135 COUNTYOFELGIN By-Law No. 135 TO CONFIRM BY-LAW NUMBER ONE HUNDRED AND SEVENTY-FOUR OF THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF YARMOUTH". Passed 25th January 1866. WHEREAS the Municipal Council of the Township of Yarmouth on the Twenty-first day of August A.D. 1865 passed By-Law Number One Hundred and Seventy-four, to convey to Joseph R. Bostwick and John E. Couse certain portions of or- iginal road allowance as described therein. AND WHEREAS IT IS enacted in said By-Law that so much of the original allowances of road, lying between Lot one in the First and Second Concessions as has fallen into disuse by the opening of Hill Street, be conveyed to Joseph R. Bostwick the owner of the land appropriated to open the said street in lieu thereof. AND WHEREAS a certain portion of the original allow- ance for road lying between the North half of Lot Number Nine andtthe North half of Lot Numbêr eight in the Thirteenth Con- cession of the Township of Yarmouth has fallen into disuse by the opening and diversion of the said public travelled road through the South West Angle of the North half of said Lot Number nine. The Lands necessary having been purchased by the Council of Yarmouth from the owners thereof, as set forth in the annexed copy of said By-Law Number 174. lÑHEREIN IT IS enacted that the said above described price of useless road allowance be sold and conveyed to John E. Couse, the owner of the land adjacent thereto, for the sum of six dollars of lawful money of Canada. The amount of which is paid into the hands of the Treasurer of the Municipality. BE IT THEREFORE enacted by the Municipality Council of the Corporation of the County of Elgin by virtue of the 343 Section of the Consolidated Municipal Institutions Act, that By-Law Number One Hundred and Seventy-four of the Municipal Council of the Corporation of the Township of Yarmouth be and is hereby confirmed. AND IT IS enacted that this By~Law shall take effect from the date of the passing thereof. . Passed in Council this Twenty-fifth day of January A.D 1866. TO_CONVEY TO JOSEPH R " PORTIONS OF ORIGINAL ROAD ALLOWANCES AS DESCRIBED THEREIN Passed 21 August 1865. ~ WHEREAS Joseph R. Bostwick in possession of part of Lot Number One in the first concession of the Township has laid out and opened a road or street, known upon a map of the Village of Port Stanley as "Hill Street", in lieu of a portion of the allowance for road between the first and second conces- sions reported by Charles J. Davis, a Provincial Land Surveyor, to be impracticable for the purposes of a pUblic road, while the portion of Hill Street opened in lieu thereof is a travel- led public road. While no compensation was ever made to the owner of the lands thus appropriated and laid out in place of the said original allowance for road; and whereas the notices required by the Three Hundred and Twenty-first Section of Chapter Fifty-four of the Consolidated Statutes of Upper Can- ada have been duly published as therein directed. BE IT THEREFORE enacted that so much of the original allowance of road lying between Lot one in the first and sec- ond concession as had fallen into disuse by the opening of "Hill Street" above mentioned, be conveyed to Joseph R. Bost- wick, the owner of the land appropriated to open the said Street, in lieu thereof. AND WHEREAS a certain portion of the original allow- ance for road lying between Lots, the North half of Lot Number Nine and the North half of Lot Number Eight in the Thirteenth Concession of the Township, has fallen into disuse by the open- ing and diversion of the said public travelled road through the South West angle of the North half of said Lot Number Nine,·. The lands necessary having been purchased by this Council from the owner thereof Robert Lee, and notices having been given as directed by the Three Hundred and Twenty first Section of the said Act for the sale at this session of the Council of said useless piece of Road Allowance, and no party having entered an appearance agåinst the proposed sale. BE IT enacted that the said above described piece of useless Road Allowance be, and the same is hereby sold and conveyed to John E.
