141 COUNTY OF ELGIN 141 By-Law No TO CONFIRM BY-LAWS NUMBER ONE HUNDRED AND FIFTY-TWO AND ': HUNDRED AND FIFTY-THREE OF THE MUNICIBAL COUNCIL OF 1HE CORPORATION OF THE TOWNSHIP OF ALDBOROUGH ONE 1866 WHEREAS the Municipal Council of the Corporation of the Township of Aldborough on the sixteenth day of Feb- ruary A.D. 1866 passed By-Law Number one hundred and fifty- two to vest in Alexander Campbell the original allowance for road between lot number three, in the First Concession and broken front number three in the Township of Aldborough in the County of Elgin and Province of Canada as the owner of the land adjoining the original allowance for road in lieu of land taken from him by the Council of the Corporation of Aldborough for a public road Passed 21st June AND WHEREAS the said Municipal Council of the Cor- poration of the Township of Aldborough on the sixteenth day of February A.D. 1866 passed By-Law number one hundred and fifty-three reciting that the original allowance for road be- tween lot number six. in the First Concession and broken front number six be invested in Robert Fleming; that the original allowance for road between lot number seven in the first con- cession of Aldborough and broken front number seven be in- vested in John McKillop; and that the original allowamce for road between lot number eight in the First Concession and broken±'fr.ont be invested in Donald D. Campbell, the owner of the land adjoining the original allowance for road, in lieu of land taken from-:;them::'for:;!a-roàd. COUNTY OF ELGIN AND PROVINCE OF CANADA IN ALEXANDER CAMPBELL. THE OWNER OF THE LANDS ADJOINING, IN LIEU OF LANDS TAKEN FROM HIM FOR A ROAD". Passed the 16th day of February 1866 WHEREAS by 22nd Victoria Chapter 54 Section 332 Consolidated Statutes of Upper Canada it is enacted that every Municipal Council shall make to the owners of real property entered upon, taken or used by the Corporation in the exercise of its powers in respect to roads, streets or ~ other communications or to drains or common sewers due comp- ensation for any damage necessarily resulting from the exercise of such powers beyond any advantages Which the claimant may deriv.e from the contemplated work. AND WHEREAS Section 333 of the aforesaid Act pro- vides that in case a new or travelled road has been laid out and opened in lieu of an original allowance for road and for which no compensation has been paid to the owner or the land appropriated as a public road in place of such original allowance the owner if his lands adjoin the con- cession road side line or original allowance shall be en- titled thereto in lieu of the road so laid out. AND WHEREAS the original allowance for road has been examined by a Deputy Provincial Surveyor and reported by him as impracticable for a road and also that the new road is sufficient for the pUTpose of a public highway. AND WHEREAS notice of the By-Law has been duly published in a newspaper within the County and also posted up in the locality of the said road assby Law required. BE IT THEREFORE enacted by the Municipal Council of the Corporation of the Township of Aldborough by and under the authority aforesaid that the original allowance for road between Lot No.3 in the First Concession and (Cont'd) By-Law No. 141 Page 4 By-Law No. 152 Township of Aldborough broken front No.3, in the Township of Aldborough, County of Elgin and Province of Canada be and are hereby convey- ed to Alexander Campbell, the owner of the land adjoining the original allowance for road, in lieu of lands taken from him by the Council of the Corporation of Aldborough for a public road. BE IT ALSO enacted that this By~Law shall take effect and be in force from and after the twenty-second day of June one thousand eight hundred and sixty-six. Aldborough 16th day of February 1866. CAMPBELL THE OWNER OF THE LANDS ADJOINING IN LIEU OF LANDS TAKEN FROMc.THiEMTBY'YTHE'<QUARTER SESSIONS OF THE COUNTY OF MIDDLESEX FOR A ROAD". Passed the 16th day of February 1866.
