August 31, 2010 MinutesThe Elgin County Council met this day at the Administration Building, 450 Sunset Drive, St. Thomas, at 1:33 p.m. with all members present except Councillor Warwick (absent due to illness) and Councillor Acre (delayed). Warden Vowel in the Chair. The new commander of the Elgin OPP detachment, Brad Fishleigh, was introduced to council. ADOPTION OF MINUTES Moved by Councillor McIntyre Seconded by Councillor Mennill THAT the minutes of the meeting held on July 27, 2010 be adopted. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF None. Moved by Councillor Marks Seconded by Councillor Marr THAT we do now move into Committee Of The Whole Council. Councillor Acre took her seat. REPORTS Restricted Acts After Nomination Day (September 10, 2010) (Lame Duck) The Chief Administrative Officer outlined Section 275 of the Municipal Act, as amended, that provides Council with directions for the period after Nomination Day (September 10, 2010) as it relates to the municipal election. Depending on the nominations filed, the sitting council may face restrictions during this period, as outlined in the by-law. Moved by Councillor Marks Seconded by Councillor Mennill THAT the necessary by-law be prepared delegating authority to municipal officials in the event that council's actions become restricted under Section 275 of the Municipal Act, as amended. Malcolm Smith, P.Eng., Senior Environmental Engineer, SENES Consultants Limited with a Notice of Public Meeting to be held by Toronto Hydro Energy Services Inc. regarding a Proposal to Engage in a Renewable Energy Project on October 27, 2010. 4. OTHER BUSINESS Statements/Inquiries by Members Councillor McIntyre noted coverage of Elgin businesses in a recent issue of Today's Farmer newspaper. Councillor Mennill clarified an issue brought up at the July 27, 2010 council meeting in regard to a letter to Malahide Township Council from Elgin St. Thomas Public Health looking to have the rental fee waived for a youth event at East Elgin Community Complex. He said the request came from a sub-committee of the Health Unit, not from the Health Unit. Councillor Marks promoted the Canadian Senior Amateur Golf Championship currently underway at St. Thomas Golf and Country Club. Warden Vowell encouraged councillors to attend the West Elgin Farm Show this weekend at the Backus-Page House venue. Councillor Habkirk gave a brief update on the recent general meeting of SCOR saying there was a good turnout. He said he and Councillor Wilson will be requesting funding at a future meeting of the Southwest Ontario Conservative Caucus. Councillor Wilson invited everyone to attend a hockey game between the Czechs and Western Ontario Mustangs on September 11, 2010 at East Elgin Community Complex. THAT we now proceed into closed meeting session in accordance with the Municipal Act to discuss matters under Section 240 (d) labour relations or employee negotiations Labour Relations Matter Mandate for Collective Bargaining with the Ontario Nurses Association (ONA); and, under Section 240.2 (a) the security of property of the municipality or local board Innovation Centre for Entrepreneurs (ICE). County Council 3 August 31, 2010 The General Manager of Economic Development presented his report. John Regan of Community Futures Development Corporation (CFDC) made a presentation. Also in attendance were consultants Rob Herald and Mark Barnes of CFDC. Motion to Rise and Report Moved by Councillor Acre Seconded by Councillor McIntyre THAT we rise and report. Moved by Councillor Mennill Seconded by Councillor Acre Carried. THAT the staff direction to revise the negotiating mandate with the Ontario Nurses Association be approved. Moved by Councillor Wilson Seconded by Councillor Marks Carried. THAT Council supports Sand Plains application for a satellite incubator; and, THAT if the Sand Plains Community Development Fund application is successful County Council direct the Chief Administrative Officer to enter into a contract with the Sand Plains Community Development Fund; and, THAT staff be authorized to establish a reserve with an upset limit of $150,000 per year, from the Mil Irate Stabilization Fund, to fund the Innovation Centre for Entrepreneurs, ICE2. Councillor Wilson requested a recorded vote.
