AND OF FIVE THOUSA~D POilliDS RAISE THE SUM "TO ERECTING A]D IN f&¥ABLE_WITHIN TEN YEARS TO BE APPLIED COUNTY OF ELGIN THE IN AND GOAL FINISHING THE COURT HOUSE Aª~_FOR THE E~~ENSES_~f THE PROVISIONAL COUNCIL AND OFFICERS EMPLOYED I\'LQR...ABOUT THE_SAME " ~tHEREAS it is desirable and expedient to raise and contract for a Loan of Five Thousand Pounds for the purpose of being applied to defray the expense incurred or to be incurred in erecting and finishing the Court House and Goal in the County of Elgin and for the gen- eral and incidental expenses incurred or to be incurred by the Provisional Council and the Provisional Officers employed or to be employed in or about the same, and it will require the additional sum of Seven Thousand Two Hundred and Fifty Pounds to be raised as a special rate for the payment of such Loan in equal annual payments and the interest thereof for the space of ten years from Thursday the eighteenth day of August next ensuing until the eighteenth day of August in the year of Our Lord One Thousand Eight Hundred and Sixty-Two both years inclusive AND WHEREAS the amount of the whole rateable property of the County of Elgin according to the assess- ment returns for the same for the year One Thousand Eight Hundred and Fifty-Two being the financial year next pre- ceeding the passing of this By-Law was One Million One Hundred and Seventy-four Thousand Six Hundred and Ninety- three pounds and fifteen shillings currency and whereas it will require the several rates in the pound mentioned in the schedule appended hereunto and forming part of this By-Law upon such rateable property as a special rate for the payment of said interest and for the creation of a sinking fund for the equal annual payment of the princi- pal of such Loan according to the requirements of the One Hundred and seventy-seventh section of the Upper Canada Municipal Act Twelfth Victoria Chapter Eighty-first as amended by the fourteenth and fifteenth Victoria Chapter One Hundred and Nine. BE IT THEREFORE enacted by the Provisional Municipal Council of the County of Elgin under Authority of the Upper Canada Municipal Corporations and Territorial Divisions Act and it is hereby enacted under authority of the same. (Cont'd) 9 By-Law No Page 2 Firstly - That it shall and may be lawful to and for the Provisional Warden to raise by way of Loan and at a rate of interest not exceeding eight per cent per annum from any person or persons body Corporate or Politic who may be willing to advance the same upon Credit of the Debentures hereinafter mentioned a sum of money not exceeding in the whole the sum of Five Thousand Pounds and to cause the same to be paid into the office of the Bank of Montreal in St. Thomas sub- ject to the order of the Provisional Treasurer of the said County for the within purposes. Secondly - That it shall and may be lawful for the Provisional Warden to cause or direct any number of Debentures to be made in sums not less than Twenty-five pounds for such sum of money not exceeding in the whole the sum of Five Thousand Pounds as any person or persons body Corporate or Politic shall agree to advance on the credit of such Debentures. Such Debentures to be under the common seal of the said County signed by the Provisional Warden and Provisional Treasurer for the time being and the said Provisional Warden and Provisional Treasurer are hereby authorized and required to sign the same which said Debentures shall be made out in such form and manner and payable at such periods not exceeding Ten Years as the Pro- visional Warden shall think fit and shall have cou- pons attached to them for the payment of the interest which in like manner shall be signed or initialled by said Provisional Warden and Provisional Treasurer. That the Interest on such Debentures shall be payable half yearly at the Office of the Bank of Montreal in St. Thomas and, Thirdly - That the sum of Five Hundred Pounds being the tenth equal part of the said sum of Five Thou- sand Pounds shall be made payable on or before the eighteenth day of August in each of the years Eighteen Hundred and fifty-four, eighte~m hundred and fifty-five Eighteen Hundred and fifty--six, Eighteen Hundred and fifty-seven, Eighteen Hundred and fifty-eight, Eighteen Hundred and fifty-nine, Eighteen Hundred and Sixty, Eighteen-Hundred and sixty-one, Eighteen Hundred and sixty-two;& Eighteen Hundred and sixty-three at the office of the Bank of Montreal in St. Thomas. Fourthly - That for the payment of the said in- terest and the equal annual payment of the said Debentures there shall be raised, levied and collected upon the whole rateable property within the said County the rates and sums mentioned in the schedule appended to the By-Law and forming a part of the same as a special rate in each year ) (Cont'd By·-Law No. 9 Page 3 mentioned in the said schedule during which the said De- bentures or any of them shall remain outstanding or the sums of money thereby secured or any part thereof shall remain unpaid over and above and in addition to all other rates whatsoever. Fifthly - That the said sum of Five Thousand pounds when so paid into the said office of the Bank of llIontreal in St. Thomas shall be appropriated towards de-- fraying the expense of erecting and finishing the said Court House and Goal and for the general and incidental expenses incurred by the said Provisional Council and the Provisional officers employed on or about the same.
