056 COUNTY OF ELGIN 56 By-Law No GIVEN BY BE FORM OF BOND AND SECURITY TO THE "TO REGULATE ----. NUMBER THREE REPEAL BY-LAW " THAT BEHALF. COUNTY TREASURER AND TO HERETOFORE PASSED IN _. _. THE Passed 17 June 1858 WHEREAS it is expedient and necessary to decide upon the form of Bond and the amount of security to be given by the County Treasurer. BE IT THEREFORE enacted by the Municipal Cor- poration of the County of Elgin in CouJ:"lcil assembled by virtue of the Assessment Laws Consolidàtion Act and the Municipal Corporations Act of Upper Canada and it is here- by enacted by authority of the same. That it shall be the duty of the Treasurer of the Municipal Council of the County of Elgin before enter- ing upon the duties of his office to deposit with the Clerk of the County Council a Bond duly executed as follows - Know all Men by Treasurer of the C D of E F of G H of I J of K L of are held and firmly bound unto the Municipal Council of the County of Elgin in Forty Thousand Dollars of lawful money of Canada to be paid to the said The Municipal Council of the County of Elgin or their certain attorney, successors or assigns for which payment to be well and truly made we bind ourselves and each of us by himself our and each and every of our heirs, executors and administrators and assigns firm- ly by these presents sealed with our seals dated the day of in the year and A B we these presents that County of Elgin WHEREAS the above bounden A B has been appointed Treasurer of the Municipality of the County of Elgin by the above mentioned the Municipal Council of the County of Elgin. NOW THE condition of this obligation is such that if the above bounden A B shall well, faithfully and truly perform the duties of his office as Treasurer of the Munici- pality of the County of Elgin and if the said A B, his heirs, executors, administrators or assigns shall well and truly ac- count for all monies received or hereafter to be received by him or any other person or persons for him or to his use as (Cont'd) Page 2 56 By-Law No such Treasurer as aforesaid or deposited or hereafter to be deposited in any Bank office or other place subject to his order and all monies disbursed or paid out or hereafter to be disbursed or paid out by him by virtue of his said office and shall well and duly account for and pay over all such monies and sums of money as shall or may come in- to his hands or under his control as such Treasurer as aforesaid as or hereafter to be required or directed by Law or by the order or orders, By-Law or By-Laws of the said Municipal Council and strictly conform to and obey all and every the laws of this said Province now or hereafter to be made and the order or orders, By-Law or By-Laws of the said Municipal Council of the said County lawfully made or passed or hereafter to be made or passed in relation there- to and also if the said A B, his heirs, executors, admini- strators or assigns shall and do at the end or sooner de- termination of his said office of Treasurer as aforesaid well and truly pay and deliver over unto the head or other officer appointed to receive the same for and on behalf of the said Municipal Council all monies, books, papers and documents belonging or appertaining to the said office of Treasurer as aforesaid the report or reports of the Auditors appointed or hereafter to be appointed to audit the accounts of the said Treasurer is and are to be taken as prima facie evidence of the correctness thereof until the contrary be shown by the above bounden parties then this obligation to be void also to remain in full force and virtue. A B C D E F G H I J K L signed ) ) ) Signed, sealed and delivered in pre- sence of AND IT IS FURTHER enacted by the authority afore- said that it shall be the duty of the County Treasurer and he is hereby required to deposit all monies belonging to the County in the Bank of the County of Elgin or such other Bank as he may be directed by said Council in a separate account for the County and it shall be the duty of said Treasurer to furnish to the Warden or Clerk of said Council a statement of the cash account at the end of each month and produce the Bank cheque book or other satisfactory evidence that the amount of money is actually on hand as represented to be. AND IT IS FURTHER enacted that the salary of said Treasurer shall be One hundred and fifty pounds per annum with an allowance of fifty pounds to pay assistant for the present year. \1'1.
