185 COUNTY OF ELGIN By-Law No. 185 "TO CONFIRM BY-LAW NUMBER ONE HUNDRED AND EIGHTY OF THE MUNICI- PALITY OF THE TOWNSHIP OF MALAHIDE." Passed 11th November A.D. 1869. WHEREAS on the ~hird day of May, One Thousand Eight Hundred and Sixty-nine, the Municipal Council of the Township of Malahide passed By-Law Number one hundred and eighty for the stopping up and sale of the original allowance for road between Lots Number twenty-five and twenty-six in the first concession of the Township of Malahide and for fixing and declaring the terms upon which the same shall be sold and conveyed as contained in copy of said By-Law hereùnto annexed. WHEREAS by the second Subsection of Section 345 of the Municipal.Institutions Act, Chapter 51 of 29, 30th Victoria it is enacted that no such By-Law shall have any force until confirmed by a By-Law of the Council of the county in which the ~~wnship is situate at an ordinary pession of the County Council not sooner than three months nor later than one year next after the passing thereof. AND WHEREAS the Township of Malahide being one of the townships situate in the County of Elgin BE IT THEREFORE enacted by the Corporation of the County of Elgin in County Council assembled under and by vir- tue of the authority aforesaid. THAT BymLaw Number one hundred and eighty of the Mun- icipality of the Township of Malahide is hereby confirmed. AND IT IS enacted that this By-Law shall take effect from and after the eleventh day of November in the year of our Lord One Thousand Eight Hundred and Sixty-nine. NOTE: See By-Law No. 180 (Malahide) TOWNSHIP OF MALAHIDE By-Law No. 180 "A BY-LAW FOR THE STOPPING UP AND SALE OF THE ORIGINAL ALLOW- ANCE FOR ROAD BETWEEN LOTS NUMBERS TWENTY-FIVE AND TWENTY-SIX IN THE FIRST CONCESSION OF THE TOWNSHIP OF MALAHIDE. AND FOR FIXING AND DECLARING THE TERMS UPON WHICH THE SAME SHALL BE SOLD AND CONVEYED." WHEREAS it is deemed expedient to stop up and sellLthe original allowance for road between Lots Number twenty-five and twenty-six in the first Concession of Malahide, the same being unfit for road purposes and not required for a public highway. AND WHEREAS public notice of the intention to pass this By-Law has been posted up in six of the most pUblic places in the immediate neighbourhood of such road allowance during one month, and published four successive weeks in the Home Journal, a newspaper pùblished at St. Thomas and the nearest to this Municipality. AND äll interested persons having had an opportunity of being heard in person or by Councilor Attorney. THEREFORE the Municipal Council of the Township of Mala- hide in the County of Elgin in Council assembled under and by virtue of the Municipal Laws in force in this Brovince of Ontario and by the authority confirmed by the same, enacts as follows Page 3 185 By-Law No. 1. That in the event of this By-Law being confirmed by a By- Law of the Council of this County of Elgin not sooner than three months nor later than one year next after the passing hereof, the said allowance for road between Lots Number twenty-five and twenty-six in the first concession of this Township of Mal- ahide in the County of Elgin, shall be stopped up and sold for such sum of money as may be obtained for the same, and the procee.dš. of such sale shall be paid over to the Municipal' surer of this Township and constitutespart of the general f of the Township Corporation. rrea- unds 2. That for the purpose of effecting such sale to the best ad- vantage for the interests of the said Corporation, the said allowance for road shall be advertised for sale at public auct- ion, and having been so advertised during two weeks, shall be so sold to the highest bidder over the upset price of fifty dollars; and the Reeve of this Municipality is hereby appointed to effect such sale. That such sale being made, it shall be lawful for the Reeve of this Municipality, and he is hereby authorized and required at the request of the purchaser or purchasers to make, sign, seal with the corporate seal of this Municipality. execute and deliver unto the purchaser or purchasers of the tract or panel of land and premises composed of the said road allowance, a Deed of Conveyance in fee simple of and for the same with the hereditaments and appurtenance thereunto belonging for the sole use of such purchaser or purchasers, his, her or their heirs and assigns forever. 4. That this By-Law shall come into full force and effect im- mediately after having been confirmed by By-Law of the Council of the County of Elgin.
