107 COUNTY OF ELGIN By-Law No. 107 "TO AUTHORIZE THE CORPORATION OF THE COUNTY OF ELGIN TO RAISE BY WAY OF LOAN THE SUM OF SIX .THOUSAND DOLLARS, PAYABLE WITHIN THEN YEARS, FOR THE PURPOSE OF MAKING ALTER- ATIONS AND ADDITIONS IN THE GAQL AND GAOL YARDS OF THE SAID COUNTY OF ELGIN." Passed 29th Januarý 186) WHEREAS the Inspectors of Prisons having reported that the Gaol of the County of Elgin is insufficIent for the requirements of the Regulations embraced in the Seven- teenth Section of the Inspectors of Prisons Act, chapter One Hundred and Ten of the Consolidated Statutes of Canada. AND WHEREAS by the Twentieth Section of said Act, it is thereby enacted that "Each County C'ouncil in Upper Canada shall levy ~d raise a sum by direct Taxation sufficient to make the said alterations and addítions, or at their øption may borrow the money required Under a By-Law to be passed for that purpose, for such number of years as they may deem expedient, in which By-Law there shall be imposed and set- tled over and above and in addition to all other·rates a special rate to be levied in each year for the payment'of said Loan, and sufficient according t9 the last Assessment returns before the passing of such By-Law, to pay the whole amount of the said Loan and Interest within the period fixed by the said By-Law:for the payment thereof." AND WHEREAS the County Coúncil of the Corporation of the County of Elgin have deemed it expedieJ;lt to !'lake the additions and alterations in the Gaol and Gaol Yards of said County, that may be required to comply as nearly as practicable with the said Regulations forPrisöns, and to provide for the cost of said additions and alterations it will be necessary for theOouncil of the Corporation of the said County of Elgin to raise by way of Loan the sum of Six Thousand Dollars on th'e credit of said County, payable within Ten Years. AND WHEREAS it will require the sum of One.Thous- and Eighty Dollars to be raised annually, over and above and in addition to all ·other rates, as an equal special rate for the payment of said Lban and the Interest thereon. (cont'd) Page'2 107 By-Law No AND WHEREAS the amount of the whole rateable property of the Municipality of the County of Elgin accord- ing to the last revised Assessment ROlls, is Four Million Six Hundred and Twenty-nine ThouSand Eight Hundred and Thirty-four Dollars. AND WHEREAS it will require an equal annual spe- cial rate of one fourth of a Mill in the dollar, for pay- ing the interest and creating an equal yearly sinking fund for the payment of the Principaló'fsaid·. ae'bt or loan within ten years, in accordance with the requirements of the Municipal Institutions Act. AND WHEREAS this By-Law has been duly published as required by said Municipal Act. BE IT THEREFORE enacted by the Municipal Council of the Corporation of the County of Elgin, by virtue of the authority aforesaid, and at a meeting specially called for the purpose of considering this By-Law. THAT it shall be lawful for the said Corporat- ion to raise by way'of Loan form any person or persons, Body or Bodies Corporate, that may be willing to advance the same upon the Debentures hereinafter menti~ned, a sum of money not exceèding in the whole the' sum of Six Thous- and DOllars, and to cause the same to be paid into the hands of the Treasurer of the Corporation of the said County of Elgin for the purposes before recited AND IT IS ALSO hereby enacted that it shall be lawful for the'Warden of said County of Elgin to cause any number of Debentures to be issued, of not less than One Hundred pollars each, for such sum or sums as may be required to raise the said sum of Six Thousand Dollars. AND IT IS ALSO enacted that said Debentures shall be sealed with the seal of the said Corporation of· the County of Elgin, signed by the Warden and countersigned by the Treasurer thereof, with Coupons attached for the Inter- est thereon which Coµpons shall also be signed by the Warden and Treasurer of said Corporation. AND IT IS ALSO enacted that said Debentures shall bear interest at the rate of eight per cent per annum from the date thereof, payable half yearly on the first day of July and January in each year at the Office of the Treasurer of said County in the Town of St. Thomas. AND IT IS ALSO enacted that for the purpose of paying said Loan and' the Interest thereon, the sum of One Thousand and Eighty Dollars shall be raised annually over and above and in addition to all other rates as a special rate for that purpose during the next Ten Years: And that an Annual rate of One. fourth of a Mill in the Dollar shall be levied upon the amount of the whole rateable property of the said County of Elgin, according to the last Revised Assessment Rolls for and during the next Ten Years, as a Special Rate for paying the said Interest and creating an equal yearly sinking fund for the payment of the Principal of said Debentures or loan in accordance with the require- ments of s~id Municipal Institutions Act. AND IT IS ALSO enacted that this By-Law shall take effect and come into operation on and after the 29th day of January A.D., 1863 Read a first time 29 January 1863 Certified w.
