132 COUNTY OF ELGIN By-Law No. 132 "TO CONFIRM BY-LAW NUMBER 127 OF THE MUNICIPALITY OF THE TOWN- SHIP OF SOUT HWOLD" . Passed 15th November 1865 WHEREAS the Municipal Council of the Municipality of the Township of Southwold on the 25th day of May A.D. 1865 passed By-Law Number 127 for the purpose of authorizing the Council of the Township of Southwold to open and establish a new road across Lot Letter G., West of the North Branch of Talbot Road in said Township of Southwold and dispose of the original allowance for road in rear of Lot Number Forty, North of the North Branch of said Talbot Road in lieu thereof. BE IT THEREFORE enacted by the Municipal Council of the Corporation of the County of Elgin by virtue of the 343 Section ,of the Consolidated Municipal Institutions Act for Upper Canada that said By-Law Number 127 of the Municipality of Southwold be and is hereby confirmed. AND IT IS ALSO enacted that this By-Law shål1 take effect and be inforce from and after the 15th day of November 1865 the day of the passing thereof. (Southwold) (Cont'd) By-Law No 132 Page 2 TOWNSHIP OF SOUTHWOLD By-Law No. 127 "TO AUTHORISE THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF SOUTH- WOLD TO OPEN AND ESTABLISH A NEW ROAD ACROSS LOT LETTER G, WEST OF THE NORTH BRANCH OF TALBOT ROAD IN THE TOWNSHIP OF SOUTHWOLD." Passed 25th May 1865. WHEREAS it is deemed expedient and necessary to open and establish a New Road across Lot Letter G, West on the North Branch of Talbot Road in the Said Township of Southwold in lieu of the or~ginal allowance for Road in rear of Lot Number Forty, North of the North Branch of said Talbot Road which is in the opinion of this Council useless to the public. WHEREAS John Boughner the p~son upon whose land the New Road is intended to be opened and other freeholders of the said Township of Southwold have petitioned the"Municipal Council of the said Township of Southwold to open and establish a New Road across said Lot Lettar G, in place of the original allow- ance for road in rear of Lot Number Forty, North of the North Branch of Talbot Road. AND WHEREAS Notices have been given respecting said New Road as required by 321st Section of the Act 22nd Victoria, Chapter 54 of the Consolidated Statutes for Upper 'Canada. BE IT THEREFORE enacted by the Municipal Council of the Corporation of the Township of Southwold by virtue and under authority of the J31st and 3J2nd Sections of said Act, that a New Road be opened and established across Lot Letter G, West of the North Branch of Talbot Road in said Township of Southwold in lieu of the original allowance for Raod in rear of Lot Number Forty, North on the North Branch of Talbot Road in said Township of Southwold and which said New Road may be known as follows. THAT to say: Commencing at the,SoUthL!!:a.stet: ¡y:a.r¡,g1e of a part of said Lot Letter G, conveyed to one Garret Smith and at the distance of Twenty-eight chains and seventy-six links more or less Easterly from the South Westerly angle of sàid Lot Letter G, then North Twenty degrees West along the line of the Easterly limit of the land of the said Garret Smith fourteen chains, ninety links more or less to the: allow- ance for Road between said Lot Le~ter G and Lot Number Forty- six. Said new road to be sixty feet in width and laid out on the right or Easterly side of the East- erly limit of said Garret Smith's land and to be taken from land now owned by one John Boughner. AND IT IS ALSO enacted by the authority aforesaid that in lieu of said New Road and for which no compensation has been paid, this Council directs that the original allow- ance for road between said Lot Number Forty, North on the North Branch of said Talbot Road and said Lot Letter G be con- veyed to John Boughner or the person who owns the land so appro- priated for said New Road.
