Council Public Meeting Zoning Amendment (Statkevicius) DISPOSITION: Carried SUBJECT: CATHERINE STREET DRAINAGE ISSUE In attendance: Chief Building Official The Chief Building Official reported that the Drainage Superintendent has taken elevations at the rear of the subject property. It has been determined that the berm is September 9 /10...Pg 2 of 13 different than what is shown on the approved pian. It is lower at the north end by 8 inches and at the southern end by 10 inches. The approach to the berm is also lower. Staff do not believe that water is running over the berm into the adjacent property. After discussion, Council agreed that it is the responsibility of the present landowner to ensure that the grading is in accordance with the approved plan. The Chief Building Official left the meeting. SUBJECT: ROAD DEPARTMENT REPORT The Road Superintendent presented his monthly report. He further reported that the Ministry of Natural Resources is requiring an environmental report on the lands proposed for the gravel pit expansion. SUBJECT: RECREATION DEPARTMENT REPORT The Recreation Superintendent presented his monthly report. He provided an update on the arena renovations. The project is being delayed, as the control panel for the compressor had not been received to date. SUBJECT: PORTABLE SIGN Council reviewed a report regarding the portable sign. The Chamber of Commerce and Recreation Committee purchased this sign. He is proposing that the sign should be used for special events only and an agreement be signed. Written agreement from the landowner plus a deposit or rental fee should be required as well. Councillor Wolf arrived. SUBJECT: GRANDSTAND The Recreation Superintendent reported that an estimate for renovations has been prepared by Spriet Associates. The estimate for roof, new steel siding, new seating and steps, demolition, engineering and contingency is approximately $173,000. The food booth will be gone and accessibility is not addressed. He feels that vandalism must be addressed before any money is expended. Access to the grandstand needs to be restricted. The Deputy Mayor reported that with this information, the Fair Board would apply for a Trillium Grant. He noted that there are few covered grandstands in the area and the Fair Board feels with renovations, the grandstand would be used more often. The band shell would not be replaced with a permanent structure. SUBJECT: WATER DEPARTMENT REPORT The Acting Water Superintendent presented his monthly report. Council received the report on the adverse quality incident on July 27, 2010. The Acting Water Superintendent reported that the auto flushers have been installed; one at intersection of Dunborough and Dymock. He will report on the amount of water used at the next meeting. The Deputy Mayor noted that Council should review the size of lines on small lines and deadends. SUBJECT: INTERCONNECTION AGREEMENT WITH SOUTHWEST MIDDLESEX The Administrator reported that principles for an agreement have been agreed upon. Southwest Middlesex is preparing a formal agreement. DISPOSITION: Carried SUBJECT: CHANGES TO HUMAN RESOURCES POLICY The Administrator presented two reports outlining requested changes to the Human Resources Policy originating from staff. Council agreed with the requests. Two matters still to be reviewed are the bereavement policy and Canada Day staffing. SUBJECT: RURAL DEVELOPMENT OFFICER REPORT The Rural Development Officer presented her monthly reports for July and August 2010. She reported that 25 tables have been reserved for the Rural Expo to date. SUBJECT: BUILDING REPORT The Chief Building Official was not in attendance. Council reviewed the monthly reports far June and July 2010. In June eight permits were issued totalling $213,800.00 worth of construction. in July seven permits were issued totalling $90,000.00 worth of construction. SUBJECT: BY -LAW ENFORCEMENT REPORT Council reviewed the By -law Enforcement report. September 9110...Pg 4 of 13 DELEGATION: WAYNE BEETON, ELAINE PULLEN RE: CANADA POST PROPOSAL FOR WEST LORNE Also in attendance: Road Superintendent Mr. Beeton noted that he is in attendance on behalf of Stewart Bacon CEO of Canada Post, as requested by Council. The Deputy Mayor outlined the reasons for opposition to community mailboxes in West Lorne. Council is asking Canada Post to reconsider the closing of the postal outlet. Mr. Beeton reported that Canada Post has programs for snow clearance, vandalism, maintenance, sites are graded. In response to question on freeze /thaw events, Mr. Beeton reported that sanding is completed in conjunction with snow removal only. The Road Superintendent reported that he had toured the proposed sites with Elaine Pullen. There will be 15 locations. The Deputy Mayor reported that MP Joe Preston would be asking for an extension on our behalf to allow for more time to work with our community. This would give an opportunity for public discussion and have Canada Post provide explanations to the public. Mr. Beeton noted that he was aware of the request for an extension, this is being considered. No timeline for an answer was given. SUBJECT: DRAINAGE APPORTIONMENT CRABBE DRAIN RES. DISPOSITION: Carried SUBJECT: MOE INSPECTION REPORT RODNEY SEWAGE TREATMENT PLANT RES. NO. 11 Moved by Balint Seconded by Bodnar RESOLVED that the Council of the Municipality of West Elgin accepts the Ministry of Environment Communal Sewage Inspection Report for the Rodney Sewage Treatment Plant. DISPOSITION: Carried SUBJECT: CONSIDERATION MEETING DANBY DRAIN Also in attendance: John M. Spriet, P Eng, Danuta Kekys, John Wilson, Henk Dieker, Peter Muffels, Terry Lebedz RES. NO. 12 Moved by Balint Seconded by Bodnar RESOLVED that Council consider the Engineer's Report on the Danby Drain. DISPOSITION: Carried The Engineer provided a summary of the construction of the drain. He noted that a portion of the drain would be abandoned. Construction will occur on the open drain. The report also updates the maintenance schedule to reflect severances. Mrs. Kekys stated that she shouldn't pay, using her land to correct a problem. The Engineer noted that the ditch is being cleaned at the bottom, allowances will be given. Assessment issues should be taken to Court of Revision. Mr. Dieker asked why proceeding when Mr. Wilson's problem has been solved. The Engineer reported that a request was made under Section 78 of the Drainage Act. Field inspection showed a lot of water in the ditch 6 to 18 inches. Mr. Wilson noted that when he built his house in 1998 there was a 3 foot fall, now it is 2 feet under water. The ditch is full of water and needs to be cleaned out. The Engineer noted that the engineer report cannot be ignored, maintenance needs to be done. September 9110...Pg 6 of 13 RES. DISPOSITION: Carried SUBJECT: DRAFT BY -LAW BUSINESS IMPROVEMENT ASSOCIATION Also in attendance: Keith Fretter, Irene Puddester Mr. Fretter requested Council reconsider the following items in the latest draft by -law: Section 4 collaborate Section 5 does not agree with minimum /maximum board members. Needs 7 members to operate. Why equal members from the two villages? Section 8 what if Board does not have 7 members? Associate membership leave in by -law After discussion, Council agreed on the following: Section 4 no change Section 5 7 members, equal members from Rodney and West Lorne Section 8 If Board appointments are Tess than 7, Council will appoint from general membership to reach 7 total Section 12 clarify that executive members of board (e.g. Chairperson) can vote Associate membership leave out of by -law at this time, revisit in the future. Council directed that a new by -law be drafted for next Council meeting and a public meeting be scheduled. SUBJECT: WEST ELGIN PRIMARY SYSTEM Council received the report from Stantec Consulting, dated August 10, 2010, regarding Dutton Dunwich reduced water taking modelling analysis. This letter was discussed at the recent Tri County meeting at which the Chair asked Stantec to contact the Dutton Dunwich engineers and discuss the issues. Council directed this matter be brought back at the next meeting for updates. Council directed that the by -law be re- drafted and the new Council schedule a public meeting. DELEGATION: PORT GLASGOW YACHT CLUB Also in attendance: Ken Strong, Bob Carey Mr. Strong is acting as the solicitor for the Port Glasgow Yacht Club and is here today to speak on Havens Lake Road closure proposal. He referred to a staff report, dated September 23` outlining the steps to be taken. He suggests that there will be a negative impact if the road is closed. He feels that it is incorrect to say the lands are surplus and that you would lose natural heritage (views) if closed. If Council declares the land surplus, he requests that the Yacht Club be given the opportunity to purchase the lands and referred to the "first right of refusal" clause that is in the agreement with the municipality. He requests that the Yacht Club be treated fairly and continue the spirit of cooperation. He asks that Council defer any decisions until after the election so that a solution can be worked out. The Clerk reported that the Ontario Realty Corporation staff have verbally advised that the following principle would apply if the municipality sold the lands that were transferred from the province: "municipality does not profit from any future sale of the land No affirmative answer has been received yet. She further advised that the appraisal has been received. The Deputy Mayor suggested that discussions should be held with the Yacht Club and suggested a committee be set up to do this. There are five matters that are in discussion with the Ministry: Modification #22 Modification #25 Modification #39 Lands on north side of Gray Line Boundary for Port Glasgow The Planner further reported that the lands at the south end of Rodney on Pioneer Line are designated as industrial and he feels commercial would be more applicable due to today's uses. Council agreed to request a combined industrial /commercial designation, which gives more flexibility to the property owners. Council does not feel that notice to the property owners is required. The modifications will be presented at the next meeting for endorsement. SUBJECT: 5 -YEAR PROVINCIAL POLICY STATEMENT REVIEW The Planner presented a report outlining topics that should be forwarded to the Ministry in response to this review. He further noted that the case of a surplus dwelling where there are 2 farms dwellings without the farmer owning other lands should be addressed and permitted. Council directed that the Planner submit a report on the municipality's behalf. DELEGATION: STAN CAVENEY, THAMES TALBOT LAND TRUST Mr. Caveney presented a PowerPoint presentation outlining the goals of the Land Trust and the neea to increase our forest coverage. Thirty percent is required to be a sustainable, healthy ecosystem (West Elgin is 15 The Land Trust has undertaken a campaign to purchase the Tanager Tract, a 100 -acre Carolinian forest located at the southwest corner of Queens Line and Kerr Road. He asks for the municipality's assistance in deterring the amount of illegal dumping along Kerr Road by erecting signs and discussing the access point to the property off Queens Line and Kerr Road. The Mayor noted that we have to witness people dumping to get conviction and signs don't work. Volunteer groups need to let us know when a clean -up is required. With the installation of the new Elgin County gateway signs various old and not so old signs were removed from the highway 3 western entrance of our municipality. 4. Rehabilitation of Kearns pit 2 was started and a large portion has been completed. Grass seed is already sprouting with the wet weather we have been experiencing. 5. The renovations are 98 complete and the compressor installation is about 80 compete. The soap dishes in the dressing rooms need to be replaced and as of October 11 the natural gas refuelling pump has yet to be connected. We also have warm water from the circulation water line feeding the cooling loop for the cr.. npressor. We have warm water trying to cool the compressor. The computer control system is not yet functioning with the refrigeration system, we are operating on the secondary system, the HVAC system has yet to operate as intended, and yea we are opening on the 16"'. The park benches have arrived and they do look very nice. The 6 benches have been installed at the pool, a little late but they are there. The cement pads for the remaining 14 benches are scheduled to be installed during the week of October 12 the benches and garbage receptacles will be installed shortly thereafter. On Sunday night October 10 2010. I received Information regarding the possibility that some youth had started a fire in the stage area at Rodney Park. Upon investigation at approximately 7 pm we found an area on the stage where they had indeed started a fire in the north east corner. They had taken straw from the horse barns and stuffed it between the wall and the stage and started it on fire. The support post is 98 burned through and minimal damage was sustained to the rest of the structure. As a precaution we took the RFD Tanker over and applied water to the area to insure that the fire was out. We also inspected the area under the grand stand. The Driving Club was contacted as the lights were on in one of the barns. The Police were called and a report was filed. All of the park washrooms have been winterizes and the Water Department has been notified to remove the water meters. I attended an Emergency Management Ontario St. Clair Sector meeting at the end of September and they indicated that we were losing our sector office but we will be absorbed by the other sector officers until they make their own internal changes. There was a very informative session done by the Town of Leamington regarding their experiences with regards to the tornado. On October 5 6 I attended the CEMC training in London and acquired my CEMC designation. With the upcoming election and the degree of training that we need to complete West Elgin will not be in compliance by December 31 2010. However we will make every effort to complete the required training and exercise prior to December 31 it may not be attainable. The automatic door closer has been installed at the front door, and as of Friday October 8 it was operating as intended. After close monitoring of pressures and chlorine levels it ran as if nothing had been changed. 3.We are still playing with the auto flushers to try and have them run as little as possible, while still maintaining good chlorine levels.The colder weather should help us keep residuals longer in the system with less flushing. 4.The 401 Service Centres opened at the end of the month.With us feeding the Eastbound building water ,this will help chlorine levels down Pioneer Line and generate good revenue. 5.Al1 work orders, locates, and other regular maintenance were completed on time and in an orderly fashion. In June 1989, Bell Cellular began construction of a tower. There has been a lease in place for 24 years with the most current lease with Bell Mobility Cellular Inc. being authorized in 1995 ending on February 28, 2011. DISCUSSION: We have been contacted by CHC Realty Corporation on behalf of Bell Mobility Inc. to renegotiate the current lease. The term of this lease will commence on March 1, 2011 and shall expire on February 28,2016. There is provision to extend the lease for 3 successive five -year terms. The termination clause is 90 days written notice. The annual rent for 2010 is $6500.00 and will be increased by $500.00 for the first five -year term. The rent will be increased by $500.00 per annum for each five -year period thereafter. RECOMMENDATION: That Council authorize renewal of the lease and negotiations to proceed. The lease renewal would be brought to Council closer to the renewal time. j/21 Joanne Groch, B.A., AMCT Ad ministrator/Treasurer 22413 Hoskins Line, Box 490, Rodney, Ontario NOL 200 Tel: (519) 785 -0560 Fax: (519) 785 -0644 8 October 2010 MEMORANDUM TO: Members of Council Municipality of West Elgin FROM: Ted Halwa RE: New Official Plan Ministry Modifications Revised The changes we wish to draw to Council's attention are: #005211608 Attached hereto is the most recent version of the modifications to the new West Elgin Official Plan which with a few exceptions are without substantive change to the modifications provided to you dated 7 September 2010. i) Modification No 17 adds a provision to allow lands to be designated `Commercial' at the south end of Rodney to be used for industrial and related purposes as well, ii) Modification No 23 (formerly #22) further modified to reach a consensus with the Ministry, iii) Modification No. 26 (formerly #25) further modified to reach a consensus with the Ministry, At this point, there remains two outstanding issues which we have not been able to reach an agreement with the Ministry. The first one is the inclusion of the frontage (first 100 m) along the north side of Gray Line as part of the 'Lakeshore Area'. The second one is the defined boundary of Port Glasgow and whether the preparation of a secondary plan ultimately would require the approval of the Province. We have taken the position with the Ministry that the boundary of Port Glasgow shown in the Official Plan should be framed generally by the extensive ravines woodlands in Lots 5 -6 on the west, the north side of Gray Line on the north and Lot 7-8 on the east. The Ministry takes the position that the lands owned by Seaside as they exist at the present time should be included (namely Lot 5, Con XIV). As for the requirement that the secondary plan should take the form of an official plan amendment approved by the Ministry, we have resisted this change as there appears to be little precedence for it elsewhere along the Great Lakes shoreline. While at the end of the day, the Ministry as the approval authority has the ability to make whatever modifications it so wishes in exercising it approval powers, the Ministry does strive to reach a consensus on any modifications being considered. With the aforementioned exceptions, we have reached a consensus on the proposed modifications. For those outstanding issues, we are satisfied that the position being taken by the Municipality is a reasonable and defensible one and in the best interests of the C -yoa New Official Plan Outstanding Matters Municipality of West Elgin 8 October 2010 page 2 (original signed by) Ted L. We would also point out that the approval of the Plan (along with all the proposed modifications) by the Ministry is appealable to the Ontario Municipal Board by any person including the Municipality. We are providing the latest version of the modifications (with the exceptions of changes to the map schedules and figures which will be presented on 16 October 2010) such that Council will be able to formally deal with them in the remainder of its term in office. I hereby approve the Official Plan for the Municipality of West Elgin, adopted by By -law No. 2008 -13, subject to the following modifications. Modification #1 Section 1.6 is modified by inserting the following after the third sentence and by commencing a new paragraph thereafter: The Municipality of West Elgin is responsible for the preparation and adoption of a comprehensive zoning by -law which shall implement various aspects of the Official Plan and shall be in conformity therewith." Modification #2 Draft DECISION With respect to an Official Plan Subsection 17(34) of the Planning Act Section 1.6 is modified by inserting the following at the end of the section: "Matters of provincial interest are further elaborated upon in the Provincial Policy Statement 2005 on land use planning. They shall be considered by the Municipality in the evaluation of any proposed amendment to the Plan; in the adoption of a new comprehensive zoning by -law and any subsequent amendments or variances thereto; in its comments on a plan of subdivision or condominium and on the granting of a consent or any other approval under the Planning Act." Modification #3 Section 2.2.3 is modified by adding the following at the end of the sentence: "in accordance with Section 6.2.3 and other applicable sections of this Plan." Modification #4 Section 2.2.4 is modified by adding the following at the end of the sentence: "in accordance with Section 6.2.2 and other applicable sections of this Plan." Modification #5 Section 3.3.2 is modified by deleting the second sentence and replacing it with the following: October 8 2010 1 The Municipality shall support the protection, restoration, conservation, enhancement and maintenance of natural heritage features." ifiodification #6 Section 3.3.7 is modified by deleting the first sentence and replacing it with the following: "Development and site alteration shall only be permitted in significant woodlands, significant ANSI's and significant valleylands where it is demonstrated that there will be no negative impact on the natural heritage feature or on its ecological functions." Modification #7 Section 3.3.9 is modified by inserting the following between the words "potentially permitted" and "within a significant natural heritage.." in the first sentence: "in accordance with Section 3.3.5, Section 3.3.6 and Section 3.3.7 of this Plan." Modification #8 Section 3.3.10 is modified by deleting the first sentence and replacing it with the following: The retention of woodlots or portions of woodlots that are not identified as 'Woodlands' on Schedule 'B', Map 2 is also encouraged." Modification #9 Section 3.3.11 is modified by deleting the first sentence and replacing it with the following: "The Municipality recognizes the importance of retaining individual trees, woodlots and woodlands, the latter as identified on Schedule 'B', Map 2." Modification #10 A new section is inserted as Section 4.5.1 and the subsequent subsections are renumbered accordingly. "The Municipality recognizes the importance of cultural heritage resources and shall encourage their identification, conservation, protection, restoration, maintenance and enhancement. All development permitted by the land use policies and designations of this Plan shall have regard for cultural heritage resources and shall, wherever possible, incorporate these resources into the proposed development. In addition, all development shall be planned in a manner which preserves and enhances the context in which cultural heritage October 8` 2010 2 resources are situated. The Municipality shall endeavour: a) to ensure all significant cultural heritage resources including heritage buildings, cultural heritage landscapes and archaeological sites are identified, conserved and enhanced: and b) to ensure all significant cultural heritage resources are managed so as to continue their use and maintain their heritage value, integrity and benefit to the community Modification #11 Section 4.5.1 is modified by inserting the words "cemeteries and burials" between the words "archeological sites" and "patterns of development Modification #12 Section 4.5.4 is modified by deleting the last sentence and replacing it with the following: The Municipality may utilize the Heritage Act to conserve significant cultural heritage resources through the designation of individual properties or cultural heritage landscapes and the designation of a group or groups of properties as heritage conservation districts." Modification #13 Section 4.5.5 is deleted and replaced with the following: "Areas exhibiting an archaeological potential shall be determined through the use screening criteria of the Ministry of Tourism and Culture. Where development (including the creation of a building lot) is proposed in an area of archeological potential, an archaeological assessment shall be required prior to final planning approval or as a condition of final planning approval. Archaeological assessment reports shall be conducted by a licensed archaeologist in compliance with the standards and guidelines of the Ministry of Tourism and Culture. The appropriate First Nations shall be provided notification with regard to the identification of burial sites and significant archaeological resources relating to the activities of their ancestors. If the Municipality initiates the preparation of an archaeological master plan, the appropriate First Nations shall be notified and invited to participate in the process." Modification #14 Section 4.5 is modified by adding a new section, being Section 4.5.6: "4.5.6 Cemeteries. Where an identified marked or unmarked cemetery is affected by a October 8` 2010 3 proposed development, the Ministry of Tourism and Culture and the Ministry of Consumer Services shall be notified in accordance with the provisions of the Heritage Act and the Cemeteries Act." Modification #15 Section 5.2.4 is modified by adding the following phrase after the second sentence: "in accordance with Section 5.2.6, Section 10.3 and Section 10.4 and other applicable sections of this Plan." Modification #16 Section 5.2.5 is deleted and replaced with the following: "Natural heritage features shall be protected. Development and site alteration within a natural heritage feature or on adjacent lands shall not be permitted unless it has been demonstrated that there will be no negative impact on natural heritage features or its ecological functions in accordance with Section 3 of this Plan." Modification #17 Section 5.4.1 is modified by adding the following to the end of the section: Lands designated 'Commercial' on Schedule 'C' may also be used for uses permitted under Section 5.5 'Industrial' in accordance with the requirements thereof. Modification #18 Section 5.5.3 is modified by adding the following to the end of sentence: in accordance with Section 8.3, Section 8.4 and other applicable sections of this Plan" Modification #19 Section 5.6.3 is deleted and replaced with the following: "Natural heritage features shall be protected. Development and site alteration shall not be permitted within a natural heritage feature or on adjacent lands unless it has been demonstrated that there will be no negative impact on the natural heritage feature or its ecological functions in accordance with Section 3 of this Plan October 8 2010 4 Modification #20 Section 6.0 is modified by deleting the second sentence of the second paragraph and replacing it with the following: "Although a potential is believed to exist, there are currently no designated specialty crop areas in West Elgin, being areas where specialty crops such as tender fruits, grapes, vegetables, greenhouse crops and crops from agriculturally developed organic soils are predominantly grown." Modification 21 Section 6.1 p) is modified by deleting the word "extraction" and replacing it with words "long term use Modification 22 Section 6.2.2 is deleted and replaced with the following: "Secondary uses may also be permitted where they are limited in scale as prescribed by the Zoning By -law and are clearly secondary to the principle use of the parcel on which they are conducted. Such uses may include home occupations and uses that produce value added agricultural products for the farm operation. Where these new uses would conflict with farming operations or would reduce the farming options or flexibility on adjacent or surrounding farmland, they shall not be permitted. Compliance with the MDS Formula One (MDS I) shall be required." Modification 23 Section 6.2.3 is deleted and replaced with the following: "Agriculturally related commercial and agriculturally- related industrial uses that are directly related to serving the needs of the farm community and are required to be, or benefit by being, in close proximity to farming operations shall be permitted subject to the following criteria: a) a demonstrated need exists for the use within the planning horizon; b) reasonable alternative sites including sites within designated settlement areas which avoid prime agricultural areas do not exist and where a location in a prime agricultural area is being proposed, lower priority agricultural lands are considered; c) specialty crop areas are not impacted and there are no reasonable alternatives which avoid prime agricultural land. Lower priority agricultural lands are considered; d) suitability of the site for the purposes intended October 8` 2010 5 e) availability of an adequate and potable water supply; f) approved waste disposal means or facilities; g) access, or proximate access, to a hard surfaced road subject to the approval of the authority having jurisdiction; h) measures, if need be, to ensure compatibility with neighbouring land uses; i) compliance with the Minimum Distance Separation Formula (MDS 1); j) an amendment to the Zoning By -law and k) entering into a site plan agreement." Modification 24 Section 6.2.4 is modified by deleting the third sentence and replacing it with the following: "While there are no specialty crop areas designated at this time in West Elgin, should such areas be identified in the future, they shall be protected." Modification 25 Section 6.2.6 is modified by deleting subsection b) and renumbering the subsections accordingly and by deleting the last paragraph which begins with the words "While the establishment... Modification 26 Section 6.2.7 is deleted in its entirety and replaced with the following: "To discourage the severing of prime agricultural land into smaller parcels, the minimum area of both the severed and retained parcels shall generally be 40 hectares. Where parcels smaller than 40 hectares are being proposed, they may be permitted subject to the following factors being taken into account: a) the need to discourage the unwarranted fragmentation of farmland; b) the type of agricultural activity common in the area; c) whether the resulting parcels would constitute viable farm units; d) whether the severed and retained parcel are large enough to maintain flexibility for future changes in the type or size of agricultural operations; e) whether the size of the parcels would have a detrimental impact on agricultural productivity, operating efficiencies or future farming options; October 8 2010 6 f) the boundaries of the parcels being created and their effect on the intended use of the lands for agricultural purposes; g) previous lots created out of the parcels including land dedications or expropriations; h) the inadvertent merging of the parcels as a result of the introduction of subdivision control in 1970. Modification 28 Section 6.2.10 is modified by deleting the first sentence and replacing it with the following: "The creation of a lot for the purposes of disposing of a dwelling considered surplus as a result of farm consolidation, being the acquisition of additional farm parcels to be operated as one farm operation, shall be considered in accordance with the following:" Modification 29 Section 6.2.11 is modified by placing a period after the word "basis" in the second sentence and capitalizing the following word "The Modification 30 Section 6.2.12 is modified by deleting the first and second sentences and replacing them with the following: "Dog kennels shall only be permitted as a secondary use on lands designated 'Agricultural' and accessory to a residential use subject to appropriate and effective measures being taken to minimize or eliminate any adverse impacts on neighbouring sensitive land uses, to ensure the peace and safety of neighbouring residents and to properly dispose of animal waste. Sites shall be limited in scale, but shall be sufficiently large enough to provide adequate space for outdoor exercise for the dogs, as well as buffering from neighbouring properties to avoid nuisance complaints." Modification 31 Section 6.2.15, Section 6.2.15.1 and Section 6.2.15.2 are deleted in their entirety and replaced with the following: October 8 2010 7 6.2.15 Alternative and Renewable Energy "The Municipality shall encourage alternative and renewable energy projects such as wind generation. Large scale energy projects which provide electricity into the Province's transmission grid are subject to Federal and Provincial approvals and regulations. The Municipality shall consider the following matters when providing comments during the consultation process on large scale energy projects. a) the potential impact of safety, noise and visual intrusion; b) access to a public road of a standard adequate to accommodate construction equipment, vehicles and maintenance; and c) the ability to contain safety and noise impacts on site." Modification 32 Section 6.4.3 is modified by adding the words "and Section 10.4.4 and other applicable sections of this Plan." after the words "Planning Act" and by deleting the rest of the second sentence in its entirety. Modification 33 Section 6.5.2 is modified by deleting the first sentence and replacing it with: "The creation of new lots for commercial and industrial purposes shall take place by consent or by plan of subdivision in accordance with the provisions of the Planning Act and the relevant policies of this Plan including Section 10.3 and Section 10.4." Modification 34 Section 6.5.5 d) is modified by adding the following sentence to the subsection: "A stormwater management plan /report shall be prepared by the proponent and approved by the Ministry of Transportation for those developments located adjacent to or in the vicinity of Highway No. 401 where storm drainage may impact the highway." Modification 35 Section 6.5.5 e) is modified by adding the following sentence to the subsection: "New entrances, the up- grading of existing residential or agricultural entrances for commercial or industrial uses and/or the creation of new public road entrances shall not be permitted from Furnival Road between McDougall Line and Hoskins Line and from Graham Road between Downie Line and Queens Line. All access for lands so affected shall be provided by alternative roads under October 8' 2010 8 the jurisdiction of the County of Elgin or the Municipality. Modification 36 Section 6.5.5 e) is modified by adding the following sentence to the subsection: "All development within the Ministry of Transportation's permit control area shall be subject to the Ministry's approval." Modification 37 Section 6.5.5 is modified by adding the following subsection: "g) traffic impact study: For major development proposals for large traffic generators within the permit control area of Highway No. 401, the proponent shall prepare a transportation impact assessment in accordance with the Ministry's General Guidelines for the Preparation of Traffic Impact Studies." Modification 38 Section 6.6.2 is modified by deleting the words "Zoning by -law" and replacing them with the words "this Plan" in the second sentence. Modification 39 Section 6.6.3. e) is modified by deleting the third sentence and replacing it with: "Rehabilitation to agriculture and agriculturally- related uses, forestry, conservation and nature reserves shall not require an amendment to this Plan." Modification 40 Section 7.5 is modified by deleting it in its entirety and replacing it with the following: "Port Glasgow on the shores of Lake Erie lies within the 'Lakeshore Area and consists of a small concentration of both year round and seasonal dwellings, campgrounds, a yacht club, marina and beach. It is the one area along the Iakeshore within West Elgin where public access to the lake and views of the lake are greatest. It is presently serviced by a municipal water supply system. Improvements to the harbour and adjoining municipally -owned lands are on- going. It is intended that Port Glasgow continues to develop as the centerpiece of the 'Lakeshore Area' offering a range of housing types, recreational and cultural opportunities and commercial establishments catering to both residents of the Municipality and visitors from outside the area, Future development in this area is anticipated and encouraged subject to the appropriate level of services being in place and that is in keeping with the natural and cultural heritage of the area. Large scale development (greater than 5 lots or units) by plan of subdivision or October 8 2010 9 condominium shall first require the preparation of a secondary plan in consultation with the general public and interested public bodies and ultimately adopted by Council setting out the following: a) the design population and demographic characteristics, b) type and arrangement of uses, c) proposed urban design features, d) servicing requirements including conceptual stormwater management, e) vehicular and pedestrian circulation, f) lands to be dedicated to the Municipality for public use, g) the protection of any potentially impacted natural heritage and cultural heritage features, h) phasing of development. Preparation of the secondary plan shall include consultation with the public and interested public bodies and authorities. Notice requirements shall follow the statutory procedures of the Planning Act and regulations thereunder for official plan amendments." Modification 41 Section 7.9 is modified by deleting the sentence and replacing it with the following: "The creation of new lots in the 'Lakeshore Area' shall take place by consent or by plan of subdivision or plan of condominium in accordance with the provisions of the Planning Act and the relevant policies of this Plan including Section 10.3 and Section 10.4." Modification 42 Section 8.2.1 is modified by adding the following sentence at the end of the section: "Minimum setbacks for buildings and structures from Highway No. 401 are subject to the permit control areas of the Ministry of Transportation." Members of the Police Services Board, other than myself, were of the view that they would "feel more comfortable" if there was a policy of insurance in place to protect them from any claims made against them by third parties. It has always been my view that members of the Police Services Board were protected from personal liability by virtue of Section 29. (1) of the Police Services Act which reads as follows: 29. (1) No action or other proceeding for damages shall be instituted against a member of a board for any act done in good faith in the execution or intended execution of his or her duty or for any alleged neglect or default in the execution in good faith of that duty. I thought it unlikely that any member of the Elgin Group Police Services Board would be carrying out his or her duties in any manner other than "in good faith" as contemplated by the above section of the Police Services Act. In 2009, I did provide a detailed analysis of the insurance coverage which the Elgin Group Police Services Board would be receiving in exchange for apremium of approximately $6,600.00 and 1 also enclose a copy of my letter of the 13 of February, 2009 sent to the County of Elgin commenting upon the necessity of having insurance coverage in place. Simply put, I have always been of the view that insurance coverage on the Board members was an unnecessary expenditure and I could not and would not support it. The issue of insurance coverage was put to a vote and the majority of the EIgin Group Police Services Board decided that the insurance coverage should be put in place. Therefore, this expenditure will now appf -.r as a line item of expenditure in the budget of the Elgin Group Police Services Board until it is revisited again at a future date. Your letter to the Honourable John Baird, former Minister responsible for Canada Post, was also forwarded to my attention. I wish to assure you of our commitment to provide a high level of service to all West Lorne residents. I understand our Local Area Manager, John Krayer- Krauss, has contacted your office about our mail delivery plans for West Lorne. After a full review of all aspects of this situation, we have decided to postpone the implementation of community mailbox service until spring 2011. This will allow us the opportunity to better communicate to customers the reasons and processes associated with community mailbox service and the use of civic addressing. Further communication will be issued and an information session will be held within the next month or so at the postal box centre. In addition, before the centre is closed next spring and the new service commences, residents will receive a letter outlining the process, their new address and community mailbox site, and where they can pick up their keys to the mailboxes. As you may know, Canada Post offers each address one basic method of delivery free of charge. We designate the primary method of delivery based on location, available resources and operational considerations. Sometimes special circumstances may lead to a change in the primary method of delivery for a community, Such is the case in West Lorne where a review of our operations and delivery network is resulting in a change to community mailbox service in conjunction with civic addressing. As the Council is aware from the meetings it attended with Canada Post, the community mailboxes to be installed at several locations around the town will provide mail delivery much closer to residents' homes. We will provide 12 months' free mail redirection service as well as Change -of- Address cards so that residents may inform their correspondents of their new mailing addresses. Our community mailbox sites are carefully selected, taking into consideration traffic flow, pedestrian safety, the proximity to the homes they serve, and the overall appearance of the neighbourhood. Community mailboxes are well designed and secure, and offer the convenience of an outgoing mail slot and a parcel compartment. When questioned as of today no municipality has met the criteria to qualify for the reduce fee sign. It is recommended that Council write the Ministry of Tourism about the criteria to advertise on the Provincial Highway's and that the intent of promoting the small towns as a tourists destination is not working. The resolution of June 7, 2010 be withdrawn, based on the cost of $7,800 per year to have signage on the Hwy 402. The quote for this work from Stantec was $15,825.00 and from OCWA was $9,00C )0 plus applicable taxes. Quite some time ago the Municipality of Dutton/Dunwich placed the Tri- County Committee on notice that we were investigating the possibility bringing the majority of our water from the Elgin System. We have continued to work towards this end and are still planning to proceed. It is our understanding that the Municipality of South West Middlesex has just completed an environmental assessment which is looking at the possibility of bringing all or at least a good portion of their water from the Strathroy connection to the Lake Huron System. It is our concern that although the firm preparing this study was or should have been aware of these plans virtually no mention was r ade of this possibility If either or both municipalities dramatically reduces the supply of water taken from the Tri- County System it would significantly change this report. It is therefore our opinion that the report should be amended to reflect this change. It is also our position that neither the existing purchase of capacity agreement nor the existing management agreement were intended to establish such reserves as recommended in the plan. L We have also reviewed the Purchase of Capacity Agreement and especially section 1.9 and Section 3.6.2. After reading these sections it is clear to us that the designated Reserve Fund mentioned in Section 1.9 is both a capital and maintenance reserve and that it is clearly the intention of Section 3.6.2 to establish a limit of 5% of the total Capital Works Cost as defined in the agreement. It is therefore our opinion that it is imperative to negotiate a new agreement to take into account the recent changes in legislation. As part of an initial bulk order, approximately 190 new Elgin County tourism signs have been erected on County roads. This program is ongoing and additional individual orders for tourism signage are expected to be received. Additional applications for new tourism signs are expected to be small in number, and, therefore are not expected to place great demands on municipal roads staff. Applications for tourism signage will be received and processed by the Economic Development Office. Engineering Services will then review and approve the locations, order the production of the signs, and contact the municipality where the sign is to be located. The municipality will then have two weeks, weather /seasonally permitting, in which to install the sign. While all matters relating to Canada Post rest within federal government jurisdiction, I feel compelled to write to you to express my concerns about these issues. Any reduction to Canada Post services to my riding is simply unacceptable. I am saddened by this continued erosion to federal government services for rural Ontarians. The provincial government has recognized that all Ontarians need government services close to home and that is why Service Ontario has expanded its services in several locations including small urban centres in my riding (the village of Rodney in West Elgin is one of them) that serve rural residents. As the Minister with responsibility for Canada Post, I urge you to reconsider any reductions to postal services in rural Ontario. Market task force has submitted a report. Business After 5: Thanks to Linda Perry and Wendy Dupuis for their recent effort at Lakewood. We are invited to the Business After 5 at Lavender Sense on June 22 International Erosion Controls has volunteered as a site for September. Community Improvement: No further activity with the Horticultural Societies. Looking for directions as to streetscape, but carrying on as planned. West Lorne seems to be less organized, and Tess effective. Website Committee: 1) Google Calendar Batch calendar that can be imported from the Chronicle. No objections, Carried. Ed Markham to propose a policy for future website based advertising, and do research for a Directors meeting. Plan to approach Bell, TD, etc for ad revenue. 4) Custom website offer Represents a major benefit to Chamber members, as this cost is approximately $300 less expensive than other developers. 5) HST link FAQ being added at no charge. 6) Conversion of newsletter from .pdf to .jpg.
