Passed 16 November 1859. WHEREAS the Municipal Council of the Corpora- tion of the Township of Yarmouth passed a certain By-Law on the eighth day of August A. D. 1859 numbered 125 to stop up and convey to James Armstrong and Isaac Minor a useless piece of a road allowance laid out and for some time travelled across lots numbers twelve and thir- teen in the third concession of the Township of Yarmouth. BE IT THEREFORE enacted by the Municipal Coun- cil of the Corporation of the County of Elgin under author- ity of the 329th section of the Act 22 Victoria Chapter 99 and it is hereby enacted by the authority aforesaid that said By-Law number 125 of the Council of the Corporation of Yarmouth be and the same is hereby confirmed. By-Law No 75 Page 2 Engineer's Report on the road in rear of lots No. 12 & 13 in the 3rd concession Yarmouth. - Dated 25th July 1859. Daniel Hanvey - Engineer To the Reeve and Councillors of the Township of Yarmouth in the County of Elgin in Council assembled. Gentlemen: In relation to the road in rear of lots number 12 & 13 in the 3rd concession of said Township I beg to Report - That many years since the Government allowance for road in rear of said lots was overflowed by the waters of a mill-pond, therefore, it was necessary, at that time, to lay out a public road across the north ends of said lots No. 12 & 13 in the said third concession, to be used in place of the said Government allowance which was then overflowed. Lately the said mill-pond became useless and the said Government allowance has been made into a well-graded, well--gravelled, and where necessary, a well-bridged road, and it is now, in every respect, fit and convenient for public travel. The original owners, from whom the present owners derived their titles, received no compensation for the land taken for the laid out road. James Armstrong is now the owner of lot No 12 and Isaac Miner is the owner of said lot No. I). All which is respectfully submitted. W. 25th July 1859 (Cont'd) Page 3 75 By-Law No TOWNSHIP OF YARMOUTH 125 By-Law No ':"r.Q_~HU'L1JP _!i'n2_CONV~I TO JAlVlES..ARMSTRONG AN~!.SA&C MINOª FOR SOlVIE Ø:.._U~~LESS_p"IECE_OF A ROAD ALLOWllNCE LAID OUT AND TIME_TliAVEL.l!.~JLACROSS LOTS NOS,-12_AND U1N THE_1'.1iIRQ C0i'WE~ê.1.QN OE-1'..1iILTOIi.l!NSHIP' Passed 8 August 1859 WHEREAS an old road allowance laid out and travelled across the North end of lots numbered twelve and thirteen in the Third Concession of the Township of Yarmouth has become quite useless by reason of the improvement of the original road allowance in rear of the said lots AND WHEREAS the said James Armstrong and Isaac lVIinor have made application for a conveyance of the said old road allowance in consideration of the improvement made by them on the above original road allowance and have further given the necessary notices required by By-Law No. 122 is attested by affidavit laid upon the table of this Council AND WHEREAS Daniel Hanvey Esquire. a Provincial Land Surveyor has reported to this Council that the origi- nal road allowance above said as improved is quite suffic- ent for the public accommodation and the old road allow- ance quite useless for the purposes of public travel. This Council therefore hereby conveys, subject to the approval of the County Council, to James Armstrong and Isaac Minor the portions of the said old road allowance lying within the limits of their respective farms.
