10-11COUNTY OF ELGIN By-Law No. 10-11 "TO AMEND BY-LAW NO. 05-35 BEING A BY-LAW TO AUTHORIZE SPEED LIMITS" WHEREAS pursuant to Section 128, Subsection 2, of the Highway Traffic Act, being Chapter H.8, R.S.O. 1990, as amended, the council of a municipality may by by-law prescribe a different rate of speed for motor vehicles driven on a highway or portion of a highway under its jurisdiction than is prescribed in Section 128, Subsection 1 (a); and WHEREAS the County of Elgin did pass By-Law No. 05-35 prescribing different rates of speed for motor vehicles on certain highways under its jurisdiction; and WHEREAS it is deemed expedient to amend said By-Law to prescribe a different rate of speed on certain highways under its jurisdiction. NOW THEREFORE the Municipal Council of the Corporation of the County of Elgin enacts as follows: 1. THAT a maximum rate of speed of 50 km/hr be established for a section of Calton Line (County Road #45) From the east property line of Springfield Road to 959 metres east, in the Township of Malahide, be posted at 50 km/hr. THAT a maximum rate of speed of 50 km/hr be established for a section of Imperial Road (County Road #73) From 530 metres south of the south property line of Nova Scotia Line to 517 metres north of the south property line of Nova Scotia Line in the Township of Malahide, be posted at 50 km/hr. THAT a maximum rate of speed of 60 km/hr be established for a section of Calton Line (County Road #45) From 177 metres west of the west property line of Richmond Road to 2450 metres east of the west property line of Richmond Road, in the Municipality of Bayham, be posted at 60 km/hr. 2. THAT the penalties provided in Section 128, Subsection 14, of the Highway Traffic Act, shall apply to offences against this By-Law. 3. THAT this By-Law becomes effective once signage setting out the speed limit has been duly posted. READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 13th DAY OF APRIL 2010.
