035 COUNTY OF ELGIN 35 By-Law No TEN OF THIS COUNCIL AND IMPOSE A BY-LAW NO. "TO REPEAL -. _. PEDLARS AND OTHERS TRADING WITHIN THE HAWKERS DUTY ON COUNTY Passed 28th December 1855 QF ELGI~' BE IT ENACTED by the Municipal Council of the County of Elgin that from and after the first day of January next it shall not be lawful for any Hawker, Pedlar, Petty Chapman or any other trading person going from Town to Town or to other persons Houses either on foot or with a horse or horses, mule or mules or other beast or beasts bearing or drawing burdens or with a boat or boats or decked vessel or other craft or otherwise to carry, to sell or expose to sale within the County of Elgin, any goods, wares or merchan- dize not being of the growth, produce or manufacture of this Province without first having obtained a license therefor from the Clerk of the said County of Elgin and the Clerk is hereby authorized and required upon the application of any such Hawker, Pedlar, Petty Chapman or other trading person as aforesaid and upon receipt of the sum hereby imposed as a duty therefor to issue a License to such applicant and such license shall be sufficient authority for the Grantee thereof to pursue his calling of Hawker, Pedlar, Petty Chap- man or other trading person within the said County from the date thereof until the first day of January then next follow- ing and no longer and the sums to be charged and paid therefor respectively shall be as follows: That is to say for every man or person travelling the sum of two pounds bearing horse, ass, mule or other beast an additional sum of two pounds. on foot, For every or drawing burthen, For every man sailing with a decked vessel trading and exposing for sale goods, wares and merchandize on board or from the same, the sum of ten pounds For every man trading with a boat or other craft and exposing for sale goods, wares and merchandize, for each boat and craft, the sum of five pounds AND BE IT ENACTED that it shall be lawful for any ratepayer within this County to require any Hawker, Pedlar, Petty Chapman or other trading person as aforesaid who shall be found trading in goods, wares and merchandize (not being (Cont'd) Page 2 35 By-Law No the growth produce or manufacture of this Province) within this County to exhibit his license and upon the refusal of any such Hawker, Pedlar, Petty Chapman or other trading person it shall be the duty of any Constable or Peace Officer upon the complaint of such rate payer or without such com- plaint if it be within his knowledge to seize and detain such Hawker, Pedlar, Petty Chapman or other trading person and to carry or bring such person or persons so seized as soon as conveniently may be Defore a Justice of the Peace which said Justice is hereby required and authorized upon satisfactory proof upon oath that the person or persons so brought before him had traded as aforesaid and had refused to exhibit his License when thereuntò required and if such person so com- plained of do not then exhibit such License to the said Justice a warrant may be issued under the hand and seal of said Justice and directed to a Constable or other Peace Officer to cause a sum not exceeding ten pounds with reason- able costs to be forthwith levied by distress and sale of the goods, wares and merchandize of such offender or of- fenders and for want of sufficient distress the offender or offenders may be dealt with as such Justice shall think most proper and is authorized according to Law in such case BE IT ENACTED that in:·every case where any Hawker, Pedlar, Petty Chapman or other trading person shall after being required thereto as herein before provided refuse to exhibit his licence he shall be liable for all costs in- curred by reason of such refusål and such costs may be re- covered by such Justice in the same way as the fine therein before provided for. BE IT ENACTED that the terms "Goods, Wares, and Merchandize" shall be held to include printed books, paper pamphlets, maps, charts, educational works and stationery. BE IT ENACTED that licenses may be issued at one half of the before mentioned rates for the last six months of the year only. AND BE IT ENACTED that the duties and fines col- lected under the By-Law shall be paid to the Treasurer of the County of Elgin for the general use of said County and that the Clerk receive the sum of three shillings and nine pence currency for each License he may issue AND BE IT ENACTED that this By-Law shall be in force upon from and after the first day of January next and not before and that By-Law Number Ten of this Council heretofore passed in that behalf shall be and is hereby repealed from and after that date.
