Subject: Port Glasgow Secondary Plan
The following comments are provided in response to my review of written comments
provided by the public and the principal stakeholders including the Province of
Ontario, Seaside and PGYC. There are 3 significant issues which should be
addressed before the Draft Secondary Plan is finalized for consideration by Council.
These issues are summarized as follows:
i) There have been several edits made to the Land Use Plan Figure 4. Although
most of the edits to the Land Use Plan were discussed to some extent at the
Nov. 15, public meeting, some clarification is necessary regarding the
rationale used to properly align the Mixed Land Use, Commercial and
Residential categories. Additional refinements have been included on the
attached version of Figure 4.
ii) The Natural Heritage land use category has been replaced by the Parks and
Open Space category on Figure 4, The rationale for this decision needs to be
fully communicated and understood. In essence, the Parks and Open Space
policies of Section 5.6, as implemented by Section 3.3 Natural Heritage of the
West Elgin Official Plan provide the comprehensive framework to achieve the
goals and objectives of the Secondary Plan for management and protection of
the natural environment.
iii) The Province of Ontario has recently provided comments on the Draft
Secondary Plan, (MMAH/MOE Dec. 4, MNR Dec. 6, LTVCA Dec. 7). These
comments relate to servicing of the developable lands, natural heritage and
implementation policies of the Secondary Plan, as well as design criteria for
the recommended planning framework. There are long term benefits to be
gained in meeting with the Province now, in order to gain further input
regarding their expectations for policies guiding implementation of the plan. It
will also be advantageous to discuss the information from the Province with
our stakeholders and the public.
RECOMMENDATIONS
• Council delay consideration of the Draft Secondary Plan until additional policy
development is reviewed with the Province of Ontario (MMAH) related to
implementation of the general infrastructural servicing policies, more expansive
localized natural heritage guidelines, design guidelines and generalized
development phasing guidelines.
• Council consider holding another public meeting in the new year, to present the
revised Land Use Plan — Figure 4, and the implementation policies as described
above.

We represent A&W Food Services of Canada Inc., McDonald's Restaurants of Canada Ltd., the
TDL Group Corp. (operators and licensors of Tim Hortons Restaurants), and Wendy's
Restaurants of Canada Inc. as well as their industry association, the Ontario Restaurant Hotel
and Motel Association (ORHMA).
The ORHMA is Canada's largest provincial hospitality industry association. Representing over
11,000 business establishments throughout Ontario, its members cover the full spectrum of food
service and accommodation establishments and they work closely with its members in the quick
service restaurant industry on matters related to drive-through review, regulations, and
guidelines.
We are providing this written submission to you on behalf of our clients after having reviewed
the proposed draft Port Glasgow Secondary Plan to determine if the proposed policies
contained within the Secondary Plan would apply to our clients' current and future operating
interests. Please accept this as our written submission on the subject matter.
Based on our review we have not identified any concerns with the "Draft Port Glasgow
Secondary Plan". However, we reserve the right to provide further comments on subsequent
drafts of the document in advance of Council's final decision on this matter.
Please also consider this letter our formal request to be provided with copies of all future
notices, reports, and resolutions relating to the proposed draft Secondary Plan for the
Municipality of West Elgin.

Reference: Draft Port Glasgow Secondary Plan
Monteith Brown Planning Consultants (MBPC) has reviewed the Draft Port Glasgow Secondary Plan
(Oct. 25. 2012) on behalf of our client, the Port Glasgow Yacht Club (PGYC), and offer the following
comments through the public consultation process:
Overall our client's are very pleased with the Draft Plan and are very appreciative of the work undertaken
by the Municipality and the Consultants. In particular, our client is most pleased with the Plan's
recognition of how important the Haven's Lake Road corridor of public lands is to the community for
public access and the provision of municipal parks and recreation uses.
Through our review of the work program and terms of reference, it remains unclear as to how the
proposed Secondary Plan is going to be implemented. Discussions with the Municipality's Planning
Consultant indicate that it is envisioned that the implementation may occur either via Minister's
Modification or through an Official Plan Amendment. Our client would like clarification as to how the Plan
will be implemented.
With regard to section 3.1.3, it is stated that "the PGYC operates the marina through an agreement with
the municipality which owns the facility"[.,,] It is correct that the PGYC operates the marina through an
agreement with the municipality but the PGYC owns the easterly portion of the marina and the clubhouse,
the landward portion of the piers and all associated facilities on the PGYC lands. Further, the PGYC has
paid for all facilities on municipal lands associated with the marina, including the basin, the docks,
lighting, clubhouse, etc. save and except the municipal washroom facilities. Our client requests that this
section be corrected accordingly.
Section 3.1.4 establishes that fundamental issues for cultural heritage include "Havens Lake Road affords
marina and lake views that are part of the cultural heritage fabric".. and that ..."every effort will be made
to preserve these views" While the background of the plan recognizes that every effort will be made to
preserve these views there do not appear to be any policies that address this intent for preservation. Our
client is requesting that similar language requiring the protection of the views from Havens Lake Road
through every effort be included in the commercial policies of section 3.2.5 to ensure that the height of
new commercial development does not obstruct views within the delineated vista on the land use plan.

In reviewing the mapping of the proposed Land Use Plan (Figure 4) it appears as the underlying lot fabric
is off slightly. Our client notes that the ownership lines should be further west as PGYC owns to the west
of the west pier. This also raises concern over how much land within the publicly owned corridor adjacent
Havens Lake Road is proposed for commercial development. Our client would like the ownership
mapping on all figures in the Plan to accurately reflect the existing condition.
With regard to parkland dedication, the plan presented at the August 8 2012 workshop identified a
location for neighbourhood level parkland centralized on the easterly table lands proposed for residential
development. That parkland has been removed in the Draft Secondary Plan. Is it the Municipality's
intention that the regionally focused open space facilities associated with the marina and beachfront at
the base of Haven's Lake Road also serve the daily needs of the future residents on the adjacent
residential lands for parks and recreation purposes? Our client is concerned about the potential for
impact and conflict on the marina lands and adjacent municipal lands as a result of the proposed density
of residential development in the area. It is noted that the adjacent trailer park communities all make on-
site provision for parks and recreation opportunities to meet the daily needs of their residents.
Lastly, on page 1 of the Plan there is a blank with regard to the year that PGYC was formed. Our client
advises that the PGYC was formed in 1958 and incorporated in 1963.
On behalf of our client, we thank you for the opportunity to provide these comments to assist in finalizing
the Port Glasgow Secondary Plan and we look forward to a response to the above noted questions. If we
can be of any further assistance in clarifying our clients concerns, please do not hesitate to contact me.

Further to our receipt of the Port Glasgow Secondary Plan (Draft for Review and Discussion) on October 26, 2012
and our initial meeting of October 29, 2012 to review same, this serves to outline comments specific to Land Use Plan
— Figure 4, for the consideration of the Municipality of West Elgin and its Planning Consultant Team. Additional
comments pertaining to the text of the DRAFT Secondary Plan (i.e. narrative and policies) will follow under separate
correspondence from Kirkness Consulting Inc., Urban and Rural Planners on behalf of Seaside Waterfronts Inc.
By way of background, Sco-Terra Consulting Group Limited is retained by Seaside Waterfronts Inc. to assist with the
implementation of the Seaside Project at Port Glasgow, on Part Lot 6, Concession 14, Aldborough Ward in the
Municipality of West Elgin. Draft Plan of Subdivision and Draft Plan of Condominium applications pertaining to the
Seaside Project were submitted to the Ministry of Municipal Affairs and Housing (MMAH) and the Municipality of West
Elgin on April 29, 2011. These applications were deemed to be complete and subsequently circulated by MMAH to
other affected provincial and external agencies. Technical comments arising from agency circulation were assembled and
documented by MMAH in correspondence to Kirkness Consulting Inc. dated November 3, 2011, Seaside's Draft Plans
and associated response to comments arising from Agency circulation are in effect being held in abeyance pending
completion of the Secondary Plan process, as agreed to by the parties.
It is understood the DRAFT Secondary Plan was presented to Municipal Council and the Public at the Regular Session of
Council on October 25, 2012. This correspondence sets out comments on the Land Use Plan identified as Figure 4 of
the Draft Secondary Plan and included as attachment-1. More specifically, this correspondence serves to identify:
0) errors and inaccuracies identified in the Land Use Plan-Figure 4;
(ii) modifications necessary to correct these errors and inaccuracies such that the Public is not misinformed;
(iii) additional modifications proposed by Seaside Waterfronts Inc. as the initiating land use activity to the Secondary
Plan process, reflective of Seaside's extensive study and planning efforts in relation to Part Lot 6 over a 5 year
period, with due consideration of adjoining land uses, other affected stakeholders and the public interest.
Land Use Plan—Figure 4:
Lands West of Douglas Line
1. The lands west of Douglas Line should be designated "Residential" rather than "Natural Heritage". These lands
are identified as Block 91 (Residential Lands) on Seaside's Draft Plan of Subdivision, the tableland portion of
which remains in active cash crop use, currently planted in winter wheat. The "Natural Heritage" designation
shown on Figure 4 is inappropriate and establishes a false expectation with the public and neighboring residents
that no development will occur in this area.

Protected Natural Corridor
2. Seaside is amenable to accommodating a "Protected Natural Corridor" on its lands east of Havens Lake Road
and incorporating this feature into the design of its Draft Plans. However, the "Protected Natural Corridor" is
believed to be inaccurately depicted on Figure 4 and therefore potentially misleading to the public. The
"Protected Natural Corridor" should be realigned to follow the existing ditch and ravine feature running parallel
to Havens Lake Road, as shown on the modified Land Use Plan included as attachment-2.
3. Provision for placement of one or more entrance culverts in the lower segment of this ditch feature forming part
of the protected natural corridor, for purposes of facilitating future access to commercial lands east of Havens
Lake Road, should be considered and anticipated in the Secondary Plan.
Parks and Open Space
4. All "Natural Heritage" designations indicated on the DRAFT Land Use Plan (i.e. west of Furnival Road) should
be changed to "Parks and Open Space" to be consistent with the corresponding designation of lands located
east of Furnival Road. Environmental impact study by BioLogic Incorporated undertaken on behalf of Seaside,
and relied upon by the Municipality's Consultant Team to inform the Port Glasgow Secondary Plan, has
determined that the definition of Natural Heritage is not met or appropriate to these areas.
5. The lands proposed to be designated "Parks and Open Space" west of Havens Lake Road (i.e. Sixteen Mile
Creek Valley) should identify a stormwater management facility, a communal wastewater treatment facility and
a municipal wastewater treatment facility as permitted uses, pending the completion of required environmental
assessment planning processes and detailed design of such infrastructure.
Mixed Use East of Havens Lake Road
6. A "Mixed Use" designation east of Havens Lake Road should occur over a previously cleared and "open area"
which forms part of the Havens Lake Road surplus lands, These lands are positioned west of the "Protected
Natural Corridor" and are understood to be a "disposal" or "fill" area established by the Municipality when
HLR was constructed. It is noted that a contiguous natural corridor is still accommodated immediately east of
this parcel. With the corrections required to "Mixed Use" designations on the west side of HLR adjacent to this
location (per item 10 below), the designation of a "Mixed Use" area east of HLR is consistent with the west
side and representative of good planning, Seaside supports the provision of a "green planting strip" along the
frontage of this parcel, subject to the successful conclusion of its surplus lands application. Buildings in this
location would be set back from Havens Lake Road to accommodate such a "green planting strip" along the
frontage, as illustrated on the modified Land Use Plan included as attachment-2. The mature vegetation in back
of this parcel would be maintained as part of the "Protected Natural Corridor".
Pedestrian Trails and Connections East of Havens Lake Road
7. Pedestrian trails east of Havens Lake Road (HLR) are modified to "link" the "Residential", "Commercial" and
"Mixed Use" areas to the public promenade proposed within the west limit of HLR (refer to item 8). The
"north" pedestrian trail aligns with the servicing corridor required to extend services east-west across HLR. The
"south" pedestrian trail could follow the sanitary forcemain alignment required from the Commercial lands'
sanitary pump station up to the east tableland gravity sanitary sewer. The precise location and design of
pedestrian trails would be determined under subsequent Draft Plan and Site Plan Control processes, whereas the
modified Land Use Plan graphically demonstrates the intent.
Public Promenade
8. Seaside supports the development of a public promenade feature within the west limit of a "normalized" (e.g.
25 metre) Havens Lake Road right-of-way (i.e. on public lands), as discussed in our October 29, 2012
meeting and further illustrated on the modified Land Use Plan included as attachment-2.

The promenade should extend west from Havens Lake Road to the upper slope along the south limit of the west
"Mixed Use" area, offering several vista opportunities over Lake Erie, the Marina, the west beach and the
Sixteen Mile Creek Valley.
Vehicular Circulation
9. The "Vehicular Circulation" designation is applied to Havens Lake Road only, which raises the question as to
designations applicable to other municipal roads within the settlement area such as Gray Line and Furnival Road.
The specific application of this designation to Havens Lake Road is considered unnecessary, as all public roads
within the settlement boundary are presumably intended for vehicular circulation.
Mixed Use West of Havens Lake Road
10. The "Mixed Use" designation on the DRAFT Land Use Plan is improperly shown extending over a forested
ravine slope extending to Sixteen Mile Creek. The following modifications to the Mixed Use designation are
noted:
10.1 Treed ravine slope which is incorrectly shown as "Mixed Use" in DRAFT Land Use Plan (attachment-
1) is modified to the "Parks and Open Space" designation (refer to attachment-2);
10.2 Mixed Use area reduced to coincide with south and west limits of Lots 1, 2 and 3 per Seaside's Draft
Plan;
10.3 Mixed Use extended east to the proposed limit of HLR (i.e. to include surplus lands);
10.4 Mixed Use extended to north limit of Block 95 (Mixed Use) per Seaside's Draft Plan;
10.5 The architectural attraction feature is shown at the southwest corner of the west "Mixed Use" area.
Waterfront Amenity and Attraction
1 1. The "Waterfront Amenity and Attraction" designation (public lands) should extend north to meet the "Mixed
Use" designation and public promenade feature at the top of slope, as illustrated on the modified Land Use Plan
(attachment-2), This area is incorrectly identified as "Natural Heritage", which could be construed as
misleading to the public; whereas the "Waterfront Amenity and Attraction" designation is consistent with land
uses contemplated for public lands proximal to the marina and waterfront area.
Pedestrian Trails and Connections West of Havens Lake Road
12. The pedestrian trail identified within the Sixteen Mile Creek Valley is shown arbitrarily extending through steep
forested ravine slopes. It is recommended the pedestrian trail be aligned to generally follow Sixteen Mile Creek
from the marina and beach parking lot area north toward Gray Line, providing a potential pedestrian link from
Gray Line along the creek to the "Waterfront Amenity and Attraction" area, subject to negotiating access with
affected private land owners.
With respect to the inaccuracies identified in relation to the DRAFT Land Use Plan (attachment-1) presented to
Municipal Council and the Public on October 25, 2012, we request the assurance of the Municipality of West Elgin and
its Planning Consultant Team that these matters will be corrected expeditiously through updated graphical and written

It is gratifying to see that the planners & council have responded to the concerns of the
residents present at public meetings. (refer: summary of public comments). The first f ve
established principals reflect those concerns. I strongly hope that council will adhere to
them to protect the natural assets of Port Glasgow for present& future generations.
However, I reiterate my concern about the placement of storm water& sanitary sewage
management included in Seaside Proposed Master Plans. In my opinion, no such facility
should be placed within 8 km. of the Lake Erie shoreline.

I found the Public Meeting on November 15, 2012 rather frustrating. It was publicized as a meeting
where the Draft Port Glasgow Secondary Plan would be presented, and questions answered, yet
when questions specific to the contents of the Draft plan were asked, they were either discounted or
dismissed. In fact, it appeared that the only questions that would be answered were those related to
the Land Use Plan— Figure 4. However, this map was not accurate. This was a huge disatisfier, as
in order to have a clear vision of this plan, an accurate reap is needed. Please note that my
husband and I are very familiar with the beach and marine area of Port Glasgow as we walk the
beach every Sunday from April through to mid November— I can only imagine how someone who is
not as familiar with the area would perceive Figure 4.
1 am not opposed to development; however I do have questions as the Land use Plan Figure 4 looks
very different than Seaside's plan which is available on their website.
Proposed yacht club expansion -Where in the Land Use Plan Figure 4 is the expansion of 48
additional slips? I understand from the draft that it will be west of the current basin but I don't see
this in Figure 4. Once additional slips are added, where will the additional parking be located?
Also not shown in Figure 4. Will this additional parking be in the grassed areas to the west of the
public washrooms? Or will the grassed hill (where trucks/trailers park currently) be removed to make
a more formal parking area? I can't visualize where this additional parking will be, unless it's to be
expanded into the natural brush area to the west of the current gravel parking to the west of the
grassy hill. Please clarify.
Public Promenade—would this be run in front of the public washroom building or behind it? i see
that it is to wind down along the creek? How much of the natural woodland will need to be removed
in order to accommodate this?
Greenway—without an idea of how wide of a buffer strip this will be, decisions around whether this
is adequate can't be made. Will it be 10 feet? 30 feet? Will the residential backyards of the Seaside
area be fenced? More info is needed as Seaside's plan shows this area as Row Houses & a
Community Centre area.

View Vista vs Mixed Land Usage-- My understanding from the Draft is that the area designated as
Mixed land Usage will have stores on the lower level with apartments/condos on the second/third
levels. Is this correct? Details regarding Mixed Land area were vague during the meeting, and I
suspect that most in the room are not aware that this area will be multi storey.
Does this mean that the Vista Views will be on the south side of these structures with access via the
public promenade?
Architectural Attraction— I am having difficulty picturing where this will be when I look at Figure 4.
Will this attraction be at the corner of the Mixed land usage area and be overlooking the public
washroom area below? Will access be only from the public promenade.
Haven's Lake Road— Figure 4 doesn't seem to indicate the addition of boulevards down the centre
of Haven's Lake Road as is shown in the Seaside proposal. Has this been eliminated?
Tourism—
What plans are being considered for attracting tourism to the redefined Port Glasgow area?
Will there be ample parking for bus tours? Where is this on Figure 4?
A few years ago there was a summer where the beach area was raked and kept quite nice. Will this
be put back in place and what will the anticipated expense for this additional maintenance be?
Other general questions:
• With the addition of 320 dwellings/700+ new residents, what plans are in place to attract
more Doctors to the West Elgin area? Currently, we have a 300+ waiting list at the West
Lorne Medical Centre and this is WITHOUT the additional population that is anticipated.
• Do we have a commitment from Seaside to hire local trades people? This question was
asked but not answered on November 15'h I suspect because it was thought not to relate to
the Draft Plan.
• What plans are in place to address the concerns regarding current businesses in the
RodneylWest Lorne areas? Will they be granted property tax breaks? Does Seaside have
documentation from previous developments that show local businesses have been positively
affected? l was not able to locate this on either West Eglin's or Seaside's website.

further advanced than in year 1, could counsel and " planners" get their act together as professional persons and
get it done before we are all to old to enjoy this area one should take a close look at that total area not only in
the summer time but also for the rest of the year. it needs improvement the area is starting to show its age as
are the part time residents of the trailer parks my self included but I would like to see the area revitalized a
fresh new look for our grand children, new stores new restaurants ,a place you would and can go to and be
able to do some things not what we have now rotten fish on the beach not cleaned up only by mother nature
great smell great for tourism, maybe with a new development, new people, new ideas new tax money we can
make it a great community I think it can be and should be we should as older persons that are planning for the
future think that way not the way it was that worked then but that will not do for our future generations in

A word from the west Elgin chamber of commerce
As we crawl ever closer to the approval of the Port Glasgow secondary plan,
we must all take pause to reflect on what it means to west Elgin, Elgin county
and the surrounding economies. The possibilities at Port Glasgow are exciting
to say the least. we have the opportunity to become an incredible destination
and enjoy prosperous growth if we all look beyond today. we recognize that with
change comes concerns about whether the direction is the right one. The business
owners of west Elgin have no choice but to feel that change is the only reasonable
direction to take. our towns are struggling like so many other rural Ontario
communities but there is a light at the end of our tunnel . we want to urge all
involved to consider what we could be by capitalizing on our wonderful resources
and allowing those who are prepared to invest and expand do just that. The
planners
who have created the secondary plan have attempted to create a vision rooted in
positive
potential and compromise and for that we thank them. we hope that with a bit of
finesse
on all sides, the plan can be developed to accommodate everyone fairly and that we
can
all enjoy the benefits that we know will come. our reputation as stewards of the
lands
and our hospitality is. Let's not let either come into question by letting
something so
important slip through our fingers. The time for compromise is still here. we
urge
everyone involved to listen once again to each other's concerns and consider them.
Then,
adjustments can be made that will suit everyone. Please do not look at these

as concessions but rather as victories for everyone who does and will call west
Elgin home.

Regarding the Draft Secondary Plan:
1. 1 think that Mixed Use Land should be along both lower sides of Havens Lake Road and
NOT up on the West Bank Hill..... Commercial should be where the people gather
collectively, from boaters to visitors to residents. Should "open markets" come on
Saturdays, Fish Frys, whatever event is planned,the Shopping should be right in the midst of
everything. ALSO, Building Mixed Use on top of the bluff would BLOCK THE VIEW COMING
DOWN HAVENS LAKE ROAD! People looking toward the west will see a row of High
Buildings. These should be built INTO the hill, as originally planned, tucked neatly away!
2. 1 know that the lands behind Douglas Line are NOT any kind of heritage land. I have
lived in this area for 25 years and the only heritage back there were weeds that the
neighbours complained about after it was plowed for winter wheat. There was never ANY
access to that land because you would have to go through Private Property to get onto it. it
is not Heritage, nor is it needed as Park Land. Our Municipal Park is just around the corner
on Furnival Road at the lake. It has a large Picnic Shelter, Nice Childrens Play Area, Baseball
Diamond, Snack Shop and loads of grass for playing on. West Lorne has a large park with a
track around, 2 large soccer fields, a very nice Water Park, and a skateboard ramp.
3. 1 strongly disagree with golf carts on the Promenade.
Golf carts are not ALLOWED on Roads, it is illegal for a reason— IT 15 DANGEROUS
There is a PERFECTLY GOOD WAY to get golf carts to the marina. Lakewood Trailer Estates
Properties, adjoin Port Glasgow Trailer Park at the North end. Since the golf carts in question
all belong to the trailer parks, Lakewood could have a connecting trail with OUR Municipal
park at the north end, go through OUR Municipal park towards the Water, then have the
Municipality prepare a path using the old road that used to be used for boats.. Golfcarts are
STILL USING that road now, they would have access to EVERYTHING around the Marina
INCLUDING the new commercial!
It would surely save the Municipality money to do that instead of building all the many steps
going to the beach from those two trailer parks, and would keep people safe, along with
providing a new trail.
4. 1 like the Promenade idea, but I definitely disagree with motorized vehicles on it. There
was no place on your plan to show how the golf carts would get to Havens Lake Road, nor
could I tell if you wanted TWO WAY traffic on that promenade to get them back to the top. I

just do not think it would work and I think it would be very dangerous.
In summary, the Developer has changed his plans more than 40 times, in over 5 Years, to try
to keep the peace with neighbours, the different ministries as well as council. I think Seaside
has a great Plan of Subdivision, perhaps adding in the Promenade, wherever it would best fit,
and it must be very difficult to come in and try to re-design it in six months.
When Seaside Waterfont purchased these lands, it was to build a great subdivision and
village shopping area, and to bring people and tourists into this community to spend tax and
commercial dollars. The bluffs on the West side of Havens Lake Road are PRIME residential
lots and the lands behind Douglas Line are also Prime lots for the developer. Let's get on with
BUILDING!

Dear Norma:
This letter has been prepared by the Seaside Waterfront Developments Inc. development team
and provides comments on the policies contained in the Draft Secondary Plan (GP). in addition
to the comments below, S exhibits are attached to demonstrate our additional work and
comprehensive evaluation of opportunities and possibilities of development that attempts to
work with the basic concepts pf the Draft Secondary Plan. The attachments are anfollows.

Notwithstanding, Seaside does have significant concerns asfollows:
GENERAL
1. Lack nf CERTAINTY and need more precision and specifics on;
a. BOUNDARIES on land use designations on Figure 4,
b. PUBLIC PROMENADE, GREENVVAY, GATEWAY, VISTAS features,
C. SURPLUS LANDS along Havens Lake Road.

2. Seaside's BACKGROUND and TECHNICAL STUDIES and DETAILED COMMENTS provided
post August public Workshop appear not have been used as there are no references, responses,
nor changes in the SP from when it was presented at the Workshop. The lawyer for the MMAH
at the pre-hearing conference on the OPA appeals stated that the Secondary Plan could be
based on the background and technical studies that have been already done.
3. There is an overall lack of COMMUNITY ECONOMIC DEVELOPMENT content and
recognition of how Important Port Glasgow is to the declining economic base of WE.
4. The Stakeholder Input section is not fairly representing the Input. Seaside has been
involved since 2007 and has invested hundreds of thousands dollars, while other stakeholders
got involved in the past year or two and brought only concept plans with no business or
Implementation perspective. The PGYC plans require Municipal public lands.
5. Should contain a separate section on IMPLEMENTATION that advises on how policies
will be carried out, such as: the public promenade etc. and as discussed, provide for future
expansion to the settlement area. Financial matters as to how are the public amenities and
facilities are expected to be funded are important, both in terms of construction and onging
maintenance..
COMMENTS AND CHANGE REQUESTS ON FIGURE 4—see Seaside's Modified Land Use Plan to
Figure 4
6. The RESIDENTIAL DESIGNATION on east side of HLR to extend southerly and west of
Douglas Line existing residences rather than "Natural Heritage". These lands are
identified as Block 91 (Residential Lands) on Seaside's Draft Plan of Subdivision, the
tableland portion of which remains in active cash crop use, currently planted in winter
wheat. The "Natural Heritage" designation shown on Figure 4 is inappropriate and
establishes a false expectation with the public and neighboring residents that no
development will occur in this area.
7. The COMMERCIAL DESIGNATION on east side of HLR be extended northerly along east
side of Havens Lake Road, and easterly up the slope to the RESIDENTIAL designation (see
6 above) on top of bank.
8. The MIXED USE DESIGNATION on the DRAFT Land Use Plan is improperly shown
extending over a forested ravine slope extending to Sixteen Mile Creek. The following
modifications to the Mixed Use designation are noted:

a. Treed ravine slope which is incorrectly shown as "Mixed Use" in DRAFT Land Use
Plan should be modified to the "Parks and Open Space" designation as per
Seaside's Modified Plan attached.
b. Mixed Use area should be reduced to coincide with south and west limits of Lots
1, 2 and 3 per Seaside's Draft Plan;
c. Mixed Use area should be extended east to the proposed limit of HLR (i.e. to
include surplus lands);
d. Mixed Use area should be extended to north limit of Block 95 (Mixed Use) per
Seaside's Draft Plan;
e. The Mixed Use area should be added along the east side of Havens Lake Road.A
"Mixed Use" designation east of Havens Lake Road should occur over a
previously cleared and "open area" which forms part of the Havens Lake Road
surplus lands. These lands are positioned west of the "Protected Natural
Corridor" and are understood to be a "disposal" or "fill" area established by the
Municipality when HLR was constructed. It is noted that a contiguous natural
corridor is still accommodated immediately east of this parcel. With the
corrections required to "Mixed Use" designations on the west side of HLR
adjacent to this location (per item 10 below), the designation of a "Mixed Use"
area east of HLR is consistent with the west side and representative of good
planning. Seaside supports the provision of a "green planting strip" along the
frontage of this parcel, subject to the successful conclusion of its surplus lands
application. Buildings in this location would be set back from Havens Lake Road
to accommodate such a "green planting strip" along the frontage, as illustrated
on the modified Land Use Plan included as attachment-2. The mature vegetation
in back of this parcel would be maintained as part of the "Protected Natural
Corridor".
9. WATERFRONT AMENITY DESIGNATION should extend north to meet the "Mixed Use"
designation and public promenade feature at the top of slope, as illustrated on the
modified Land Use Plan . This area is incorrectly identified as "Natural Heritage", which
could be construed as misleading to the public; whereas the "Waterfront Amenity and
Attraction" designation is consistent with land uses contemplated for public lands
proximal to the marina and waterfront area.
10. The PEDESTRIAN TRAIL identified within the Sixteen Mile Creek Valley is shown arbitrarily
extending through steep forested ravine slopes. It is recommended the pedestrian trail

be aligned to generally follow Sixteen Mile Creek from the marina and beach parking lot
area north toward Gray Line, providing a potential pedestrian link from Gray Line along
the creek to the "Waterfront Amenity and Attraction" area, subject to negotiating access
with affected private land owners. The focusshould be on the objective of connecting
Gray Line and the Beach along Creek, and not a specific route. (currently it goes through
the future WWTP and on some very steep hills)
11. Seaside is amenable to accommodating a "PROTECTED NATURAL CORRIDOR" on its
lands east of Havens Lake Road and incorporating this feature into the design of its Draft
Plans. However, the PEDESTRIAN TRAIL DESIGNATION should be deleted all along the
east side of HLR as pedestrian access in that area can be along the sidewalk as part of
Havens Lake Road development.The corridor can be better protected without a
formalized pedestrian trail.
Pedestrian trails east of Havens Lake Road (HLR) are modified on Seaside's modified
plan to "link" the "Residential", "Commercial" and "Mixed Use" areas to the public
promenade proposed within the west limit of HLR (refer to item 8). The "north"
pedestrian trail aligns with the servicing corridor required to extend services east-west
across HLR. The "south" pedestrian trail could follow the sanitary forcemain alignment
required from the Commercial lands' sanitary pump station up to the east tableland
gravity sanitary sewer. The precise location and design of pedestrian trails would be
determined under subsequent Draft Plan and Site Plan Control processes, whereas the
modified Land Use Plan graphically demonstrates the intent.
12. Designating the NATURAL HERITAGE lands in the ravine and valley as PARKS and OPEN
SPACE since our ecological work shows none of this area meet the definition of NH
definition in the PPS and complicates matters by using the same terms that have different
meanings.
13. The COMMUNITY COMMERCIAL designation at southwest Furnival and Gray Line should
be included and Seaside's attached Plan shows it as Mixed Use Area.
14. The VEHICULAR CIRCULATION designation is only on HLR which begs the question of
what are other existing roads designated? It should be removed as it is unnecessary
knowing that all public roads are for vehicular circulation.

15. To re-align the PROMENADE to be located on primarily public rights-of-way and public
lands and integrated with private development. Seaside supports the development of a
public promenade feature within the west limit of a "normalized" (e.g. 25 metre) Havens
Lake Road right-of-way (i.e. on public lands), and further illustrated on the modified Land
Use Plan attached. The promenade should extend west from Havens Lake Road to the
upper slope along the south limit of the west "Mixed Use" area, offering several vista
opportunities over Lake Erie, the Marina, the west beach and the Sixteen Mile Creek
Valley.
16. To re-locate VISTAS to be on high points of re-aligned Promenade and integrated with
private development,
17. To show the ARCHITECTURAL ATTRACTION where the re-aligned promenade and mixed
use land uses prevail and created as a partnership of public and private development
initiatives.
SPECIFIC COMMENTS ON FIGURE 2 and 3
18. See the detailed comments provided by Seaside team in August of 2012 post Workshop.
Much time and effort was spent. Seaside's team tried to help with an incomplete
analysis. It remains incomplete. Suggestion is to delete the two figures, make them
more comprehensive with Seaside's suggestions already made or relegate them to
"appendices" in the Secondary Plan.
SPECIFIC POLICIY COMMENTS
19. Section 1.2—second paragraph (P) should describe the numerous studies that their
submission was based on to give fair representation.
The following could be added:
"Seaside's applications were based on extensive technical and background studies,
namely: Environment Site Assessment, Archaeology(Phases 1 thru 4), Natural Heritage
Study, Geotechnical Study, Traffic Impact Study, Environmental Impact Study(including a
Butternut Assessment). A Functional Servicing Report and an Environmental Impact
Study were submitted as separate reports. Some of this work has been used in the
development of the Secondary Plan."

20. Section 1.2 —second P last sentence could be made more complete by
Improved wording may be to replace the last sentence in the second paragraph with:
adding the following:
"MMAH has provided a table of comments from Ministries and agencies and Seaside is
preparing a comprehensive response to satisfy those comments, The approval process of
the Draft Plans would be facilitated by the Secondary Plan which would in turn facilitate
the resolution of the appeals of the Minister's Modifications."
21. Section 2.1—dealing with specific issues a thru I—have not all been dealt with, and how
are those going to be addressed? Such items as: c), g), i),J).
22. Section 2.2.2—on the matter of LSVs—is the matter of licensing for road use under the
Highway Traffic Act going to be included if routes are planned for them within public
rights-of-way? Our November 3rd discussion indicated that these vehicles would likely be
on a separate pathway than the automobile used roadways, as part of the Promenade
and the Greenway,
23. Section 2.2.3—
a. the first item (i) should have the basis and source provided.
b. Item (iii) also is questioned on having a "well-established" pedestrian and
commercial uses. Pedestrian facilities are informal paths and commercial
uses are very few and small scale.
c. There are more than 4 fundamental planning considerations, for example; a
properly designed Community, and a proper Village Core for the PG community
and may be this could be included in ii.
d. item (iv) --The mixed commercial/residential blocks should also include "retail
shops and retail services".
e. Item (iv)—fourth P should also include a TECHNICAL AND BACKGROUND STUDIES
REPORT that contained several/numerous studies on various substantive topics
such as archaeology, natural heritage; environmental site assessment, design
charette, engineering etc. This could be cross referenced to comment section 1.2
above.

24. Section 2.3 —maior concerns here with respect to incomplete listing and analysis.
Should define FIRST PLANNING PRINCIPLES. It is a new term Planning and should be
clear. Should also describe that some are BOTH opps and cons. There are more than 7
OPPORTUNITIES, such as potential for a new community and economic stimulus—
already commented earlier.
25. Section 3.1.1. HLR—issues such as traffic should be quantified to give balance to the
traffic picture. I suspect tri-axle trucks are few. "Steep and possibly unstable slopes"
should be qualified with the help of SCOTERRA'S work.
26. Section 3.1.3.—the sources of information need to be stated and proper quantification
described.
27. Sections 3.1.4--would benefit in terms of further meaningful information on Seaside's
significant work on Archaeology and its results from the Ministry of Culture. It
demonstrates depth of study on Seaside's behalf and respect to local policy and the PPS.
—see letter on page 12.
28. Section 3.1.5--second P--needs to be sourced and verified as this represents 750 to
1500 truck loads—being on average of 2 to 5 truck trips'per day??
29. Section 3.1.7—should explicitly deal with the 16 Mile Creek pedestrian trail connection
with the objective of joining Gray Line and the Beach front though a natural area and
that its' designation location, as shown, is very flexible and will be made more precise
during the development process of the tablelands. It should also be made clear that
these trails will be on public lands generally and occasionally on private lands with
appropriate arrangements made with the respective land owners.
30. Section 3.2.4—the second P tries to help with Figure 4 interpretation but insufficient
and Figure 4 needs to be more precise as previously stated and commented.
31. Section 3.2.6.—second P should include the "retail shops, retail services and offices".
32. Section 3.2.8—NATURAL HERITAGE --All "Natural Heritage" designations indicated on
the DRAFT Land Use Plan (i.e. west of Furnival Road) should be changed to "PARKS AND
OPEN SPACE" to be consistent with the corresponding designation of lands located east
of Furnival Road. Environmental impact study by Biologic Incorporated undertaken on
behalf of Seaside, and relied upon by the Municipality's Consultant Team to inform the

Port Glasgow Secondary Plan, has determined that the definition of Natural Heritage is
not met or appropriate to these areas.
This land use designation, proposed to be titled "Parks and Open Space" should identify
a storm-water management facility, a communal wastewater treatment facility and a
municipal wastewater treatment facility as permitted uses, pending the completion of
required environmental assessment planning processes and detailed design of such
infrastructure.
33. Sections 3.2.11, 3.2.12, 3.2.13, and 3.2.14--these need more quantification and
definition, Seaside intends 4 m wide sidewalks on both sides of HLR that would/could
function as a PUBLIC PROMENADE. Seaside intends a natural corridor along the east
side of HLR that can provide for both a PROTECTED NATURAL CORRIDOR and include a
PEDESTRIAN TRAIL.
The following requests are made:
a) Define PROMENADE as an overlay designation to be 3m to 6m in width and be part
of the public right-of-ways.
b) Define GATEWAY as an overlay designation to require enhanced aesthetic treatment
to both public and private realms. The COMMUNITY COMMERCIAL designation
proposed by Seaside, in southwest Furnival and Gray Line, should be included. Perhaps
the following policy would help and be placed in the Residential land use classification:
"Small scale and locally serving commercial and socio-recreational
amenities may be permitted in the RESIDENTIAL designation provided
it is adjacent to a GATEWAY designation. "
b) Define GREENWAY as an overlay designation to be within public road allowances and
to be respected and enhanced by private development along side with respect to
enhanced landscaping along the street/road frontage.
d) Add to the VISTA policies as follows:
• Recognize and encourage more vistas that would be provided by private
development,
• Built form may be designed with unique architectural features such as
"viewing rooms"on upper storeys.

® Where Vista designations cross developable land use designations,for
example, the Mixed Use area, that building and development is not
precluded.
34. Section 4.1 —goal b) needs to be separated between economic and environmental
matters. They can often conflict and have to be rationalized together. Separation gives
an opportunity to give focus to "community economic development".
The two goals (and maybe others) should be cross referenced to section 1.3 of the
Official Plan, and then could read as follows:
• Development shall be ENVIRONMENTALLY responsible by identifying and
establishing inter-connected natural heritage areas and to encourage
development that efficiently utilizes land resources.
• Development shall contribute to COMMUNITY ECONOMIC DEVELOPMENT in
terms of fostering employment opportunities and municipal revenue generating
resources, in keeping with the County of Elgin Economic Growth and
Development Plan.
Section 4.2.3--RESIDENTIAL-- "Four" storeys is being asked for in the that could occur
in the MIXED USE A and COMMERCIAL land use designations. It may be that 4 storeys
are also required to gain views and vistas of Lake Erie from Residential development
long Gray Line. Also, some multi-family blocks—currently thought to be developed as
cluster townhouses -- could also develop for seniors apartments and 4 storeys would be
helpful for this housing form as well.
The following policy would permit the proposed Community Commercial land use
intended by Seaside:
"Small scale and locally serving commercial and socio-recreational
amenities may be permitted in the RESIDENTIAL designation provided
it is adjacent to a GATEWAY designation. "
35. Section 4.2.5—MIXED USE AREA . We ask for confirmation of permission for a
predominance of residential land use along the west side of Havens Lake Road, if lands
along west side of normalized Havens Lake Road are not consolidated with lands owned
by Seaside. Tthe shallow depth of the developable lands from HLR will only warrant a
predominance of residential uses with access from internal roads only.

36. Section 4.2.9—WATERFRONT AMENITY AND ATTRACTION -- should be broadened in
the last part to give examples of what would be supportive and compatible. Could a
hotel be built west of the public washrooms?
37. Section 4,2.11—is this section intended to look after the HLR surplus lands? A separate
policy on HLR surplus lands is required to ensure that the policy framework enables
consideration of the conveyance of public lands to acquire other, more strategically
located, private lands to serve the public's recreation and natural heritage conservation
interests, and to assist private development to provide for community economic
development. See item 1c. In addition, this section should declare whether there will
be any new or additional public parks in Port Glasgow.
38. Sections 4.3.2 and 4.3.3 dealing with SANITARY SERVICING AND STORM WATER
MANAGEMENT should be explicit in that they are permitted in PARKS AND OPEN SPACE
( currently titled Natural Heritage) designations subject to the Environmental
Assessment Act and review by relevant agencies.
39. Section 4.3.4.1 —should be simplified and permit private road access and common
parking areas access in the Village Centre along Havens Lake Road.
40. HAVENS LAKE ROAD --To have a special policy on Havens Lake Road elements and road
allowance irregularity and development along side it. A draft of the policy follows:
In recognition of the importance of Havens Lake Road to the overall development of Port
Glasgow, the development of it shall reflect the following principles and elements;
• Be coordinated with the commercial and mixed use alongside it,
• The normailization of the road allowance to a width of 20 m to 25 m,
• The inclusion of lands in excess of the normalized road allowance with
development along side,
• Have a minimum of 2 through lanes of enhanced width for traffic flow,
• on-street parking,
• optional centreline median treatment,
• a promenade of widened sidewalks and landscaping with furniture to enhance
the walking, cycling and slow moving vehicles,
• aesthetic landscaping, lighting and street furniture treatment.

41. A separate section on IMPLEMENTATION - which sets out the planning tools expected
to put into effect the SP policies, such as draft plans and zoning that may require unique
regulations to fully realize the SP policies.
More over, as discussed, policies should be added to give direction to the expansion of
the settlement. The policies would logically describe future growth to be on LAKESHORE
designated lands, as opposed to AGRICULTURAL designated lands, that in turn would be
preferrable based on Lake Erie views and proximity.
The policy suggested is as follows :
Evaluation criteria for the expansion of the Port Glasgow Settlement Area shall be based
on :
a) Locating future growth in the existing LAKESHORE designation;
b) By way of adding to the SECONDARY PLAN;
c) Scope LAND REQUIREMENT JUSTIFICATION to be within the context of the local
area,past performance, and not the entire West Elglin Municipality;
d) When the development in Lot 6 is 30%built-out in terms of developable land area.

RE. Archaeological Assessment for the Proposed Development, Part tot 6, Concession

Dear Sir,
After completing Stages 1-3 archaeological assessments and partially completing the
Stage 4 mitigation on the above property, we are contemplating the completion of the Stage 4
archaeological mitigative excavation (east portion of property). This involves the final block
excavation and some mechanical excavation of areas of high concentration identified during
the Stage 3 investigation. Less than 10%of the property that is actually of any further
archaeological interest will be the subject of that further assessment. A final report following
provincial regulations and guidelines will also be issued requesting full clearance from the
Ministry of Culture at that time.
Up to this time, there has been no indication that this stage 4 mitigative excavation will
uncover anything more substantive than has already been discovered. There is no indication
that sacred ritual components or human remains will be forthcoming. indeed, our extensive
experience in archaeological mitigation, is that human remains are very rare on any
archaeological site, and this one is no different. We further are confident that this further work
can be completed within the framework and time constraints of the Draft Plan process.
We feel that once the Stage 4 is complete, the Ministry of Culture will concur with our
recommendations that no further archaeological investigations are required and issue a letter
to that effect.

I have attended most Public Meeting regarding the Port Glasgow Secondary Plan. I B o2
believe there are some key points that need to be considered when creating the
"conceptual plan" or Port Glasgow.
Firstly I think the planner should consider widening Haven's Lake Road to a) capture a
better view of the lake and b) provide more room for the public promenade to ensure it is
on "public" land. The idea that the public promenade be on public and private land
creates an uncertainity as to who is liable for what and where. If this is truly to be a
"public" access the fail promenade should be on public land and full responsibility
should be maintained by the Municipality going forward.
The placement of commercial or mixed use buildings at the bottom of Haven's Lake
Road and over the west bluff will not enhance the atmosphere of Artisan Shops and retail
shopping to the same extend as moving the mixed use buildings up Haven's Lake Road.
Access to the shops from the West Bluff seem very steep and I would wonder how many
of our senior citizens will be able to hike up the stairs to get to the shops. By having
access available off the public promenade on Haven's Lake Road to the shops the
planners would create a more attractive, easier to access and viable retail corridor.
I also have a concern around golf carts using the public promenade in terms of safety and
whether golf carts will also then mean ATV's etc. While I concur we want full access to
the Port Glasgow community for all, haven's Lake Road as it is seems to be on quite an
incline and I am wondering how we would police the safety of everyone using it,
especially if we allow golf carts etc on such a path.
The one piece that was not addressed in the secondary plan that I believe also requires
some explanation/discussion is the dredging of the marina and the removal of this
material. Will town dumptrucks be travelling up and down Haven's Lake Road with all
the rest of this activity going on? And will this not create any conflict with regular traffic
flow and the safety of those using the community?
I look forward to seeing the Secondary Plan move forward. I cannot image that after all
the effort and time put forth to explore these options our council will not see fit to pass
same.

I applaud the amount of work that the current council has put into the
secondary draft plan. The plan takes most of the public's concerns and deals
with them in the proper manner. The issue of the surplus lands on Havens
Lake Road was a great solution as it would be a greater appreciated as the gift
it was, as donated land. The Havens family will be happy with the land for
public use on the west side of the lake road. The work that Gary Blazzak
completed for the municipality was outta the box thinking and will serve the
members of our whole community well. One other concern is that the proper
boundaries be defined for the endangered species this was not addressed well

Our comments are regarding the Draft Port Glasgow Secondary Plan that was presented at the
Nov. 15, 2012 meeting and the revised Draft that is now on the Municipality of West Elgin
website.
At the meeting, it was stated that there may be MINOR revisions made to the map that was
presented. This snap outlined that the land West of Douglas Line was to remain Parks and Open
Space/Heritage Land; we now see on the Municipality of West Elgin website that Major
revisions have been made. This same land is now designated as future residential buildings, We
consider this a major change and this change should have been discussed at the meeting not
revised on your website. This area should be left untouched as Natural Heritage/Parks and Open
Space_ There are species at risk and endangered species living in this area. West Elgin Council
should look into how wide of an area should be/reserved for the Protected Natural Corridor on
the East Side of Havens Lake Road and around the ravine areas.
We asked in our last comments to allow the land west of Douglas Line to remain as
grass/parkland as it has been for decades. Many residents, tourists and children enjoyed this land
and used it for park activities. On June 28, 2012 the owner of Seaside Corporation brought in a
tractor and furrow plowed this land. It was not taken into consideration the feelings of the Port
Glasgow residents nor that there are species at risk living in this area.
We feel that council should not make a decision regarding the secondary plan until all documents
are collected from the Ministry of Natural Resources, Lower Thames Conservation, Ontario
Ministry of Municipal Affairs and all other Ministries that should be involved regarding the lands
that are to be developed.
The map has not outlined where the Sewage Treatment Plant will be located.
Also on the map we noticed that there is a Vista or what we would cal I a Looks Out Point at the
end of Douglas Line overlooking the lake; although we feel this is a good idea, we would like to
point out that there is no area for parking along Douglas Line for tourists to park their vehicles.

SUBJECT: Tri-County Water System Agreement
RECOMMENDATION:
That the letter dated December 13, 2012 of comments to the draft agreement be
sent to the Tri-County Management Board for distribution to all members to be
reviewed at the Tri-County Water Management Board meeting of January
8,2013.
INTRODUCTION:
The Municipality of West Elgin, Municipality of Southwest Middlesex, Municipality
of Dutton/Dunwich, Municipality of Chatham-Kent and Village of Newbury are
involved in the Operation of the Tri-County Primary Water System. The current
ownership of the West Elgin Water Treatment Plant is the Municipality of West
Elgin and managed by the Tri-County Management Board.
DISCUSSION:
A draft agreement was presented at the last Tri-County Management Committee.
It outlines a new operating agreement for consideration by the member
municipalities.
A review of the draft was discussed the council of West Elgin at the November
22, 2012 Council Meeting and the Administrator/Treasurer was directed to
prepare a letter to the Tri-County Management of council's concerns.

Re: Draft Tri-County Management Board
The Municipality of West Elgin is supportive of an agreement with the current five
municipalities that are members of the present Tri-County Water Management
Committee and have the following comments on the draft agreement:
1. The agreement talks about the Joint Board of Management, however it
appears that the ownership is still in the Municipality of West Elgin's name,
along the liability issues that come with ownership. The two main ownership
options 1) A Municipal Services Corporation or 2) A Municipal Service
Board (that are considered).
2. Currently OCWA carries the obligations of operator and therefore carries
liability for their actions. However at the present time the Municipality is
exposed to the responsibilities and liabilities imposed upon the owners and the
standard of care required of decision makers.
3. The advice the municipality has received is that ownership of West Elgin
Primary Water Systems including both the assets and the liabilities should be
to a Municipal Services Corporation established under section 203 of the
Municipal Act, 2001 in accordance with O,Reg 599106.
4. Currently the Licence for the Tri-County Water System is part of the
Municipality of West Elgin Drinking Water Licence and this will be required
to be changed to separate the Distribution System of West Elgin and the
Treatment Plant and associated equipment.
5. The agreement talks about the representation on the Board based on
consumption, for clarification is this consumption of all water (whether from
the West Elgin Treatment or through a purchase agreement from an
alternative source). At the present Tri-County Management Committee has an
agreement for purchase of water from the Township of Southwold, or does
this connection become an emergency connection only. At the present the
Tri-County Water System has the ability to treat all the water required for the
current users (approximately using 50%of the Treatment Plant Capacity).
6. Status of the current agreement with the Tri-County Management Committee
& Township of Southwold and the Elgin Primary Water System has expired.
How and with whom would a new agreement be negotiated with? Regular
supply? Emergency supply? At what cost? Is there a cost of Buy-in to the
Elgin Primary System? Can Water Flow both ways? Minimum/Maximum
quantities? Annual or daily?
7. Clause 8a) when a party wishes to withdraw from the System could be a little
clearer, basically it requires a minimum of 18 months notice and leaves at the
end of year.
8. Clause 14: Administering Body is the option for these services to be provided
by one of the member municipalities or separate organization?
9. Concern with clause 24 e) that the municipality will be billed for the water
losses associated with regular operation/maintenance of the Tri-County Water
System. (Such as the overflowing the West Lorne Water Tower, Storage
Tanks at the Water Treatment Plant and flushing the Transmission Water
Main from the treatment plant to the West Lorne connections.)
It is recommended that the Tri-County Management Board request legal advice of the
appropriate ownership structure being 1) Municipal Services Corporation or 2) Municipal
Services Board.

Dear, West Elgin Council
I am writing regarding the comments that are beginning accepted for
the Port Glasgow draft secondary plan.
I am finding that the process that is being used is frustrating and
inconsistent. The forms that were presented at the November15
meeting were for the figure # 4 on the plan presented at the meeting
and the same one that was presented to council, two weeks prior to
the meeting. This has givin the public close to a month since posted on
the municipalities web site to view the information. Now 4 days before
the comments are due the plan has changed again. I feel this is not
fair to the tax payers and people who are concerned with the future of
Port Glasgow.
I had time to review and comment the new plan, but believe the rest
of the people have not. This change has omitted all of the natural
heritage on the plan, which I believe is a huge concern raised from day

one. Also the vehicle traffic line going down Havens Lake Road is now
gone, not allowing it as a defined area.
I also submitted a form the last time by fax and it wasn't recieved or
documented until I contacted the Mayor. I find this all frustrating and
unfair to myself and other people in this community.
I hope that the concerns brought forward are considered from the
orginal plan, not the revised one. I would further like it discussed at
council if this process was fair and have it documented.
