001 COUNTY OF ELGIN 1 By-Law No SUM OF È 4000 AND INTEREST OF LOAN THE "TO RAISE BY WAY FOR THE ERECTION OF A COURT HOUSE TEN YEARS PAYABLE WITHIl1 &ND GOAL FOR THE " COUN'!'Y OF ELgIN Passed 22nd July 1852 WHEREAS it is expedient to raise by way of Loan the sum of Four Thousand Pounds for the purpose of defray- ing the expense incurred in the erection of a Court House and Goal, in the County Town of Elgin for the County of Elgin. And it will require the sum of È 5760 to be raised as a special rate for the payment of such Loan and the In- terest thereof for the space of Ten Years from Thursday the 22nd day of July next ensuing until the 22nd day of July in the Year of Our Lord One Thousand Eight Hundred and Sixty- Two. AND WHEREAS the amount of the rateable property of the County of Elgin amounts to È 1.145.941 assessed value for the year One Thousand Eight Hundred and Fifty- One and it will require the several rates in the Pound men- tioned in the schedule appended hereunto and forming part of this By-Law upon such rateable property as a special rate for the payment of said Interest and for the creation of a sinking fund for the payment of the principal of such Loan according to the requirements of the 177th Section of the Municipal Act 12th Victoria Chapter 81 as amended by the Act 14th and 15th Victoria Chapter 109. BE IT THEREFORE enacted by the Provisional Mu~ nicipal Council of the County of Elgin: FIRST - That it shall and may be lawful to and for the Provisional Warden to raise by way of Loan and at a rate of Interest not exceeding 8 percent per annum from any person or persons body Corporate or Politic who may be willing to advance the same upon Credit of the Debentures hereinafter mentioned a sum of money not exceeding in the whole the sum of È 4000 and to cause the same to be paid into the office of the Bank of Montreal in St. Thomas sub- ject to the order of the Treasurer of the said County for the within purposes SECOND - That it shall and may be lawful for the Provisional Warden to cause or direct any number of Deben- tures to be made in sums of not less than È 25 for such sum or sums of money not exceeding in the whole the sum of É 4000 (Cont'd) Page 2 1 By-Law No as any person or persons body Corporate or Politic shall agree to advance on the Credit of such Debentures. Such Debentures to be under the Common Seal of the said County, signed by the Provisional Warden and Treasurer and made out in such form and manner and payable at such periods not ex- ceeding ten years as the Provisional Warden shall think fit THIRD - That the interest on such Debentures shall be payable half yearly at the office of the Bank of Montreal in St. Thomas and the sum of È 400 being the tenth part of the said È 4000 shall be made payable yearly at the said office of the said Bank of Montreal in St. Thomas FOURTH - That the special rates enumerated in the schedule appended to this By-Law shall be raised, levied and collected in the same manner as other Taxes and paid over to the Treasurer as the Law directs over and above, and in ad- dition to all other rates whatsoever for the years therein mentioned upon all rateable property in the said County of Elgin for the purpose of paying the said sum of È 4000 with the interest thereon and the proceeds of such special rate so to be raised, levied and collected and paid over shall be applied solely to the payment and satisfaction of such De- bentures and the interest thereof until such Debentures and the interest thereof shall be fully paid, satisfied and dis- charged. FIFTH - That the said sum of È4000 when so paid into the office of the Bank of Montreal in St. Thomas shall be appropriated towards defraying the expense of the erec- tion of the said Court House and Goal SIXTH - And be it enacted that the By-Law shall be in force and take effect from and after the 22nd day of July next.
