113 COUNTY OF ELGIN By-Law No. 113 "TO REGULATE THE DUTIES OF INSPECTORS OF WEIGHTS AND MEASURES IN THE COUNTY OF ELGIN AND TO REPEAL BY-LAW NUMBER SEVENTY- SEVEN HERETOFORE PASSED IN THAT BEHALF AND ALSO TO AMEND BY- LAW NO. 32 RELATING TO THE APPOINTMENT OF INSPECTORS." Passed 12 November 1863. WHEREAS it is deemed expedient to regulate the duties of Inspector of Weights and Measures in the County of Elgin and repeal By-Law Number Seventy-seven theretofore passed by the Elgin County Council in that behalf. WHEREAS, by chapter Fifty-eight of the Consolidated Statutes for Upper Canada, it is thereby recited under section Fifth that the Council of every County may by By-Law appoint one or more Inspectors of Weights and Measures for the County or for any Division thereof to be defined in the By-Law, but no appointment or Division under said Section shall extend to or include Incorporated Towns and under Section sixth, it is also recited that when there are two or more inspectors in the Municipality, the Council thereof shall by By-Law appoint one of them to be the Senior Inspector, who shall have charge of the Standard Weights and Measures of the Municipality and such Senior Inspector shall keep the same for the use Qf him- self and of the other Inspectors. BE IT THEREFORE enacted by the Municipal Council of the Corporation of the County of Elgin under the authority and by :virtue of chapter Fifty-eight of the. Consolidated Statutes for Upper Canada. THAT the County of Elgin be divided into two Divis- ions - namely; the Eastern and Western Divisions and defined as follows: THE Eastern Division shall consist of the Municipal- ities of Vienna, Bayham, Malahide, South Dorchester, and Yarmouth. THE Western Division shall consist of the Municipal- ities of Aldborough, Dunwich and Southwold. AND IT IS HEREBY enacted that By-Law Number Thirty- two be amended and that Daniel Eccles of Iona be appointed Inspector of Weights and Measures for the Western Division of the County in place of Thomas Brown deceased. AND IT IS ALSO enacted by the authority aforesaid that every Inspector shall before entering on the duties of his office take and subscribe the following Oath. (Oath of Of'fice) I do hereby promise and swear that I will carefully preserve all Weights and Measures given me in charge or for my use as Inspector, as a standard.·for: the Division of' AND that I will deliver them over to my successor in office duly appointed f'or the purpose when required so to do and that I will honestly and faithfully discharge the duties of Inspector of Weights and Measures f'or such Division pursuant to the true intent and meaning of the law in that behalf, accord- ing to the best of my abilities and knowledge, so help me God. AND IT IS ALSO enacted that every Inspector shall carefully examine and compare with the standard so furnished as aforesaid any Weights and Measures presented to him for that purpose within his Division, and when the same are f'ound of thB true Weight or Measure, he shall mark, stamp or brand the same (if a measure as near the two ends top and bottom as may be) with the stamp or brand furnished f'or the purpose. AND IT IS ALSO enacted that every Inspector shall attend at such time and place in his Division as hereinafter mentioned or as the Municipal Council may appoint, once, but not oftener than twice, in each year with the stamps and set of Standard Weights and Measures in his custódy to examine and compare and if' found correct to stamp all Weights and Mea- sures brought to him for that purpose. (Inspector to give Notice) And he shall give one month's notice of the time and place so appointed by publishing the same in one or more newpapers or by posting up copies there- of in four of the most public places in his Division in which he is acting that he will be in attendance with such Wèights and Measures which appointment shall be as follows. FOR the Easter Division; at Vienna, Port Burwell, Straffordville, Ayl~er, Port Bruce, Sparta, Springfield, Lyons Richmond, Eden and Port Stanley during the months of September and October. And in the Western Division; at Fingal, Wallacetown, Iona, Tyroonnel and Port Glasgow and during the months of Jan- uary or February. (Fees of Inspectors) AND IT IS ALSO enacted that every Inspec- tor may demand and receive ten cents and no more every Weight and Measure he marks or stamps and that every Store,Keeper (cont'd) ll3 By-Law No Page 3 Shop Keeper, Miller, Distiller, Butcher, Baker, Huckster or other trading person and every wharfinger or forwarder in said County, who two months after the appointment of an Inspector therefore uses any Weight or Measure which has not been duly stamped according to Law or which may be found light or other- wise unjust shall on conviction forfeit a sum of not more than Twenty nor less than Eight Dollars and every such light or un- just Weight or Measure so used shall on being discovered by any Inspector be seized. (Penalty) AND on conviction of the person using the same shall be forfeited and broken up by the Inspector (Inspector may enter shops etc. to examine Weights & Measures) AND THAT every Inspector may at all reasonable times enter any shop, store, warehouse, stall, yard or place whatso- ever within his County or Division where any commodity is bought sold or exchanged, weighed, exposed or kept for sale or weighed for conveyance or carriage, and there examine all Weights, Mea- sures, steelyards or other weighing machines and compare and try the same with the copies of the Standard Weights and Mea- sures provided by Law. (Standard to be deposited with Senior Inspector). AND IT IS ALSO enacted that it shall be the duty of each Inspector after his appointments as aforesaid have been fulfilled to carefully pack and forward said Weights and Mea- sures to the care of the Inspector of the adjoining Division and that after all the appointments have been fulfilled said Weights and Measure·s. shall be put under the charge of said Senior Inspector, who shall keep the same for the use of him- self and of the other Inspectors (Expenses of Conveyance to be paid by County) AND the County Treasurer is hereby required to pay for the conveyance to the Inspectors of the said Weights and Measure.s reasonable charges thereon, oncèrtificatè ðf,:'Clerk that the work has been performed. AND IT IS HEREBY enac~ed that this By-Law shall be in force and take effect from and after the date of the pass- ing thereof. AND IT IS ALSO enacted that By~Law be and the same is hereby repealed.
