076 ,,----- COUNTY OF ELGIN 76 By-Law No .TO CONFIRM_~Q.~RTAIN ÞY::-J:&~-º-E.._,!,HE MUNICIPAL COUNCIL OF THE TOWNSHIP OF SOUTHWOLD CONVEYING CERTAIN ROAD ALLOlril- --' --------_._----- ---_._- Passed 16 November 1859 ANCES IN SAID TOWNSHIP ----., WHEREAS the Municipal Council of the Township of Southwold in pursuance and by virtue of the authority vested in them by the Municipal Institutions Act of Upper Canada passed a By-Law on the 27th June 1859 num- bered 67 to convey so much of the original road allowance between the fourth concession and the gore in said Munici- pality in front of lot number four and part of lot number three in the fourth concession of the said Township of Southwold being the allowance for road south of the fourth concession and thereby conveys to and vests in Neal Graham Donald Crawford and Thomas Marr, the ovmers of lot number four and part of lot number three in the fourth concession in said Township, the portion of said road allowance in front of each lot, on account of its never being used as a road AND FOR THE same and similar reasons the origi- nal road allowance laid out on the west half of number eight in the fourth concession be in the same manner vested and conveyed to Dugald McArthur. The original allowance for a road across the west half of lot number ten in the fourth concession to be vested and conveyed to Neil McLean and the original allowance for road across lot number ten in the third concession be vested and deeded to Dugald Brown. And that portion of allowance for road across the north half of lot number nine in the third concession of the said Township of Southwold be vested and deeded to Peter McNicol in lieu of land taken for a road along the boundaries of said lot. BE IT THEREFORE enacted by the Municipal Council of the Corporation of the County of Elgin by virtue of the 329th Section of the Act 22nd Victoria Chapter 99 IT IS hereby enacted by the authority afore- said By-Law No. 67 be and the same is hereby AND said that the confirmed. Passed 27 AND WHEREAS Jesse P. Ball, a Deputy Provincial Land Surveyor, has in a Report of the said roads now laid before this Council certifies that road south of the Gore is quite sufficient for the sue and accommodation of the public and that the original allowance in front of the fourth concession is not required on account of its never being used as a road. AND WHEREAS over one months notice has been given of the intention to pass this By-Law at the pre- sent session of this Council and to submit the same to the County Council at a succeeding meeting of that body for their approval by putting up six written notices in as many different places in the vicinity of the said road allowance as well as by publishing the same in the Home Journal for three successive weeks. AND WHEREAS Neil Graham, Donald Crawford and Thomas Marr are desirous of purchasing the road allowance in front of their lots. The Municipal Council of the Township of Southwold by virtue of the authority vested in them by the Municipal Institutions Act of Upper Canada hereby conveys to and vests in Neil Graham, Donald Crawford and Thomas Marr, the owners of lot number four and part of number three in the fourth concession in said Township, the portion of said road allowance in front of each lot AND POR THE SAME and similar reasons the ori-- ginal road allowance laid out on the west half of number eight in the fourth concession be in the same manner vest- ed and conveyed to Dugald McArthur. The original allow- ance for a road across the west half of lot number ten in the fourth concession to be vested and conveyed to Neal McLean and the original allowance for a road across the north half of lot number nine in the third concession be (Cont'd) By-Law No 76 Page J+ (By--Law No. 67 Cont'd) vested and deeded to Peter McNicol in lieu of land taken for a road alongside of several lots.
