PURPOSE: To consider a proposed amendment to the Zoning By-law for the purposes of disposing a surplus farm dwelling. The proposed amendment would change the zoning of lands lying on the south side of Hoskins Line east of McPherson Road from the Agricultural (Al)Zone to a 'site-specific' Special Agricultural (A2-#)Zone and to a `site-specific' Agricultural (A1-#) Zone. The amendment would also fulfill a condition imposed by the County of Elgin Land Division Committee in granting Application for Consent E60112 to dispose the surplus farm dwelling situated on the lands. The lands proposed to be rezoned 'site-specific' Special Agricultural (A24) comprise an area of 1.1 hectares (2.7 acres), a frontage of 130 metres (427 ft) and a depth of 85 metres (279 ft). The parcel is occupied by a single unit dwelling (erected circa 1960), detached garage, barn and corn crib. No change in use is proposed. The lot would satisfy the minimum lot area and minimum lot frontage requirements (4,000 sq. m and 50 m respectively) of the A2 zone but would exceed the maximum lot area requirement of 1.0 ha. All other requirements are capable of being satisfied. Permitted uses of the A2 zone include a single unit detached dwelling, bed and breakfast establishment, home occupation and an agricultural use. The lands proposed to be rezoned 'site-specific' Agricultural (A14) comprise an area of 38.9 hectares (96 acres) and a frontage of 493 metres (1,617 ft). The parcel has been cleared for agricultural purposes with the exception of a woodlot in the northwest portion of the parcel. No change in use is proposed. PURPOSE: To consider a proposed amendment to the Zoning By-law to permit a winery The proposed amendment would change the zoning of lands lying on the south side of Talbot Line (County Road No. 3)west of Blacks Road from the Agricultural (Al)Zone to a 'site-specific' Agricultural(A14)Zone. The subject lands comprise an area of 21 hectares (51.9 acres) and a frontage of approximately 300 metres (984 ft). The lands are occupied, on the westerly side, by an older two storey brick single unit dwelling (farmhouse) and various farm buildings and structures. Cultivated agricultural lands are limited with much of the parcel situated in low-lying wooded and/or scrubland areas associated with the Green Drain. A vineyard has been established between the dwelling and farm buildings and Talbot Line. The owners wish to establish a winery ('Hibernia Winery') on the lands. A processing building is proposed to be erected this year followed by a retail outlet in 2014. The winery would comprise receiving, crushing and pressing operations. Also included would be facilities and equipment for fermentation, ageing, clarification, cold storage, ambient storage, bottling operations and a testing laboratory. An amendment to the Zoning By-law is required to permit any process, use or activity not related to the processing of grapes but to winemaking (e.g. fermentation, ageing, cold and ambient storage, bottling, associated retail and hospitality uses). Site plan control would apply, including the execution of a site plan agreement between the owners and the Municipality specifying the owners' obligations with respect to the provision of appropriate siting of buildings, access, parking, buffering, lighting and signage. The subject lands are designated `Agricultural' in the West Elgin Official Plan. The proposed amendment would change the zoning firstly; of lands lying generally southerly of Powell Street and fronting on the easterly side of Munroe Street in the Village of Rodney from the Industrial (M1) Zone to the Residential First Density -- Holding (111-1-1) Zone and secondly; of lands fronting on the westerly side of Third Street (unopened) from the Industrial (11111) Zone to the Residential First Density — Holding (R1-H)Zone. The amendment would fulfill a condition imposed by the County of Elgin Land Division Committee in granting Application for Consent E95112 to enlarge an existing residential lot on Munroe Street. The holding symbol would be applied to the lands to ensure premature development does not place until appropriate services are in place and the necessary extensions of Munroe Street and Third Street are constructed at the expense of the owners and to the satisfaction of the Municipality. The result of the change in zoning is shown on the attached Key Map. The lands proposed to be rezoned Residential First Density (111) on the easterly side of Munroe Street comprise an area of 850 square metres (9,150 sq ft). The parcel is vacant and is proposed to be merged in name and title with the abutting vacant residential lot to the north, increasing its size from 809 square metres (8,712 sq ft) to 1,659 square metres (17,862 sq ft). The frontage of the enlarged lot (on Munroe Street), at 20.1 metres (66 ft), would not change. No additional lot would be created and no change in use is proposed. The lot would satisfy the minimum lot area and minimum lot frontage requirements(580 sq. m and 15 m respectively) of the R1 Zone. The lands proposed to be rezoned Residential First Density (111) fronting on the westerly side of Third Street comprise an area of 2,266 square metres (0.5 acres) and a frontage of 10.1 metres (33ft ft). It conducts its operations guided by the provisions of provincial statutes such as the Municipal Act, Municipal Affairs Act and related legislation. 1. Significant Accounting Policies The consolidated financial statements of the Municipality of West Elgin are prepared by management in accordance with generally accepted accounting principles for total governments as recommended by the Public Sector Accounting Board (PSAB) of the Canadian Institute of Chartered Accountants. The focus of PSAB financial statements is on the consolidated financial position of the Municipality and changes thereto. The Consolidated Statement of Financial Position reports financial assets and liabilities. Financial assets are available to provide resources to discharge existing liabilities or finance future operations. Net financial assets represent the financial position of the Municipality and is the difference between financial assets and liabilities. This information presents the Municipality's overall future revenue requirements and its ability to finance activities and meet its obligations. The following outlines the significant accounting policies: (a) Reporting Entity These consolidated statements reflect the assets, liabilities, revenues, expenditures and accumulated surpluses and changes in investment in non financial assets of the Municipality of West Elgin. The reporting entity includes the activities of all committees of Council and the following boards, municipal enterprises and utilities which are under the control of Council: Four Counties Community Transportation Services Port Glasgow Yacht Club West Elgin Arena West Elgin Primary Water Supply System There are no non-consolidated entities. (c) Trust Funds Trust funds and their related operations administered by the Municipality are not consolidated, but are reported separately on the Trust Funds Statements of Financial Position and Statement of Operations. (d) Accrual Accounting The accrual basis of accounting recognizes revenues as they become available and measurable; expenditures are recognized as they are incurred and measurable as a result of receipt of goods or services and the creation of a legal obligation to pay. (e) Non-Financial Assets Non-financial assets are not available to discharge existing liabilities and are held for use in the provision of services. They have useful lives extending beyond the current year and are not intended for sale in the ordinary course of operations. The change in non-financial assets during the year,together with the excess of revenues over expense, provides the Change in Net Financial Assets for the year. Tangible capital assets are recorded at cost which includes all amounts that are directly attributable to acquisition, construction, development or betterment of the asset. Significant_Accounting_Policies continued (e) Non-Financial Assets continued The Municipality has a capitalization threshold of$ 10,000, so that individual assets of lesser value are expensed unless they are pooled because collectively they have a significant value. Leases are classified as capital or operating leases. Leases which transfer substantially all of the benefits and risks incidental to ownership of property are accounted for as capital leases. All other Ieases are accounted for as operating leases and the related lease payments are charged to expense as incurred. Tangible capital assets received as contributions are recorded at their fair value at the date of receipt. The fair value is also recorded as contributed revenue. (f} Inventories Inventories held for consumption are recorded at the lower of cost or replacement cost. (g) Revenue Recognition Government grants and transfers are recognized in the financial statements as revenues in the period in which events giving rise to the transfer occur, providing the transfers are authorized, any eligibility criteria have been met, and reasonable estimates of the amounts can be made. (h) Deferred Revenue Grants, contributions and other amounts are received from third parties pursuant to legislation, regulation or agreement and may only be used in the conduct of certain programs, in the completion of specific work, or for the purchase of tangible capital assets. In addition, certain user charges and fees are collected for which the related services have yet to be performed. Revenue is recognized in the period when the related expenditures are incurred, services performed, or the tangible capital assets are acquired. (i) Financial Instruments Financial instruments of the Municipality consist mainly of cash, investments, accounts and taxes receivable. Si ficant Accounting Policies continued (j) Use of Estimates The preparation of financial statements in conformity with generally accepted accounting principles requires management to make estimates and assumptions that affect the reported amounts of assets and liabilities and disclosure of contingent assets and liabilities at the date of the financial statements, and the reported amounts of revenues an expenditures during the period. Actual results could differ from these estimates. (k) Budgets The Municipality's Council completes separate budget reviews for its operating and capital budgets each year. The approved operating budget for 2012 is reflected on the Consolidated Statement of Operations. For capital spending, budgets are set for individual projects and funding for these activities is determined annually and made by transfers from the accumulated surplus and by the application of applicable grants or other funds available to apply to capital projects. 2. Tax Revenues Property tax billings are prepared by the Municipality based on an assessment roll prepared by the Municipal Property Assessment Corporation. All assessed property values in the Municipality were reviewed and new values established based on a common valuation date which was used by the the Municipality in computing the 2012 property tax bills. Property tax revenue and tax receivables are subject to appeals which may not have been heard yet. Any supplementary billing adjustments made necessary by the determination of such appeals will be recognized in the fiscal year they are determined and the effect shared with the County of Elgin and the appropriate school boards. 3. Trust Funds Trust funds administered by the municipality amounting to $ 1,537 (2011 - $ 2,148) have not been included in the Consolidated Statement of Financial Position nor have their operations been included in the Consolidated Statement of Operations. Pension Agreements The Municipality makes contributions to the Ontario Municipal Employees Retirement Fund (OMERS), which is a multi-employer plan, on behalf of members of its staff. The plan is a defined benefit plan which specifies the amount of the retirement benefit to be received by the employees based on the length of services and rates of pay. The amount contributed to OMERS for 2012 was $ 100,096 (2011 - $ 84,993) for current service and is included as an expenditure on the Consolidated Statement of Operations. 6. Deferred Revenue A requirement of the public sector accounting principles of the Canadian Institute of Chartered Accountants, is that obligatory reserve funds be reported as deferred revenue. This requirement is in place as provincial legislation restricts how these funds may be used and under certain circumstances these funds may possibly be refunded. At the end of the year, the outstanding principal amount of this liability is (132.243) (150329) Net long-term liabilities at the end of the year $ 401 827 $ 471,508 (b) Of the long-term liabilities reported in (a) of this note, $ 326,175 in principal payments are payable from 2013 to 2017, and $ 75,652 from 2018 to 2021 and are recoverable from user rates_ (c) Approval of the Ontario Municipal Board has been obtained for those pending issues of long-term liabilities and commitments to be financed by revenues beyond the term of Council and approved on or before December 31, 1992. Those approved after January 1, 1993 have been approved by by-law. The principal and interest payments required to service these pending issue and commitments are within the debt repayment limit prescribed by the Ministry of Municipal Affairs. (d) The Municipality is contingently liable for long-term liabilities with respect to tile drainage loans, and for those for which the principal and interest had been assumed by other municipalities, school board and unconsolidated local boards,municipal enterprises, and utilities. The total amount outstanding as at December 31, 2012 is $ 132,243 (2011 - $ 150,329) and is not recorded on the Consolidated Statement of Financial Position. Post-Closure Landfill Costs During 2007, the Municipality engaged a consultant to estimate the post-closure costs for the West Elgin Landfill site. It is estimated that it will cost $ 296,180 in 2007 dollars which will approximate $568,200 in the year 2022 which is the estimated year of closure. As of December 31, 2012, the Municipality has set aside $ 564,929 (2011 - $ 469,512) in the waste management reserve to fund these costs. The amendment would partially fulfill conditions imposed by the Elgin County Land Division Committee in granting a related Application for Consent (E60112) on September 14I", 2012 for the purposes of creating a lot to dispose a surplus farm dwelling. The subject lands are situated on the south side of Hoskins Line east of McPherson Road. The proposed change in zoning is from the Agricultural (Al) Zone to the 'site-specific Agricultural (A1-93) Zone and to the 'site-specific' Special Agricultural (A2-28) Zone. The lands proposed to be rezoned A2-28 comprise the lot on which is situated the surplus farm dwelling. The parcel satisfies the minimum lot area and minimum lot frontage requirements (4,000 sq m & 50 m respectively) of the A2 zone but slightly exceeds the maximum lot area requirement of 1.0 hectares. A 'site-specific' zoning is, therefore, required to maintain compliance with the Zoning By-law. The lands proposed to be rezoned Al-93 comprise the balance of the farm. The parcel satisfies the minimum lot area and minimum lot frontage requirements (19 ha & 150 m) of the Al zone. The Al-92 zoning would prohibit a dwelling being erected on the lands as stipulated by the Provincial Policy Statement (PPS) and the West Elgin Official Plan. The proposed residential lot has been reduced considerably in size (Figure 1), from 2.9 ha (7.0 ac) as originally applied for to 1.1 ha (2.7 ac) as granted by the County of Elgin Land Division Committee. If approved, a winery processing building would be erected this year, followed by a retail outlet in 2014. Processing would consist of receiving, crushing and pressing operations. Also included would be facilities and equipment for fermentation, ageing, clarification, cold storage, ambient storage, bottling operations and a testing laboratory. The subject lands comprise an area of 21 hectares (51.9 acres) and a frontage of approximately 300 metres (984 ft) on the south side of Talbot Line west of Blacks Road. The lands are occupied by an older two storey brick faced single unit dwelling (farmhouse) and various farm buildings and structures. Cultivated agricultural lands appear quite limited with much of the parcel situated in low-lying wooded and/or scrubland areas associated with the Green Drain. A vineyard has been established between the dwelling and farm buildings and Talbot Line. The dwelling is serviced by a private water supply and sanitary waste system. Access to the dwelling is directly from Talbot Line. An existing separate entrance (unused)would be upgraded to provide access to the winery. Neighbouring lands are primarily used for agricultural purposes. Rural residential and other non- agricultural uses are limited in the area. There is no apparent potential for land use conflicts between the proposed use and neigbouring uses. Hibernia Winery—West Elgin MONTEITH BROWN PLANNING CONSULTANTS 21 May 2013 page 2 The subject lands are situated in a designated 'Agricultural Area' in the as yet unapproved County of Elgin Official Plan. Under the Plan, a distinction is made between estate wineries and farm wineries, both of which are recognized as secondary uses permitted in the 'Agricultural Area' subject to the policies of the local official plan and other criteria related to the size of retail and hospitality uses, site plan control, and the minimum area of the parcel planted with vines. The subject lands are designated 'Agricultural' in the West Elgin Official Plan. Section 6.2.1 of the Plan permits a wide range of agricultural uses. The growing of grapes for the purposes of making wine is not specifically permitted, however, would not be excluded on the basis of a reasonable interpretation: Within areas designated 'Agricultural'on Schedule 'E', the primary use of land shall be for farming and buildings, structures, uses and facilities associated with the farm operation including the farm dwelling and dwellings required for full-time farm help. A full range of agricultural activities shall be permitted including the raising of livestock and poultry(and other animals for food, fur or fibre), cash crop farming, specialty farming, mixed farming, aquaculture, apiaries, maple syrup production, horticulture, nurseries, forestry and general farming. While wineries are not specifically referenced in the West Elgin Official Plan, secondary uses that produce value-added agricultural products for the farm operation are permitted (Section 6.22) on lands designated 'Agricultural'. On this basis, the establishment of winery on the subject lands which is used for the growing of grapes for these purposes would potentially be in conformity with the Official Plan. The subject lands are zoned Agricultural (Al) in the Township of Aldborough Zoning By-law. Agricultural uses are defined as follows: 2.4 AGRICULTURAL USE, shall mean the cultivation of land, the production of crops and the processing and selling of such products on a lot and the breeding, raising, and care of livestock and the selling of such livestock or the products of such livestock raised on a lot and, without limiting the generality of the foregoing, may include animal husbandry, and the raising and harvesting of field, bush, tree or vine crops, market gardening, greenhouses, sod farming and mushroom farming, or the sale of such products raised or harvested on the lot or portion thereof. While the growing of grapes and the processing thereof would fit within the definition of agricultural use, this would not necessarily extend to the conversion of grapes into wine (as in a winery) for commercial Hibernia Winery—West Elgin MONTEITH BROWN PLANNING CONSULTANTS 21 May 2413 page 3 purposes. For this part of the operation, a rezoning would be required. An amendment would be required to permit any process, use or activity not related to the growing of grapes but rather to winemaking (e.g. fermentation, ageing, cold and ambient storage, bottling, associated retail and hospitality uses). Purpose • to enlarge an existing lakeshore parcel through the conveyance of abutting lands for the purposes of providing suitable and feasible access to the lot; • the lands proposed to be conveyed have a width of 16.8 metres (55 ft), a depth of 510 metres (1,672 ft) and an area of approximately 0.9 hectares (2.3 acres). The parcel, which has been encroached upon by potions of trailers, accessory structures and landscaped open space associated with the abutting Hickory Grove Trailer Park to the west, is proposed to be added (merged in name and title)to the abutting aforementioned lakeshore parcel; • the Lakeshore parcel which abuts the Lake Erie shoreline, is occupied by a seasonal dwelling. If the consent is granted, the parcel would be increased in size from 7.8 hectares (19.3 acres) to 8.7 hectares(21.6 acres). No additional lot would be created; • the lands proposed to be retained have a frontage of 596 metres (1,955 ft) on Gray Line and an area of 34.4 hectares (85 ac). The parcel is without buildings or structures and extensively cleared, in part, for agricultural purposes with the exception of a large wooded area which occupies the easterly portion of the property. No change in use is proposed. Provincial Policy Statement(PPS)and Official Plan • under the Provincial Policy Statement, boundary adjustments in lakeshore areas (i.e. areas other than prime agricultural areas) are not specifically addressed, although it would be reasonable to assume that given these types of severances are permitted in prime agricultural areas provided no new lot is created, the intent of the PPS would not be compromised. On this basis, the proposed severance would be consistent with the PPS; • the subject lands are situated within the designated 'Lakeshore Area' in the West Elgin Official Plan. Consents for the purposes of conveying additional lands to an adjacent lot are permitted provided: a) the conveyance does not lead to the creation of an undersized, irregularly shaped lot(s) unsuited to the purpose for which it is being used or proposed to be used, or contrary to the provisions of the Zoning By-law unless the Bylaw is otherwise amended or a variance granted; b) the lands being conveyed are registered in the same name and title as the lands to which they are being added,and c) it is stipulated in the granting of the severance that any subsequent conveyance or transaction will require a future severance(Section 10.4.2) • a proposed amendment to the Township of Aldborough Zoning By-law to recognize the seasonal dwelling as a legal use on the lakeshore (i.e. Nirta parcel) was refused by Council and subsequently appealed to the Ontario Municipal Board. The Board ruled (9 Aug 2011) in favour of the continued existence of the dwelling subject to a number of matters being addressed, including the use of a holding (M) provision in the amending zoning by-law to ensure 'that the Municipality is satisfied that legal and physical access to the Lakefront parcel exists from Gray Line over the ROW or the Hickory Grove lands for persons and vehicles, including emergency vehicles;" • legal access to the parcel being enlarged was intended to be from an existing 10 metre (33 ft) wide right-of-way registered in 1942. The right-of-way, however, is wooded and overgrown and suffers from the afore-mentioned encroachments. As a result, the right-of-way is unusable as a means of providing legal and physical access to the parcel. By widening the access to 16.8 metres (55 ft), low-lying marshy areas as well as the encroachments would be avoided; Lakeview Aldborough Bluffs Inc(Ric Knutson,agent)—Proposed Severance #0190/2279 Municipality of West Elgin 25 March 2013 page 3 • the existing 10 m right of—way lies within the lands proposed to be conveyed. As it seems, it will be difficult, a best, to remove the encroachments from Hickory Grove, a solution may be to convey the portion of the lands being conveyed affected by the encroachments to the owner of the Park. This would be an opportune time to resolve this issue and a condition imposed to ensure in fact, it does take place; • with respect to item b) and item c) above, these matters are appropriately addressed as conditions of consent, if granted. Conformity with the Official Plan is capable of being maintained. 3. Zoning By-law • the lands being conveyed, retained and enlarged are zoned Agricultural (Al) in the Township of Aldborough Zoning By-law. A By-law to change in zoning of the Nirta lands to `site-specific' Lakeshore Residential - Holding (LR-5-H) was drafted but has yet to be adopted by Council. The By-law permits and defines a seasonal dwelling, establishes various setback provisions, and requires that legal and physical access to the lands be provided prior to removal of the Holding (H) Symbol. The lands being conveyed would require a re-zoning as well such that consistent zoning applied to the enlarged parcel. The lands being retained would readily satisfy the minimum lot area and lot frontage requirements (19 ha and 150 m respectively) of the Al zone and a change in zoning or a site-specific zoning is not required. • the amendment to the Zoning By-law noted above is required to maintain compliance with the By- law. 4. Other • the proposed conveyance would provide legal and physical access to an otherwise land-locked parcel in keeping with, and necessary, to fulfill a related decision of the Ontario Municipal Board 5. The Framework Agreement is for a four-year term commencing January 1,2011 and extending to December 31,2014. Within the 2010 Framework Agreement between the Ontario Provincial Police Association (OPPA) and the Province of Ontario,the OPPA agreed to a two-year across the board salary freeze for both uniform and civilian members. The salary freeze applied to 2012 and 2013. The agreement will conclude with a salary increase in 2014,which will match the salary of the highest paid police service in Ontario. At this time the projected salary increase for 2014 will be 8.55 percent. In our meeting on March 120, I advised the group that I would raise the issue of lengthy Hwy 401 closures at the next meeting of the West Region Strategic Leadership and specifically discuss the possibility of Quick Response Crash Teams in West Region. On 03 Apr, 2013 I attended the West Region Strategic Leadership meeting and introduced the topic for discussion. A lengthy discussion took place resulting in the following: • Quick Response Crash Teams are not an option in West region as we do not have the resources to cover the extensive lengths of the three 400 Series Highways. The GTR is a much smaller geographical area to cover enabling the use of Crash Teams • Our discussion has led to the renewed emphasis of assignment of a Traffic Supervisor at all 400 Series Highway crashes when the highway is closed • The Traffic Supervisor will make a determination if a Technical Traffic Collision Investigator is required at the onset of the crash and not wait for medical reports from the hospital regarding the severity of injuries ■ And, West Region will increase the number of TTCI trained officers to expedite their ,A response when required at a crash scene. I believe the discussion at our Strategic Leadership meeting was very beneficial and the commitments provided above will assist our members to re-open Highway 401 as soon as possible when there is a requirement for it to be closed. As I stated in my last correspondence,the Opp fully realizes the impacts of closing Highway 401 and our investigators will work diligently to re-open the highway as soon as possible. We will also continue to provide the necessary resources to ensure the safe movement of traffic on the EDR. Although intimidating at-first,.I learnt quickly that I had some wonderful resources to count on. The executive has been there to guide me, support me and tolerate me. It's a tremendous team of individuals.who all seethe same light just beyond the horizon. This year,we say goodbye:to our longtime treasurer, Ed Kebbel,who has performed his duties professionally and accurately for many years. Our secretary Terry Eckersley.has now had the job for a year and is doing great work for the chamber and has been a great support to me.
