037 COUNTY OF ELGIN By-Law No. 37 TO CONFIRM THE ACTION rÅ’RETOFORE TAKEN FOR THE COLLECTION OF TOLLS ON THE PORT STANLEY ROAD IN THE COUNTY OF ELGIN AND ESTABLISH THE SAME." Passed 27th February 1856. WHEREAS it is expedient to confirm the action heretofore taken, and establish the authority by which tolls have been collected on the Port Stanley Gravel Road. BE IT THEREFORE ENACTED by the Municipal Council of the County of Elgin, That the following rate of tolls has been heretofore sanctioned by this Council, and ordered to be taken at the toll bars or gates on the aforesaid road, in the said County of Elgin, and shall be the rates to be taken henceforward at each gate on each time of passing (except when checking each other) with the privilege of the same vehicles and animals and same amount of load, or;not exceed- ing two thousand pounds, including weight of vehicle, re- turning free of charge once within the same day. For every vehicle drawn by one horse or animal, four pence. For every vehicle drawn by two horses or animals, and not more than 2000 Ibs. weight, including weight of vehicle, sixpence. For every additional 2000 Ibs. up to 4000 Ibs., including weight of vehicle, and the fractional part of two thousand pounds, as two thousand pounds one penny, half penny. And for every additional one hundred pounds and the fractional part of one hundred pounds, as one hundred pounds over and above four thousand pounds including weight of vehicle the sum of one half penny. For every additional horse or beast of draught at- tached to each vehicle, or for a saddle horse and rider, two pence. For every score of sheep or swine at the rate of two pence halfpenny per score. For every head of cattle one penny. (Cont'd) 37 By-Law No Page 2 Wagons having five inch tires to pass by pay- ing half the above rates of toll Freeman Ellison to be allowed to pass and re- number two, free of toll when going to and saw mill pass gate from hi s All persons passing through either of the check gates shall be allowed till noon of the following day to repass with their tickets the other check gate; also all persons living within one mile of the north side of gate number four on the gravel road, or persons coming to the road within that distance and living within two miles east and west shall pass gate number four for half toll, pro- vided they register their names at the gate. AND BE IT ENACTED that all persons driving over any of the said bridges on said line of road faster than a wàlk shall, upon conviction thereof before any Justice of the Peace, be sentenced to pay a fine of not more than fifty shillings, nor less than five shillings, together with costs of conviction, to be recovered sum- marily by distress and sale of offenders goods and chattels AND BE IT ENACTED that all persons exempt by law shall pass free of toll, also contractors and officers con- nected with the road, while on duty or persons having to pass any gate to perform statute labour and all persons on the Sabbath day going to attend, or who have attended Divine Service, also ministers of the gospel while en- gaged on ministerial duty; and this By-Law shall be in force and take effect from and after the 27th day of February, A.
