064 -'-- .~ COUNTY OF ELGIN 64 By-Law No "FOR REGULATING THE AMOUNT TO BE PAID BY AUCTIONEERS FOR MERCHANDIZE OR EFFECTS BY WARES .}- LkICENSE Tº-1?ELL_GOODS IN IT SHALL BE IN FORCE PUB4IC AUCTJON ANlL'J'..Q FIX THE TIME !HE __C OUNTY _OF Ji:i:,G [l\!,' Passed 28th January 1859 WHEREAS by the 277th Section of the Municipal Institutions Act of 1858 it is thereby enacted "that the County Council of every County may pass By-Laws for Li- censing, regulating and governing Auctioneers and other persons selling or putting up for sale goods, wares and merchandize or effects by public auction and for fixing the sum to be paid for every such License and the time it shall be in force" BE IT THEREFORE enacted by the Municipal Cor- poration of the County of Elgin - That from and after the first day of March next in that and every ensuing year during the continu- ance of this By-Law there shall be paid for a license to be taken out by every Auctioneer or person selling or putting up for sale goods, wares, merchandize or ef- fects by public auction within the said County of Elgin the sum of Twelve dollars. BE IT FURTHER enacted that any person found auctioneering any goods, wares, merchandize or effects within the said County of Elgin without a license con- trary to this By-Law shall be convicted on satisfactory proof before any Justice of the Peace for the said County and fined in a sum not exceeding Twenty dollars nor less than twelve dollars and costs which fine and costs if not paid forthwith to be levied by distress and sale of the goods and chattels of the offender and in case of there being no distress found to commit the offender to the Common Goal or nearest Lock Up House for a term not exceeding twenty days at the discretion of the convicting Justice. AND BE IT FURTHER enacted that it shall be lawful when the pecuniary penalty has been levied that one moiety thereof shall go to the informer or pro- secutor and the other moiety to the Corporation of the County of Elgin. (Cont'd) By-Law No. 64 Page 2 AND BE IT FURTHER enacted that it shall be the duty of the Clerk and he is hereby authorized to issue such Licenses with the Common Seal of the Corporation of the County attached thereto which said Licenses shall be in force for one year commencing and ending on the first day of March in each and every year during the continu- ance of this By-Law and to receive the sum of fifty cents fees - for issuing such License. AND IT IS FURTHER enacted that this By-Law shall be in force from and after the first day of March next Anything to the contrary herein not withstanding.
