Ms. Dupuis gave a presentation outlining their thoughts for development of their
property located at the south-east corner of Gray Line and Furnival Road. Their
preferred option is to expand the existing seasonal park to include more overnight sites
for cycling and motorcycling travellers and larger sites In addition, they are proposing
rental cabins. She noted that cycle/cart pathways for the area needs to be included in
the study. A concept plan for the property was presented.
Council recessed to hold two public meetings for zoning amendments and resumed their
meeting thereafter.

projects,on a case by case basis,subject to written confirmation from an
engineer regarding the capability of the structure;
AND THAT for microFit projects the applicants shall retain a planner to provide
zoning opinion;
AND THAT for FIT projects our planning consultant shall provide a zoning
opinion.

Mr. Collier reported that their company is a leader in microFit projects and have
engineers on staff to evaluate all projects. He reported that there are automatic shut-
offs which kill the AC power and therefore no power is being converted from DC to AC.
On a flat roof the panels are 5 feet from the edge and 4 feet between each one. On a
sloped roof the panels are bolted into a racking system. What happens when power
goes out? He thought that Hydro One would notify their office and then they would shut
down the system.
DELEGATION: TOM MCLARTY RE: POULTRY CLAIM
The Administrator outlined the nature of the claims requested and that the payment of
the claim was being recommended. Mr. McLarty spoke to Council about the process
that was followed for his recent poultry kills. The Administrator reported that if OMAFRA
would not reimburse the municipality for these claims, the claims would be funded
through the municipal dog tags revenue.

Mr. Kozdras outlined the process under the FIT program and asked for support of their

(the"Lands") in the Municipality of West Elgin under the Province's FIT
Program;
AND WHEREAS the Applicant has requested that Council of the
Municipality of West Elgin indicate by resolution Council's support for the
construction and operation of the Project on the Property;
AND WHEREAS, pursuant to the rules governing the FIT Program (the
"FIT Rules"),Applications whose Projects receive the formal support of
Local Municipalities will be awarded Priority Points, which may result in the
Applicant being offered a FIT Contract prior to other persons applying for
FIT Contracts.
NOW THEREFORE BE IT RESOLVED THAT Council of the Municipality
of West Elgin supports without reservation the construction and operation
of the project on the Lands.
This resolution's sole purpose is to enable the Applicant to receive Priority
Points under the FIT Program and may not be used for the purpose of any
other form of municipal approval in relation to the Application or Project or
any other purpose.

Councillor Aldred reported that he had attended a West Lorne Fire meeting and reported

Councillor Miller reported that he had attended the recent Recreation Committee
meeting. The committee is looking into a turkey toss in conjunction with the Santa
Claus parade. He also attended the Chamber of Commerce gathering and noted that
MP Joe Preston was in attendance. The AGM for the Chamber of Commerce is
scheduled for October 2"0 at the Rodney Legion,
Councillor Leatham reported that the Rodney Fire Department had 3 tails last month.
At the meeting discussion was held regarding the Command Centre. They had a
successful breakfast event
The Mayor reported that he had attended the AMO conference in Ottawa and attended
session on waste diversion, SARS legislation and bicycle routes/paths which were all
very informative.

The Mayor called the meeting to order at 1:30 p.m. The Clerk informed those present
that notice of this meeting had been given under Section 34(12) of the Planning Act first
class mail to all assessed owners within 150 metres of the subject property as well as
provincial agencies and ministries as prescribed by regulation. Correspondence was
received from the Lower Thames Valley Conservation Authority which indicated no
objection.
The proposed amendment would change the zoning of lands lying on the east side of
Furnivai Road (County Road No. 103) between Kintyre Line and McDougall Line and
comprising part of Lot 9, Concession V, from the Institutional (1)Zone to the Rural
Residential Three (RR3) Zone. The applicants are seeking the re-zoning to permit the
conversion of a building which formerly served as a school and a private club for
residential purposes.
The lands comprise an area of 3,786 square metres(0.9 acres), a frontage of 50.3
metres(165 ft) and a depth of 75.3 metres(247 ft). The parcel is occupied by a building
formerly used as an educational facility(S.S. No. 8 school) and later as a private club
(Lithuanian Canadian Club). The use of the building as a school and a club has now
ceased and the owners wish to convert the building for use as a single unit dwelling.
The permitted uses of the RR3 zone include a single unit detached dwelling, a bed and
breakfast establishment, a home occupation and an accessory use. The lot, which pre-
dates the zoning By-law, would satisfy the minimum lot area and minimum lot frontage
requirements (1,850 sq. m. and 30 m respectively) of the RR3 zone. A'site-specific'
Residential First Density (RR3-#) zoning will be considered to include a "dwelling" as a
permitted use, being defined as follows:

DWELLING shall mean a building, occupied or capable of being occupied
exclusively as a home, residence or sleeping place by one or more persons,
but shall not include hotels, boarding houses, rooming houses, motels,
institutions or mobile homes. (Section 2.33)
The subject lands are designated `Agricultural' in the West Elgin Official Plan. The
proposed amendment is considered to be in conformity with the Plan.

The Mayor called the meeting to order at 1:45 p.m. The Clerk informed those present

of Queens Line (County Road No. 104)west of the Village of Rodney from the
Agricultural (Al) Zone to a 'site-specific' Rural Residential Three (RR3-#) Zone and to a
'site-specific'Agricultural (A1-#) Zone. The amendment would also fulfill a condition
imposed by the County of Elgin Land Division Committee in granting Application for
Consent E11112 to dispose the surplus farm dwelling situated on the lands.
The lands proposed to be rezoned 'site-specific' Rural Residential Three (RR3-#)
comprise an area of 4,088 square metres (1.0 ac), a frontage of 61 metres (200 ft) and a
depth of 67 metres (220 ft). The parcel is occupied by a single unit dwelling (erected
2000)and an in-ground pool. No change in use is proposed. The lot would satisfy the
minimum lot area and minimum lot frontage requirements (1,850 sq. m and 30 m
respectively) of the RR3 zone, but would exceed the maximum lot area requirement of
4,000. A'site-specific' (RR3-#)zoning would permit this deficiency. All other
requirements are capable of being satisfied. Permitted uses of the RR zone include a
single unit detached dwelling, home occupation and an accessory use.
The lands proposed to be rezoned 'site-specific' Agricultural (A14) comprise an area of
38.9 hectares (96.2 ac) and a frontage of 137 metres (449 ft) on Queens Line (County
Road No. 104) and 290 metres (951 ft) on Downie Line. The parcel is occupied by a
small shed and a silo. The lands have been cleared for agricultural purposes, with the
exception of a woodlot located in the northerly portion of the farm. No change in use is
proposed. The lot would satisfy the minimum lot area and lot frontage requirements (19

ha and 150 m respectively) of the Al zone. The 'site-specific' (i.e. Al-#)zoning would
prohibit a dwelling on the remaining lands as stipulated by the PPS and the Municipality

RECOMMENDATION: That our current temporary employee's contract be
extended an additional six months to cover our winter control season. And that
our extra weekend patroller is rehired.
INTRODUCTION: Our current temporary employee was hired to cover for an
employee off on S.T.D. who now has unfortunately moved to L.T.D. This six
month term is nearing completion and with the upcoming winter control season
this employee will be more then capable of filling this vacant position.
Our weekend patroller from the 2011-2012 season is available to work for us in
the 2012-2013 season
DISCUSSION: It is recommended that this temporary position be extended for
an additional six months from November 1 , 2012 thru to June 1, 2013, and that
the weekend patrol position be installed from November 15, 2012 thru to March
15, 2013.

INTRODUCTION:
Monthly report for West Elgin Recreation.
BACKGROUND:
1. Netting at Miller Park: The poles have been installed at Miller Park for the
netting behind the soccer nets. The nets have been ordered, however will
not be installed until 2013.
2. Rodney Fair: The 2012 Edition of the Rodney Fair has concluded with very
few problems that were facility relater as far as I know. The new Tractor Pull
track performed well.
3. The Pool as well as all of the outdoor washroom facilities has been
winterized. The only item left to a winterized is the Splash Pad in Miller Park,
and the irrigation water lines.
4. The Arena continues to operate, all of the winter programs have started
including public skating, tots and adult skating.
6. Recreation Center: The flower bed was completed just in time for the fair,
there have been some parking lot spots painted in the parking lot and this
should be completed before the winter sets in.
6. The Horse Track: After the fair and the Tractor Pull the track horse track
required some repairs and these are ongoing, the Road Department is
making these repairs as time permits.
7. Vandalism: The Skate Park, the Washrooms, as well as the Splash Pad in
Miller Park were subject to vandalism, in as much as they were spray
painted with various things. They were damaged to the extent that we had to
bring in an outside company to clean them off. The Company was in Miller
Park on Wednesday October 4 2012 and cleaned off all of our facilities.
8. Complaints: The Recreation Superintendent has received complaints from
local residents regarding the conduct of people using Miller Park, mostly
after hours. Correspondence with the OPP will be provided to Council.

INTRODUCTION:
To report the major monthly activities of the Water Department.
DISCUSSION:
• Lead sampling throughout the water distribution system is being
completed this week in accordance the Ministry Requirements.
• A major water leak was replaced at Furnival and Poineer Line on
September 19th, with the problem of pre-mature failure of bolts on a six
inch valve. The remaining valve's installed on Furnival Road in 1992 are
being checked for possibility of pre-mature failure.
• A meeting was held at the West Elgin Treatment Plant on October 4, 2012
with Ministry of Environment (MOE), Ontario Clean Water Agency
(OCWA), Elgin County Health Unit, Municipality of West Elgin,
Municipality of Southwest Middlesex, Municipality of Dutton-Dunwich.
Village of Newbury and Municipality of Chatham-Kent to review the
coloured water of Labour Day Weekend and September 9, 2012. The
preliminary information was the colour in the water was due to magnesium
caused from the flip of the lake (due to lack of Oxygen). Future
information will be presented at the Tri-County Water Management
meeting as more research is done.
• The water main flushing program will be completed this fall.

RECOMMENDATION:
That Council supports the application for Municipal Infrastructure Investment Initiative
Funding for Asset Management Expression of Interest; AND FURTHER directs staff to
complete the application for submission by October 22, 2012.
INTRODUCTION:
On August 16th, 2012, the Government of Ontario launched the Municipal
Infrastructure Investment (M13) and announced funding of $60 million over the
next three years to small and rural municipalities. Up to $9 million will be used
immediately to help municipalities prepare their asset management plans, while
approximately $17 million per year will be used to address critical projects
identified in the finalized plans.
DISCUSSION:
The Municipality of West Elgin has completed inventory of the assets of the
municipality in compliance with the PSAB rules for financial statement
presentation. The municipality as well has completed a financial plan for the
Water System to be compliant with DQWMS of the Safe Drinking Water Act
requirements.
The municipality has started the mapping of the following asset classes:
• Water (incl. hydrants)
• Storm Sewers
• Sanitary Sewers
• Roads
• Road signs
• GPS'd Curb Stops
• Streetlights
• Bridges/culverts
The next step would to develop an overall Asset Management Plan for the
Municipality of West Elgin. I have attached a summary of the benefits of a
quality Asset Management Program produced by the Ministry of Infrastructure,
along with a news release from AMO on Infrastructure Funding Priorities to the
Federal Government.
It is believed that an Asset Management Plan will be a requirement for future
grant funding application submissions.
The qualifications for this grant application includes:
• Lower-tier municipalities with infrastructure assets and populations under
20,000
• Upper and Single-tier municipalities with infrastructure assets and
populations under 50,000
• LSB's with water and/or wastewater systems
• Municipality must have submitted their 2011 Financial Information Return
to the Ministry of Municipal Affairs and Housing by October 22, 2012
The Municipality of West Elgin qualifies for applying for the Asset Management
Expression of Interest. There is no matching requirement by the municipality for
this part of the funding and it is expected that the minimum grant will be $23,000.

The Board of the Association of Municipalities of Ontario has approved a submission to
Infrastructure Canada that lays out the needs of Ontario's municipalities in a new federal
Long-Term Infrastructure Plan.
The AMO submission calls for a long-term investment program that would allow
municipalities to plan capital works and ensure that local priorities are funded. These
include:
• A long term, ideally at least ten-year, program;
• Funding allocations by province based on population and economic importance;
• Dedicated portion of the funds to be directly for municipal infrastructure reflecting the
fact that municipal governments are owners of the greatest portion of public
infrastructure; and
• Eligibility of all local priorities determined by municipal councils through long term
municipal asset management planning.
In approving the submission, HMO's Board noted the critical importance of municipal
infrastructure as the foundation for economic and social development, environmental
protection and quality of life and passed a resolution that articulates municipal priorities.
This resolution is appended below and local councils are encouraged to support it or use it
as a basis for their own resolutions to the federal and provincial governments.
The submission will be provided to the federal government and posted to the AMO website
in the near future.
Resolution — Federal Long-Term Infrastructure Plan
Whereas municipalities in Ontario are responsible for the majority of infrastructure in the
province and that infrastructure is an investment in the economic, social and cultural
development and the environmental protection of our communities; and
Whereas the Government of Canada is developing a new Long Term Infrastructure Plan for
federal support for infrastructure in Canada; and
Whereas, despite increased investment in municipal infrastructure by municipal, provincial
and federal orders of government in recent years, Ontario's municipalities still have a
significant infrastructure deficit.
Now, therefore, the Board of the Association of Municipalities of Ontario resolves
that:
Any new federal infrastructure support program must be long-term in its scope and
horizon, ideally at least ten years, to help infrastructure investment partners tackle
our significant infrastructure needs; and

That Ontario, as Canada's most populous province, should be allocated
infrastructure support under any new federal infrastructure support commensurate
with its population and economic importance; and
That any new federal infrastructure support program must recognize the number and
variety of infrastructure systems owned, managed and operated by municipalities in
Ontario and the critical supports these provide to local communities and economies
by providing for an exclusive municipal allocation in any new federal infrastructure
support program; and
That the priorities of local governments in Ontario, as defined by their long-term
municipal asset management plans, must be recognized and eligible for direct
federal support under any new federal infrastructure support program; and
That those municipalities that have or will have comprehensive asset management
plans in place at the time the Federal program is in effect should be considered
immediately eligible for any new infrastructure program funding from the federal
government.

Building Support for Asset Management Planning
Overview
The successful development and implementation of an asset management plan requires buy-in
from stakeholders, municipal staff, council members, and the general public. As with any long-
term initiative that affects a community, it is important to build support early in the planning
process and keep stakeholders informed and engaged throughout the development of the plan.
Some of the engineering and financial terminology used in asset management planning can be
technical in nature. It is best to avoid jargon and instead use plain language for communicating
goals and performance.
Benefits of Asset Management
Communicating the benefits of asset management planning is a key part of building support for its
implementation. The following list contains a range of messages that can be used to help make
the case for asset management planning to various stakeholder groups:
It builds on existing activities: While developing a detailed asset management plan may be a new
process for some municipalities, the foundation for asset management planning is already in place
for most. Asset management planning builds on activities that municipalities are already
undertaking, such as: recording information on tangible capital assets as part of financial
reporting; tracking performance measures as part of the Municipal Performance Measurement
Program; and planning for the sustainability of water systems.
• Asset management pays for itself. The incremental costs involved in moving towards detailed
asset management planning are generally offset by the savings that are realized through
optimizing investments (e,g. undertaking preventive maintenance at the right time to defer the
need for costly reconstruction) and better managing risk.
• Improves decision-making: Asset management planning can be used to provide decision makers
with objective, evidence-based advice regarding resource allocations. It is easier to make
informed decisions when all costs have been factored into the evaluation of options. This can help
streamline decision-making at budget time.
• Reduces risks: Good asset management practices reduce risks by identifying issues and allowing
for early intervention, particularly for core assets that affect the health and safety of the public.
• Required for future provincial funding: Municipalities will need to demonstrate that they are
undertaking asset management planning - and that their grant requests are supported by their
plan - in order to access provincial funding for infrastructure. Planning also helps ensure that
limited public resources are directed to the most critical needs.
• Improves public confidence: A transparent, publicly communicated asset management plan
provides greater accountability by demonstrating that public money is being invested responsibly
and by showing that results are being achieved. The development of a plan also provides an
opportunity for the community to have an open discussion about its needs and priorities, and
about service level expectations.
Communication Tips
The following can contribute to a successful communications strategy that builds support for asset
management planning among stakeholders:
• Municipal website: Municipal websites provide an excellent forum for sharing information with the
public. A municipality can use this tool to share its asset management plan with its citizens, and
fn dic,nie, tha gtatP of the rnmmimitv's infrastructure. Materials should be undated reaularly in

order to keep the public informed of how the plan is performing against established goals. The
website can also be used to solicit input from stakeholders, and to inform citizens of construction
projects or upcoming events.
• Municipal internal communications: If a municipality has internal forums such as an intranet page
for its staff, a section of this resource could be dedicated to asset management planning. This
would facilitate collaboration between different disciplines (such as engineering and finance) by
ensuring that documents are made available across various departments.
• Consultations: Public consultations can be an effective tool for engaging the public in the
development of plans, particularly related to expected levels of service and performance
measures.
• Orientation and training: Basic information about asset management could be included in
orientation or training materials that are provided to new councilors and staff. Holding workshops
on asset management planning can be helpful, particularly in advance of the annual budgeting
process. Taking staff and councilors on a tour of key infrastructure sites can also promote a
better understanding of the infrastructure needs throughout the community.
• Visual aids: Photographs are a useful tool to add to asset management plans and presentations.
They serve as an effective way to demonstrate the condition of infrastructure. As plans can be
data intensive, charts and illustrations are effective for providing high-level summary information
in a more understandable and intuitive form for various audiences.
This tool was designed to assist Ontario municipalities in developing and/or refining detailed asset
management plans. It is not an exhaustive treatment of the topic. Municipalities are responsible
for tailoring their asset management planning practices to their unique needs and for seeking
appropriate professional advice.

Dear Mayor Wiehle:
On behalf of the Government of Canada, I wish to inform you that the Chippewas of the
Thames First Nation and the Government of Canada have been working together to
resolve a longstanding land claim known as the Big Bear Creek specific claim. The
claim relates to the unlawful sale without a surrender of the Big Bear Creek Reserve, as
set apart pursuant to the Longwoods Treaty, or Treaty 25, which was concluded in
1822. The Chippewas of the Thames First Nation is located 35 kilometres south-west
of London, Ontario.
The Government of Canada has a policy and process in place for resolving the
outstanding specific claims of First Nations through negotiations. To date, Canada has
resolved about 359 specific claims through settlements negotiated with First Nations
across the country. Settling claims is key to achieving reconciliation and rebuilding
relationships with First Nation people in Canada.
The Big Bear Creek specific claim was accepted for negotiation in August 2008 and
since then, the negotiating table has made efforts to update interested parties as key
milestones were reached in the process. As part of our continuing efforts to share
information, I am taking this opportunity to confirm that Canada has made an offer to
settle the above-noted specific claim and the First Nation has agreed to take this offer to
their members for a vote.
I am writing today to inform you of the Additions to Reserve component of the proposed
specific claim settlement and provide you with an opportunity to seek more information,
to ask questions and to share any views you may have.

Under the proposed settlement, the COTTFN will have the opportunity, if they so
choose, to add up to 5,120 acres of land to their Reserve. Lands would be acquired on
a willing seller, willing buyer basis, and would be added to reserve pursuant to Canada's
Additions to Reserves (ATR) Policy. Please find attached a map of the selection area
from which the COTTFN will be able to acquire lands if they choose to do so (See Map).

(a) That Report PW10088a be received;
(b) That Option 3 — Proactive Management, 1:1 planting for the City of
Hamilton's Emerald Ash Borer Action Plan, be selected based on the
options presented in Table 1 (attached hereto as Appendix "A");
(c) That the $26.2 million for Option 3 be referred to the 2013 Capital Budget
process for further consideration;
(d) That the implementation of Option 3 include an option for homeowners with
healthy ash trees to be able to retain such City trees and/or park trees until
they are in decline or are dead, or be afforded the flexibility to pay for
inoculation for trees on City-owned property, and in consultation with the
Ward Councillor and City staff;
(e) That staff be directed to implement an Emerald Ash Borer Action Plan
based on Council's preferred option selected in recommendation (b) of
Report PW10088a, subject to Council approval of a capital funding plan;
(f) That staff be requested to consider using the.existing Street Tree Planting
Program to offset some of the costs of implementing Option 3 and report
bath during the 2013 capital budget process;
(g) That staff be directed to provide an annual update to the General Issues
Committee on the implementation of the Emerald Ash Borer Action Plan;

(h) That correspondence be sent to the Canadian Food Inspection Agency,
the Federal Minister of Natural Resources Canada, the Ontario Minister of
Natural Resources, local M.P.'s and M.P.P.'s, the Association of

advocate for increased Emerald Ash Borer research funding and for the
provision of financial assistance to affected municipalities in Ontario;
(i) That the municipalities in the EAB-Regulated areas in Ontario be
requested to support Hamilton's request to the senior levels of
government.

Dear Council Members:
At its September general meeting members of the Rodney & District Horticultural
Society wished to express thanks and gratitude to the Parks and Recreation Department
for the care and attention its employees delivered in watering the planters, flower beds
and hanging baskets throughout Rodney. Delivering a reliable watering system to
various plantings proved critical to successfully showcasing the village in its best light.
Despite the long and hot summer weather the flowers beds and hanging baskets stood up
well and provided a healthy and colourful display throughout the summer. We were very
proud of the work performed by the students along with the help of the Parks and
Recreation staff.
We were particularly impressed with the planning and creation of raised flowerbeds at
the Rodney Recreation Centre. The planting of shrubs, trees and flowers into these beds
prior to the Rodney Fair helped elevate the status and success of the Fall Fair. This
enhancement of the property will bring pleasure for visitors and users of the complex for
years to come.
Volunteers of the Horticultural Society are proud of the village of Rodney and work hard
at keeping the streets, buildings and park areas as attractive and pleasant looking as
possible. We sincerely appreciate the time and resources the Municipality invests in
supporting these endeavors and we are pleased to acknowledge special attention to
exemplary efforts of Municipal staff as they occur.

planning, is reviewing the Provincial Policy Statement (PPS), as required by the Planning Act.
The PPS is the statement of the Province's policies concerning land use planning and development. It
provides policy direction on matters of provincial interest such as building strong communities, the
wise use and management of resources, and protecting public health and safety. The Planning Act
requires that decisions on land use planning matters "shall be consistent with" the PPS.

On November 301h 2012, the Optimist Club of West Lome are again hosting a Christmas
parade which runs approx. I hour from 7prn to 8pm.
We have decided the new route of the parade from last year worked well for the safety of
children. Therefore we will again be using Graham Rd. from Gilbert St. to the arena
where Santa and Mrs. Claus will disembark to the warm room to hand out goodies. The
rest of the parade will proceed to the VVESS Ist parking lot adjacent to WESES.
Can we count on your assistance with trucks and men along with Optimist members to
aid in road closures of the town streets and municipal roads. We will also be contacting
the OPP.
Also, we would appreciate monetary support towards this event when we provide you
with the cost entailed at a later date.

Dear Mayo iehle,
I am writing to inform you of legislation tabled by my colleague MPP Jim Wilson that
would, if passed, fix Ontario's broken public sector arbitration system. The system as it
exists now has, on too many occasions, completely disregarded the ability of taxpayers to
pay for wage increases.
I know your Council is well aware of the problem. So are your colleagues in Windsor
who have been waiting since 2006 for a final decision on their negotiations with
firefighters. In the meantime, the arbitrator awarded the firefighters' union a $7.3 million
"interim" wage increase of nearly 13%. While wages continue to rise in Windsor, the
population and industrial base are shrinking and the tax base is collapsing.
Owen Sound also experiences the burden of the current arbitration system. Only recently
was Council able to sign a fire contract that dated back to 2009 and expired in 2011. In
that decision, Owen Sound firefighters received a total wage hike of more than 10 per
cent. Council is now preparing for a new round of contract talks with both police and
firefighters.
To fix the problem — and to keep rogue arbitrators in line — MPP Wilson has introduced
the Ability to Pay Act. This bill would require arbitrators to consider specific local
economic and budgetary criteria and explain in writing how these objective criteria
affected their decision.
The bill means that arbitrators would not be allowed to use future tax increases to justify
ability to pay. It would also require panels of three independent arbitrators to settle
arbitration cases for broader public sector union contracts within a tight timeline of three
months. The panels would be chosen from a roster approved by the Minister of Labour.
The legislation would also create a wage division using existing resources within the
Ministry of Finance called the Ability to Pay Division. The department would collect
and publish comparative data on compensation, as well as proactively disclose all
arbitration awards.

Despite repeated calls from mayors and other public sector employers the Liberals
haven't fixed the problem. We know that taxpayers do not have deep pockets. In fact,
more often these days, they are empty pockets. Economic growth has been slow and
communities are strapped for cash.
To that end, I would ask that you review the enclosed legislation and consider drafting a
resolution to send to the Liberals and NDP to encourage them to step up for taxpayers,
help municipalities, and get this bill passed when it is debated on October 4. I have
enclosed a draft resolution that could be used.

Be it resolved that the (Enter Municipality Name] believes that arbitrators when
undertaking a decision should be required to take into account the following criteria as
outlined in Bill 121, the Ability to Pay Act, 2012, in addition to any other criteria provided
by law:
1. National, provincial and local unemployment rates, economic growth rates and
personal income levels.
2. A comparison, as between the employees and other comparable employees in the
public and private sectors, of the terms and conditions of employment, including
remuneration and benefits, and the nature of the work performed.
3. Inherent advantages in bargaining enjoyed by the employees because there is a
monopoly on services, because the activities are not carried on for profit, or for both
reasons.
4. If applicable, the mandate of elected officials.
5. The fiscal situation of the Province (or, if the employer is a municipality or local board
of a municipality, the municipality's fiscal situation).
In applying the criteria, arbitrators shall assume that no tax rate will be increased to pay
the costs of the decision or award. Arbitration cases within the entire broader public
sector shall be settled within a tight timeline of 3 months.
Whereas Bill 121, the Ability to Pay Act, 2012, will legislate these criteria and bring
government employee wages back in line with what municipalities and taxpayers can
afford to pay;

I am avid fisherman and boater and visit port Glasgow many times through the year. I would like to
voice my disapproval for any development on Havens Lake Road.
I understand that there are possible lands on the development and also surplus lands that are proposed
to be sold that fall under the endangered species act, Under the current regulation a distance of 100m
needs to be still back from hibernaculum. That's over 300 ft. if that is the case the lands on Havens Lake
Road are undevelopable and shouldn't be considered to be sold. Also in the last minutes I read that
there is vegetated areas that fall under the endangered species act,could that not also be where the
sewage and storm water is going to be directed? if that is so why continue until an alternative is found
or clarification from the ministries.
1 hope that this council does the right thing. The right thing I believe is to allow development on the
lands seaside owns.

read the minutes from the last meeting and this email from Tammy Ryall states
that there is vegetated areas that fall under the endangered species act. Also
there is a Regulation that eastern fox snake and habitat fall under.
The reason I am bringing this to your attention is that the eastern fox snake
habitat may be on the property along Havens Lake Road and other areas in the —•---
development concept plan. Under regulation it is my understanding that 100m
around hibernacuia is protected. If any of the natural heritage features fail Into
this definition,the lands on Havens Lake Road should not even be considered to
be sold.
I would appreciate that you follow the Official Plan Sections;

I have been watching the newspaper in the area and also been reading the council minutes regarding
the Seaside Development. I visit Family and friends in the area all summer and enjoy what peace and
tranquility Port Glasgow has to offer.
I read in the last minutes that the habitat for eastern fox snake is on the lands in question that might be
developed. It is also my understanding that surplus lands that are an Mavens take Road possibly might
have the habitat. My question is why you are not pursuing a study or at least some input from a
relevant ministry that handles these matters. I would not agree that these lands that were donated to
the municipality,would even be considered to be sold without the proper investigation into the habitat
that is on them_ it would be foolish to see council sell these lands only to find that they are
undevelopable due to endangered species act,
Gard and Grace Havens were my grandparents,which I would like to remind you again,gave those lands
to the municipality for the just having their last name ppt on a sign. The least you can do is ensure that
you follow your own Official Plan Section 3 under environmental concerns. For the record I do not agree
with selling of the surplus lands on Havens Lake Road, nor do I agree with and modification to it. What it
is today is what Gord and Grace gave to this municipality it would be nothing Wt a shame to see it
destroyed.

as amended, to require pet shops to provide every purchaser of a cat or dog with a health
assessment from a licensed veterinarian for all cats and dogs kept in the shop that receive
veterinary care; and,that all pet shops that sell more than 10 cats or dogs per year, obtain
these animals from one of the following sources only: municipal animal shelters;
registered humane societies; registered shelters or rescue groups.
2. That staff conduct quarterly proactive inspections of licensed pet shops that sell cats
and/or dogs.
3. That staff work with the Ontario Society for the Prevention of Cruelty to Animals
Investigation Unit on a continual basis to determine if any information exists related to
the existence of kitten and puppy mills in Mississauga; and, that staff take appropriate
enforcement action with local pet shops in Mississauga if these issues are uncovered.
4. That pet shops be permitted to sell their existing inventory of cats and/or dogs up to and
including December 31, 2012 and that all future cat and/or dog acquisitions by pet shops
who sell more than 10 cats or dogs per year be from one of the following sources only:
municipal animal shelters; registered humane societies; registered shelters or rescue
groups and that staff work with pet shop owners on a program for animal licensing, in
accordance with the amendments to Schedule 20 of the Animal Licensing By-law 1-06,
as amended.
5. That the Minister of Community Safety and Correctional Services be requested to
provide additional support to the-Ontario Society for the Prevention of Cruelty to
Animals (OSPCA) so that they can take further action against puppy mills in the Province
of Ontario.

as amended,being a Business Licensing By-Law to regulate
the sale of dogs and cats in pet shops
WHEREAS subsection 150(1)of theMunir pal Act,2001 S.A.2001,c25,as amended,
provides that a local municipality may license,regulate and govern any business wholly or partly
carried on within the municipality,even if the business is being carried on from a location
outside the municipality;
AND WHEREAS The Council of The Corporation of the City of Mississauga has
enacted Bylaw 1-06,as amended,being the Business Licensing Bylaw;
AND WHEREAS Schedule.20 of By-law 1-06,as amended outlines certain terms and
conditions of licensing owners of pet shops,inoludiang the entry onto a register details of where
and from whom their animals were acquired,
AND WHEREAS in order to halt the proliferation of kitten and puppy mills,it is
necessary to ensure that all animals offered for sale or otherwise in licensed pet shops are
acquired only from certain reputable sources;
NOW THEREFORE The Council of The Corporation of the City of Mississauga hereby
ENACTS as follows:
1. That Schedule 20 of By-law 1-06,as amended,is hereby amended by adding the
following subsections to Section 3:
(14) provide to every purchaser of a cat or dog a health assessment from a
licensed veterinarian for all cats and dogs kept in the shop that receive
veterinary care.
(15) if such person sells chore than 10 cats or dogs per year, obtain these
animals from one of the following sources only; municipal animal
shelters;registered humane societies;registered shelters;or rescue groups.
(16) notwithstanding section 3(15)of this Schedule 20,if such person sells
more than 10 cats or dogs per year,be permitted to sell their existing
inventory of cats and/or dogs that are obtained from sources other than
those as provided in section 3(15)of this Schedule 20,up to and including
December 31,2012.

This regular session of the West Elgin Recreation Committee was called to order at 7:04 pm with the
following members present;James Husband, Ken Neil, Grace Blanchard, Dug Aldred, Norm Miller, Doug
Staddon,Jonathan Wolf and Recreation Superintendent Jeff Slater.
Prior to the commencement of this session the Recreation Superintendent indicated that Valarie Parker
had notified him with her request to resign as Chair Person of the Recreation Committee citing job
responsibilities. Mrs. Parker would like to stay on the committee but feels she cannot act as chair at this
time.

1. Soccer Netting: The Recreation Superintendent reported that the estimated cost of
purchase and installing the netting behind the soccer nets in Miller Park is estimated at$
5000.00.The Recreation superintendent has a report going to council on September 13
2012.
2. Pool Report:The Recreation Superintendent will ask Shelley Smith for a written report
regarding Pool Programs for the next meeting and invite Shelly to attend the October 2012
meeting to discuss the report.
3. Turkey Toss:The members discussed a Turkey Toss event to be held at the Santa Claus
Parades in both West Lorne and Rodney.The concept involves tossing a rubber turkey; the
person who tosses the turkey the furthest will win a cash voucher from the local grocery
store.

The age groups as determined by the Committee will be, 5 — 10, 11- 15, 16 plus, and 60 plus,
The prizes will be for first place: $ 25.00, for second place $ 15.00, and for third place
In each category.
4. Blacks Large Trail: member Norm Miller presented a proposal regarding the acquisition of
CSX Rail property (Thompsons) from Blacks Lane to Furnival Road. The discussion resulted in
the passing of the following resolution:

of the resurfacer. An estimate from Resurfice Corp. In the amount of$ 77,088.00, and Zamboni
Corporation for 73,349.20 both are plus applicable taxes. The Recreation Superintendent
explained the size difference and the construction difference between the two machines and
indicated that his recommendation would be to purchase the Zamboni Machine. Discussion
ensued which resulted in the passing of the following resolution:

The Recreation Superintendent indicated that the machine probably will not arrive in 2022, but
early in 2013.
2. Joint Council Meeting: Member Purcell indicated that West Elgin and Dutton Dunwich
Municipal Councils had arranged a joint meeting for the 13`}'of September, to discuss the Soiar
Power project for the West Elgin Arena. However that meeting had to be re-scheduled and a
new date has not been set as of this meeting date.
