110 COUNTY OF ELGIN By-Law No. 110 "TO CONFIRM BY-LAW NUMBER 104 OF THE MUNICIPALITY OF THE TOWN- SHIP OF SOUTHWOLD FOR THE DISPOSAL OF A CERTAIN ROAD ALLOWANCE THEREIN MENTIONED." Passed 17 June 1863. WHEREAS By-Law Number One Hundred and Four of the Municipality of Southwold was passed on the Twenty-third day of February A.D. 1863, to convey to Henry B. Berdan and Isaac Wallace the Allowance of Road between Lot Numbers thirty- five and thirty-six, North of the North Branch of the Talbot Road in said Township of Southwold; Said Allowance having been reported by Daniel Hanvey Esquire, a Provincial Land Surveyor as not being practicable for a Road as recited in said By- Law No. 104 and it is also recited on said By-Law No. 104, that a New Road has been established between Lots No. 33 & 34 in lieu thereof, according to report of T. W. Dobbie, Deputy Provincial Land Surveyor. BE IT THEREFORE enacted by the Council of the Cor- poration of the County of Elgin under the authority of the 343 Section of the Act 22nd Victoria Chapter 54 of the "Con- soli dated Statutes for Upper Canada. THAT By-Law Number 104 of the Municipality of the Township of Southwold be and that the same is hereby confirmed and that this By-Law tàke effect from and after the passing thereof. TOWNSHIP OF SOUTHWOLD By-Law No. 104 "TO CONVEY CERTAIN ROAD ALLOWANCES THEREIN MENTIONED." Passed February 23rd, 1863 WHEREAS the Original Road Allowance between Lots No. 35 & 36, North of the North Branch of the Talbot Road in the Township of Southwo1d being condemned by Daniel Hanvey Esq. Deputy Provincial Land Surveyor, as not being practic- able for a Road. AND WHEREAS there has been a road established between Lots between 33 & 34 in lieu thereof, according to a report of T. W. Dobbie, Deputy Provincial Land Surveyor. AND WHEREAS one month's notice has been given of the intention to pass this By-Law at the present Session of this Council and to submit the same to the County Council at a succeeding meeting of that Body for their approval by put- ting up six written notices in as many different places in the vicinity of the said Road Allowance as well as by publish- ing the same in the St. Thomas Dispatch for three successive weeks. AND WHEREAS Henry B. Berdan and Isaac Wallace have made application to the Municipâlityö'f the·'\I'ownsh1p of ~. . .. - Southwold to purchase the said Road Allowance for which they will pay for the same, the sum of One Hundred and Eighty Dollars (cont'd) Page 3 110 By-Law No THE Municipal Council of the.'Township of Southwold by virtue of the authority vested in them by 12th Victoria Chapter 81 of the Municipal Institution Act of Upper Canada, hereby conveys to and vest in Henry B. Berdan and Isaac Wallace the Allowance of Road between Lots No. 35 and 36, North of the North Branch of the Talbot Road in the said Township of Southwold.
