being a by-law to provide for the
adoption of the official plan for the County of Elgin; and
WHEREAS pursuant to Subsections 21(1) and 22 (1), council may initiate an amendment of
any official plan that applies to the municipality.
NOW THEREFORE BE IT RESOLVED THAT the Municipal Council of the Corporation of the
County of Elgin enacts as follows:
1. THAT Amendment No. 01-26 to the County of Elgin Official Plan (2024) consisting of
the attached amendment (Schedule `A') and supporting documentation is hereby
adopted.
2. THAT this by-law will come into force and take effect on the day of its final passing by
the Council of the Corporation of the County of Elgin.

The preamble does not constitute part of this Amendment.
The purpose of this Amendment is to establish a site -specific policy to permit a large-scale
agri-tourism use associated with the existing Clovermead Adventure Farm operation on an
approximately 11-hectare portion of the lands municipally known as 11302 and 11460 Imperial
Road, Township of Malahide. The Amendment recognizes the large-scale agri-tourism use as
a site -specific non-agricultural use within the Agricultural designation while maintaining the
Agricultural designation and the long-term agricultural function of the balance of the subject
lands.
This Amendment also establishes a new Part 14.0 — Modified Policy Areas within the County
of Elgin Official Plan to provide a framework for identifying and implementing site -specific
policies that modify or provide exceptions to the otherwise applicable policies that modify or
provide exceptions to the otherwise applicable policies of the Plan. The site -specific policy
applying to 11302 and 11560 Imperial Road constitutes the first Modified Policy Area
established under 14.0.

PART B — THE AMENDMENT
The Official Plan for the County of Elgin is hereby amended by adding a new Part 14.0
following Part 13.18 as follows:
Part 14.0 Modified Policy Areas
The policies of this Part apply to lands where site -specific permissions or exceptions to the
otherwise applicable policies of this Plan have been established by amendment to this Plan.
Unless specifically modified by the polies of this Part, all other applicable policies and land use
designations of this Plan shall continue to apply.
14.1 Modified Policy Area 1 - 11302 and 11460 Imperial Road, Township of Malahide as per
By-law No. 26-32.
Notwithstanding any other policy of this Plan to the contrary, on the approximately 11-hectare
portion of the lands municipally known as 11302 and 11460 Imperial Road and identified
herein, a large-scale agri-tourism use associated with the existing agricultural operation,
including associated visitor -oriented activities, facilities and infrastructure, may be permitted as
a site -specific non-agricultural use within the Agricultural designation. The site -specific
permission shall apply only to the lands identified herein. The balance of the subject lands
shall remain subject to the Agricultural policies of this Plan and shall continue to be maintained
for agricultural uses and purposes.
