PURPOSE: To consider a proposed amendment to the Zoning By -law of the former Township of Aldborough. The proposed amendment would change the zoning of lands lying between Douglas Line and Furnival Road north of the Lake Erie shoreline in Port Glasgow from the Hamlet Residential (HR) Zone to a 'site specific' Hamlet Residential Holding (HR-#-H) Zone and from the Hamlet Residential (HR) Zone to a 'site- specific' Hamlet Residential (HR-#) Zone. The change in zoning would permit the re- configuration of existing lots, one of which is occupied by a cottage. The lands proposed to be re -zoned 'site- specific' Hamlet Residential Holding (HR -H) comprise an area of approximately 1,065 square metres (0.3 acres) and are without frontage on a public road. The parcel, which is owned by Audrey Miller, is in the process of being enlarged through the conveyance of abutting lands to the south (Application E 86/09) subject to, amongst other matters, appropriate zoning being in place. The lands are vacant and no buildings or structures are proposed at this time. A 'site- specific' (HR zoning is proposed to permit the creation of a lot without frontage on a public road. Application of the holding (H) symbol would prevent development of the lands until such time as a geotechnical report is prepared, a certificate of approval is issued for an on -site waste disposal system, a minor variance is granted from the minimum setback requirements from the one hundred year erosion limits of Lake Erie, a permit is issued by the Lower Thames Valley Conservation Authority and an extension of Douglas Line as may be necessary to provide adequate access is undertaken. The lands proposed to be re -zoned 'site- specific' Hamlet Residential (HR-#) comprise an area of 3,005 square metres (0.7 acres) but are without frontage on a public road. The parcel, which is owned by Robert Miller, is occupied by a single unit dwelling (described as a 'cottage') erected circa 1996. A 'site- specific' (HR zoning is being proposed to permit the creation of the newly configured parcel without frontage on a public road. The subject lands are designated `Lakeshore Recreation' in the Township of Aldborough Official Plan. The proposed amendment is considered to be in conformity ANY PERSON may attend the public meeting and /or make a written or verbal representation either in support of, or in opposition to, the proposed amendment. IF A PERSON OR PUBLIC BODY that files an appeal of a decision of the Council of the Corporation of the Municipality of West Elgin in respect of the proposed zoning by -law does not make oral submissions at a public meeting or make written submissions to the Council of the Corporation of the Municipality of West Elgin before the proposed zoning by -law is adopted, the Ontario Municipal Board may dismiss all or part of the appeal. Background 2. Current Proposal 81 #0008/1821 SUBJ: Proposed Severance Victor Matos 22102 Gibb Line Part of Lot 9, Concession 1— north side of Gibb Line west of Furnivai Road (County Road No. 103) former Aldborough In January 2010, Georges Joan Beauregard submitted an application to create a lot out of a 20.2 hectare (50 acre) parcel for the purpose of disposing a surplus farm dwelling. The lot would have a frontage of 76.2 metres (250 ft), a depth of 282 metres (925 ft) and an area of 2.1 hectares (5.3 acres). The remaining land, having an area of 18.1 hectares (44.7 acres) were intended to be conveyed to Cheryl and Victor Matos, owners of the abutting lands to the west. At the meeting on January 28, 2010, Council was advised that the Matos' were not in favour of merging the lands being conveyed with the abutting farm. In addition, concern was expressed with the size of the proposed residential lot. It was concluded that the rear lot line should be 'pulled in' by 7.6 metres (25 ft) to reduce the depth to 274 metres (900 ft), and to reduce the frontage (width) of the lot by 6.1 metres (20 ft) to 70.1 metres (230 ft). The area of the lot would be reduced to 1.9 hectares (4.8 acres) compared with the original proposal. Mr. Victor Matos now proposes (dated 14 April 2010) to create a residential lot for the purposes of disposing a surplus farm dwelling, as described above, with the following revisions: a) Mr. Matos intends to purchase the subject lands from Georges Joan Beauregard, and convey the proposed residential lot to an, as yet, unspecified third party. The lands being retained by Mr. Matos, comprising an area of approximately 18.2 hectares (45 acres), would remain as a 'stand alone' lot and would not be merged in title with abutting lands which he owns along with Cheryl Matos to the west; Victor illiatos Proposed Severance Municipality of West Elgin May 25, 2010 page 2 #0008/9829 b) While the frontage of the proposed residential lot has been decreased from 76.2 m (250 ft) to 70.1 m (230 ft), the depth of the lot remains at 281.9 m (925 ft) with no rationale provided by Mr. Matos for not decreasing it to 274 m (900 ft) as determined previously. 3. Conclusions The current proposal is not materially different than the one considered by Council in January 2010 with the exception that it now appears the application will be submitted in the name of the proposed purchaser. Our comments and recommendation contained in the Memorandum dated 25 January 2010 stand with the necessary revisions are provided below: 4. Recommendation That the proposed application for consent be supported (based on the lands being first transferred, in title, to Victor Matos) subject to the following conditions and, upon receipt of an Application for Consent in the name of Victor Matos, the Elgin Land Division Committee be advised accordingly: 1) That the requirements of the Municipality, if any, are satisfied with respect to the existing on -site sanitary waste disposal system serving the dwelling on the lands being conveyed; ii) That the depth of the lands being conveyed be reduced to a maximum of 275 metres; iii) That the frontage of the lands being conveyed be reduced to a maximum of 70 metres; iv) That the lands being conveyed be re -zoned to 'site- specific' Special Agricultural (A2 to permit their size and use for residential purposes; v) That the lands being retained be re -zoned 'site- specific' Agricultural (A1 to prohibit the erection of a dwelling thereon in the future. (Donald McIntyre) 20383 Kintyre Line 802 #000811858 At its meeting on 22 April 2010, Council considered the above -noted proposed severance for the purposes of disposing a surplus farm dwelling. Council was supportive of the severance contingent on the owner reconfiguring the lot boundaries to minimize the loss of productive agricultural land (particularly between the dwelling and Kintyre Line) and was prepared to consider a revised proposal to this end. As originally proposed, the rectangularly- shaped lot to be created would have a frontage of 67 metres (220 ft) on Kintyre Line, a depth of 229 metres (751 ft) and an area of 1.5 hectares (3.8 acres). The remaining lands (i.e. balance of the parcel) would have area of 69.3 hectares (171.2 acres). Now being proposed is an irregularly- shaped lot having a significantly reduced frontage of 10.7 metres (35 ft), a depth of 245 metres (804 ft) and an area of 0.9 hectares (2.3 acres). The lot narrows appreciably between the dwelling and the road and is intended to be sufficient to accommodate the existing driveway to access the dwelling including adjacent lands to serve as landscaped open space between the driveway and the cultivated lands on either side. The remainder of the farm would be increased by a modest amount in area to 69.9 ha (173 ac). Based on discussions with Mr. Donald McIntyre, the reduction in the size of the proposed lot is appropriate and will suit his needs. The re- configured lot will preserve as much productive agricultural land as possible without compromising access to the dwelling. The creation of 'flag- shaped' lots has been accepted in the past, such as in the case of E. Wilson (part of Lot 8, Concession 1) and J. Miller (part of Lot B, Concession IX) in the interests of minimizing the loss of agricultural land. The lot proposed to be created to dispose the surplus farm dwelling would require a re- zoning to Special Agricultural (A2) given its size and use for residential purposes. The lot would satisfy the minimum lot area and maximum lot area requirements (4000 sq m and 1.0 ha respectively) of the A2 zone, but would have less than the minimum tot frontage McIntyre Clan Ltd. Halwa, MCIP, RPP #0008/1858 requirement of 50 metres and would exceed the maximum lot depth to lot frontage ratio of 3:1. The proposed lot, as reconfigured, now comprises a frontage of 10.7 metres and a lot depth to frontage ratio of 23:1. A'site- specific (i.e. A2- zoning would be required to permit these deficiencies. Notwithstanding the designation of the lands as 'Aggregate Resources' in the Official Plan, Council has concluded that the proposed severance constitutes a legitimate surplus farm dwelling as contemplated by the Provincial Policy Statement and the Township of Aldborough Official Plan. No further information is expected from the owner regarding the aggregate resource potential of the subject lands. That the proposed application for consent be supported subject to the following conditions and the Elgin Land Division Committee advised accordingly: i) That the requirements of the Municipality, if any, are satisfied with respect to the existing on -site sanitary waste disposal system serving the dwelling on the lands being conveyed; That the lands being conveyed be re -zoned to 'site- specific' Special Agricultural (A2 to permit their size and use for residential purposes, and to permit the creation of a lot having less than the minimum lot frontage requirement and which exceeds the maximum lot depth to frontage ratio; ill) That the lands being retained be re -zoned 'site specific' Agricultural (A1 to prohibit the erection of a dwelling thereon in the future. REASONS i) The severance is 'consistent with' the Provincial Policy Statement; ii) The requirements of the Township of Aldborough Zoning By -law are capable of being satisfied; iv) The matters set out in the Planning Act would be satisfied. Purpose to create a lot out of a 42.3 hectare (104.5 acre) parcel for the purpose of disposing a surplus farm dwelling; the lands proposed to be conveyed have a frontage of 52 metres (171 ft), a depth of 61 metres (200 ft) and an area of 3,172 square metres (0.8 acres). The parcel is occupied by a single unit dwelling (circa 1900) and a detached garage. No change in use is proposed; the lands being retained have a frontage of approximately 720 metres (2,362 ft) and an area of 42 hectares (103.7 acres). The lands have been primarily cleared for agricultural purposes with the exception of a two barns and a chicken coop, all of which are proposed to be removed from the parcel. An oil well is situated in the northwesterly portion of the parcel. No change in use is proposed; the current owners of the subject lands, Herman Kathyrn Minnema, purchased the farm this year (May 7th 2010) from the Estate of Mary Gilchrist and the dwelling, which is now vacant, is considered surplus to their needs. A small residential lot was previously created (date unknown) out of the westerly portion of the farm; neighbouring lands comprise a mix of agricultural uses, primarily cash crop. Rural residential development is scattered and limited in the area. No large livestock operations have been identified by the owners in the vicinity of the proposed lot. 2. Provincial Policy Statement (PPS) and Official Plan Herman Kathryn Minnema Proposed Severance Municipality of West Elgin May 21, 2010 page 2 ##0008/1875 in prime agricultural areas, the creation of a lot for the purpose of disposing a residence surplus to a farming operation is permitted by the PPS. A surplus residence is defined as: an existing farm residence that is rendered surplus a result of farm consolidation and farm consolidation as: the acquisition of additional farm parcels to be operated as one farm operation; in this instance, the dwelling on the lands being conveyed would be surplus to the needs of the Minnemas' whose principle residence is located on a farm at 11811 Largie Road in the Municipality of Dutton Dunwich. They also own a farm at 26654 Stalker Line in West Elgin and own and farm other lands having a total acreage of approximately 526 hectares (1,300 acres); the PPS requires that residential dwellings are prohibited on any vacant remnant parcel of farmland created by the severance. Such a restriction is appropriately addressed as a condition of consent, if granted, through the application of a 'site- specific' zoning consistent with the practice of the Municipality. The application would be consistent with the PPS; the subject lands are designated 'Agricultural' in the Township of Aldborough Official Plan. The creation of residential lots to dispose surplus farm dwellings in areas designated `Agricultural' is permitted provided: a) the dwelling was in existence prior to adoption of the Plan; b) it is not practical or feasible to relocate the dwelling to an existing vacant lot; c) the dwelling is structurally sound and suitable for human occupancy; d) the remainder of the farm is zoned to prohibit a dwelling (Section 2.1.15). the abovenoted criteria are satisfied or are capable of being satisfied. The owners have advised verbally that the dwelling and detached garage are structurally sound. Other criteria to be satisfied include compatibility with surrounding lands use, availability of a water supply, suitability of the lot for on -site sanitary waste disposal, access and compliance with the Zoning By -law; the owners have confirmed that the dwelling on the lands being conveyed is serviced by an on -site water supply (well), with connection to the municipal piped water supply on Downie Line possible, if necessary. Confirmation will be required to ensure that the existing septic tank and tile field system is wholly contained on the proposed lot. The lands being retained have a separate field entrance from the road. No new or additional entrances are required or proposed; 3. Zoning By -law #0008/1875 based on the information provided, conformity with the Official Plan of the Township of Aldborough appears capable of being maintained. the subject lands are zoned Agricultural (Al). The proposed residential lot would require a re- zoning to Rural Residential Three (RR3) given its use and size. The lot would satisfy the minimum lot area, maximum lot area and minimum lot frontage requirements (1,850 sq m, 4,000 sq m and 30 m respectively) of the RR3 zone. Based on the sketch provided, all other yard requirements are capable of being satisfied; the lands being retained would satisfy the minimum lot area and lot frontage requirements (19 ha and 150 m respectively) of the Al zone. The two barns and chicken coop are proposed to be removed which is appropriately addressed as a condition of consent, if granted. A re- zoning to 'site- specific' Agricultural (A14) would be required to prohibit a dwelling being erected on the parcel in the future as stipulated by the PPS and the Official Plan. 4. Conclusions the proposed severance would represent a type of lot creation which is both contemplated and permitted by the Provincial Policy Statement (PPS) and the Township of Aldborough Official Plan. The Official Plan provides for the creation of lots to dispose a surplus farm dwelling in agricultural areas. 5. Engineering) dated 12 August 2008 was submitted. A draft agreement was prepared and forwarded to Mr. Vanden Boomen for review and execution, however, execution of the agreement never took place. The owner is now interested in proceeding with the project and has submitted further revised site plans dated 22 April 2010 and, just recently, 20 May 2010 the latter plan comprising revisions based on further discussions with the owner and his engineer. The April 2010 plan has been reviewed by the Municipality's Chief Building Official, Mr. Lorne McLeod, and by the Municipality's Drainage Superintendent, Mr. John Unger. Neither have any outstanding issues or concerns with respect to the plan. We wish to draw attention to the following revisions to the site plan: 1) Buildings: The size of the proposed office/mini-storage warehouse in Phase I of the development has been increased considerably by including, now all as one building, what was originally proposed as a 'stand alone' building to the west in a subsequent phase. A future expansion of the building proposed to be erected in Phase I is contemplated. The number of buildings proposed to be erected in Phase I has been reduced from three to two. The system is now in full operation, but has been observed to have low residual chlorine levels in certain watermains that are not looped and have low water consumption levels. To maintain adequate chlorine levels, regular watermain flushing has been required, a process that is time consuming and results in a significant water Toss on a long term basis. The proposed solution is to construct a new facility that would rechlorinate and recirculate water. The proposed facility would consist of a small concrete block brick building (estimated about 12 ft x 12 ft, or equivalent area), to house the required recirculation and rechlorination pumps and associated equipment. A series of remote controlled isolation valves and flow control devices would be installed at strategic locations within the Graham Road water system to control water flow. If feasible, the building would be located within a municipal road allowance to avoid purchasing property. The budget for facility construction is estimated at $250,000 to $300,000., excluding consulting fees. The project will be managed by Spriet Associates, with John Spriet as Project Manager. In addition to project management, Spriet Associates will be responsible for site location and site /building design. The Municipal Infrastructure Group (TMIG) are proposed to be retained as a subconsultant for design of the recirculation, rechlorination and control systems. Design fees for TMIG are estimated to be $50,000. to $60,000. Construction supervision would be managed by Spriet Associates, with TMIG assistance. A Schedule B Municipal Class EA was completed for the Graham Road Watermain project. A preliminary discussion with Bill Armstrong, MOE Planner, indicates that the proposed project would likely require an Addendum to the Class EA. However, Class EA procedures would be minimized.
