078 COUN'ry OF ELGIN 78 By-Law No .:'£'Q._ERECT !'B.~.J¿I1fNCORPOR4c'rEJ:LYILLAGUJ' MILLERS BURGH IN-'J'_HE T..Q1f'!.I1SHI~_Q1': YARlVlQUTli INTO A]O:[:.ICE VIJ~LAGE AND Passed 17th November 1859 Tº-~SSI9:.!:I LI~'!lTS _1'HERE'£.Q' WHEREAS a number of the inhabitants residing on the south halves of lots number four and five in the ninth concession of the Township of Yarmouth and the north halves of lots number four and five in the eighth concession of the said Township of Yarmouth hav- ing petitioned the Council of the Corporation of the County of Elgin to be erected into a Police Village under the name of Millersburgh. AND \1JHEREAS by the ninth section of the Munici- pal Institutions Act of Upper Canada it is enacted as follows "On petition of any of the inhabitants of an unincorporated Village, the Councilor Councils of the County or Counties within which the Village is situate may by By-Law erect the same into a Police Village and assign thereto such limits as may seem expedient" BE IT THEREFORE enacted by the Council of the Corporation of the County of Elgin by virtue of the author- ity aforesaid and it is hereby enacted by authority of the same that a Police Village be erected in the Township of Yarmouth in the County of Elgin under the name of Millersburgh and that the said Village be comprised of the south halves of lots number four and five in the ninth concession of Yarmouth and the north halves of lots number four and five in the eighth concession of the said Township of Yarmouth and that the boundaries of said half lots be the limits assigned to said Police Village AND IT IS ALSO enacted under the authority aforesaid and by virtue of the 85th section of said act that the election of Police Trustees for said Village shall be held on the second Monday in January at the house of John B. Miller in said Village and at the hour of ten o'clock in the forenoon (Cont'd) By-Law No. 78 Page 2 AND IT IS thereby enacted by the 92nd Section of the said Municipal Institutions Act of Upper Canada that "In every By-.Law establishing a Police or Incorpo- rated Village, a Returning Officer shall be appointed who is to hold the first election for such Village." BE IT THEREFORE enacted that Samuel W. Thompson be Returning Officer at the first Election of Police Trustees to be held at the house of John B. Miller in said Village of Millersburgh.
