PEDLARS AND OTHERS TRADING
TO IMPOSE Aj¿~,!,Y ON HAWKERS
COUNTLOF ELGIN
WITHIN THE
Passed 21st December 1853
"
BE IT ENACTED by the Municipal Council of the
County of Elgin under authority of the Exise Duty Trans-
fer Act for Upper Canada Sixteenth Victoria Chapter One
Hundred and eighty-four, that there shall be raised, col-
lected and paid to the Treasurer of the County of Elgin
to and for the public uses of this said County the sev-
eral Duties hereinafter mentioned for and upon the re-
spective Licenses to be taken out in the manner and by
the persons hereinafter mentioned. That is to say from
and after the first day of January next in that and
every ensuing year during the continuance of this By-Law
there shall be taken out a Licence by every Hawker, Ped-
lar and petty Chapman and other trading persons going
from place to place or to other mens' houses or who have
not become householders by permanent residence within
this County either on foot or with a horse or horses,
mule or mules or other beast bearing or drawing burthen,
boàt or boats, decked vessels or other craft or other-
wise within this County carrying to sell or exposing to
sale any goods, wares and merchandize for which License
there shall be paid the following sums viz
of
the sum
For every man travelling on foot
two pounds
For every horse, ass or mule or other beast
bearing or drawing burthen. an additional sum of three
pounds.
For every man sailing with a decked vessel,
trading and exposing for sale goods, wares and merchan-
dize on board or from the same, the sum of twelve pounds
ten shillings
For every man trading with a boat or other craft
and exposing for sale goods, wares and merchandize, for
each boat and craft the sum of seven pounds ten shillings
AND BE IT further enacted that nothing herein
contained shall extend or be construed to extend, to
prohibit any person from selling within this County any
goods, wares and merchandize or any printed papers or
books. Such goods, wares and merchandize being the grow-
th produce or manufacture of this County

Nor to hinder any person or persons who are the real
makers of any goods, wares and merchandize of the manu-
facture of this County or his, her or their agents from
selling such goods, wares or merchandize by retail or
otherwise
AND BE IT enacted that it shall be unlawful
for any Justice of Peace, Constable or Peace Officer
to detain any such Hawker, Pedlar or petty Chapman or
other trading person as aforesaid who shall be found tra-
ding without a license contrary to this By-Law or being
found trading shall refuse to produce a License accord-
ing to this By-Law after being required to do so. Such
persons may be convicted on satisfactory proof before
any Justice of the Peace and fined in a sum not exceed-
ing Ten Pounds currency, and costs of conviction to be
forthwith levied by distress and sale of the goods with
which such offender or offenders shall be found trading
as aforesaid and for want of sufficient distress the
offender or offenders may be imprisoned as such Justice
of the Peace is authorized according to Law in such case
to do.
AND BE IT FURTHER enacted that the duties imposed
by this By-Law and the penalty imposed thereby shall be
paid to the Treasurer of the County for the general use
of said County and the Clerk is hereby authorized to
issue such License which shall be in force until the first
day of January in the year following that in which such
License shall be issued and to receive as his fee for
issuing such License the sum of three and nine pence
currency.
AND BE IT FURTHER enacted that this By-Law
shall be in force from and after the first day of Janu-
ary next and not until then, anything to be contrary here-
in not withstanding.
