By-Law No. 180
TO CONFIRM BY-LAW NUMBER ONE HUNDRED AND SIXTY-TWO OF THE
MUNICIPALITY OF THE TOWNSHIP OF DUNWICH."
WHEREAS the Council of the Township of Dunwich
on the tenth day of November A.D. 1868, passed By-Law Num-
ber 162, to convey to Thomas Luton the original road allow-
ance between the~orth halves of Lots No. Twelve and Thir~
teen in the fifth 'concession south of A Concession, in lieu
of road now travelled through the 'horth half of said Lot ~
Number Thirteen in the Township of Dunwich and to authorize
a conveyance of the original road allowance to the said
Thomas Luton.
AND WHEREAS by the second~ubsection of Section
345 of the Municipal Institutions Act of 1866, it is enacted
For the s~opping up and sale of any original allow-
ance that no such By-Law shall have any force until con-
firmed by a By-Law of the County Council in which the Town-
ship is situate at an ordinary session of the County Council
held not sooner than three months nor later than one year
next after the passing thereof.
BE IT THEREFORE enacted by the Corporation of the
County of Elgin that By-Law Number 162 of the Township of
Dunwich be and the same is hereby confirmed.
AND THAT this By-Law shall take effect on the seven-
teenth day of June 1869.

"TO CONVEY TO THOMAS LUTON THE ORIGINAL ROAD ALLOWANCE BE-
TWEEN THE NORTH HALVES OF LOTS NO. 12 & 13 IN THE FIFTH
CONCESSION SOUTH OF "A" CONCESSION IN LIEU OF ROAD NOW TRAVEL-
LED THROUGH THE NORTH HALF OF SAID LOT NO'¡ 13 IN THE TOWN-
SHIP OF DUNWICH AND TO AUTHORISE" A CONVEYANCE OF THE ORIG-
INAL ROAD ALLOWANCE TO' THE SAID THOMAS LUTON."
WHEREAS application has been made to the Munici-
pal Council of the Township of Dunwich by Thomas Luton that
the Currie Road rUßs through his land and has not received
compensation for the same.
AND WHEREAS J. P. Ball, Provincial Land Surveyor
has reported to the Council of the Municipality of said Town-
ship of Dunwich of the plan and survey of said original road
allowance.
IT IS IN the opinion of this Council of the said
Township of Dunwich useless to the public on account of
another road laid out in lieu of the same, they therefore
deem it expedient to convey the said original road to Thomas
Luton on whose land the road runs in lieu of the said new
or travelled road and for wfiich no compensation has been
paid to the said Thomas Luton for the land appropriatèd as a
travelled road.
AND WHEREAS notice required by Law has been given
of the intention to make an application for this By-Law to
convey the said original road to the said Thomas Luton by
being posted in the immediate neighborhood and inserted in
the St. Thomas Home Journal.
BE IT THEREFORE enacted by the Council of the Town-
ship of Dunwich by virtue and under authority of the 331st
Section of the Municipal Institution Act, Chapter 54 of
the (Consolidated Statutes for Upper Canada that the road
applied for and reported by J. P. Ball, Provincial Land Sur-
veyor between the North halves of Lots 12 & 13 in the 5th
Concession South of A Concession in said Township of Dun-
wich be and the same as hereby established as in said re-
port as follows. Viz.
COMMENCING at the north easterly angle of Lot No.
12 in the 5 Concession South of A Concession in the said
Township of Dunwich; thence South 45 degrees East along the

Easterly limit of Lot No. 12, 33 chains 70 links more or
less to the centre of said Lot No. 12 as to length; thence
North 45 degrees East, one chain to the Easterly limit of
the said road allowance, 24 chains more or less until it
intersects the Westerly limit of the public road now passing
through said Lot No. 13; thence North 50 degrees West along
the Westerly limit of the travelled road 10 chains more or
less to the place of beginning containing 3 acres.
AND IT IS ALSO enacted under authority and by
virtue of the 332 Section of the Municipal Institutions Act
22 Victoria chapter 54 of the Consolidated Statutes for Upper
Canada, that the Council of the Municipality of the said Town-
ship of Dunwich to convey the original allowance for road
in fee simple to the said Thomas Luton whose land is joining
the said road allowance in lieu of new travelled road laid
out through his land. And the Reeve of the Municipality of
the said Township of Dunwich is hereby a~thorized on beh~lf
of the Council of the said Munic;:Lpalij;ycOfc,t:tte"sàid",townshJ:p
to execute a dèëd for said road allowance as described above
to the said Thomas Luton.
AND IT IS ALSO enacted that the Reeve of Dunwich
is herehÿ authorized to attach the Seal of the Corporation
to the said conveyance for said original as mentioned in
this By-Law.
