Passed 22nd January 1867
WHEREAS the Municipal Corporation of the Township
of Aldborough on the 31st day of August 1866 passed By-Law
number one hundred and fifty-four to convey the original
allowance for road between lot number ten in the first
concession and broken front number ten in the Township of
Aldborough to Robert Walker, the owner of the land adjoining
in lieu of land taken from him for a road.
AND WHEREAS by second subsection of section number
345 of the Municipal Institutions Act 29 & 30th Victoria
Chapter 51, it is recited that By-Laws for the stopping up
and sale of any original allowance for road or any part
thereof within the Municipality shall not have any force
unless passed in accordance with the 323 section of said act nor
until confirmed by a By-Law of the Council of the County in
which the Township is situate at an ordinary session of the
County Council held not sooner than three months nor later
than one year next after the passing thereof.
BE IT THEREFORE enacted by the Municipal Council
of the Corporation of the County of Elgin under and by virtue
of the authority aforesaid that By-Law Number 154 of the
Corporation of the Township of Aldborough be and is hereby
confirmed.
AND IT IS enacted that this By-Law shall be in
force from and after the date of the passing thereof.

10 IN THE FIRST CONCESSION AND BROKEN FRONT NO. 10, IN THE
TOWNSHIP OF ALDBOROUGH, COUNTY OF ELGIN AND PROVINCE OF
CANADAl.. TO ROBERT WALKER. THE OWNER OF THE LAND ADJOINING.
IN LIEU OF LAND TAKEN FROM HIM FOR A ROAD".

WHEREAS by 22 Victoria Chapter 54 Section 332
Consolidated Statutes of Upper Canada"it is ertacted that
every Municipal Council shall make to the owners of real
property entered upon, taken or used by the Corporation
in the exercise of its powers in respect to roads, streets
or other communications or to drains or common sewers due
compensation for any damages necessarily resulting from
the exercise of such beyond any advantages which the claim-
ant may derive from the contemplated work.
AND WHEREAS Section 333 of the aforesaid Act,
provides' that in case a new or travelled road has been laid
out and opened in lieu of an original allowance for road
and for which no compensation has been paid to the owner
of the land appropriated as a public road in place of such
original allowance, the owner, if his land adjoin the conces-
sion road, side line or original allowance. shall be entitled
thereto in lieu of the road so laid out.
AND WHEREAS the original allowance for road be-
tween Lot No. 10 in the first concession and broken front
No. 10 has been examined by a Deputy Provincial Surveyor
and reported by him as impracticable for a road and that
the new road is sufficient for the purpose of a public
highway.
AND WHEREAS public notice of this By-Law has been
duly given by being published in a newspaper within the Coun-
ty and also by being posted up in the locality of the said
road as by law required.
BE IT THEREFORE enacted by the Municipal Council
of the Corporation of the Township of Aldboroughby and

under the authority aforesaid that the original allowance
for road between Lot No. 10 in the first concession and
broken front No. 10 in the Township of'Aldborough, County
of Elgin and Province of Canada be and are hereby conveyed
to Robert Walker,the owner of the land adjoining the said
original allowance for road,in lieu of land taken from him
for a road by the Quarter Séssions of the County of Middle-
sex.
BE IT ALSO enacted that this By-Law shall take
effect and be in force from and after the passing of this
By-Law.
