195 COUNTY OF ELGIN By-Law No. 195 A BY-LAW TO INCORPORATE THE VILLAGE OF AYLMER IN THE COUNTY OF ELGIN." WHEREAS by the Act of the late Province of Canada passed in the twenty-ninth" and thirtieth years of Her Majesty's reign entitled "An Act respecting the Municipal Institutions of Upper Canada" it is enacted as follows. "When the census returns of an unincorporated Vil- lage with its immediate neighbourhoó.d, taken under the direct- ion of the Councilor Councils of the County or Counties in which the Village and its neighbourhood are situate show that the same contain over seven hundred and fifty inhabitants and when the residences of such inhabitants are sufficiently near to form an Incorporated Village, then on petition by hot less than one hundred resident freeholders and householders of the Village ånd neighbourhood, of whom not fewer thàn one half shall be freeholders the Council'Jor Councils,jóf"ithe'Ooun;l;yoor Counties in which the Village and neighbourhood are situate shall by By-Law erect the Village and neighbourhood into an Incorponated Village apart from the township or townships in which the same are situate, by a name and with boundaries to be respectively declared'. fun the By-Law and shall:¡name the By- Law the place for holding"the first election and the returning officer who is to hold the same';" AND WHEREAS the census of the unincorporated Vill- age of Aylmer in the County of Elgin with its immediate neigh- bourhood has been taken under the direction of the Council of the Corporation of the County of Elgin and the returns thereof show that the said Village and its said neighbourhood contain over seven hundred and fifty inhabitants whose residences are sufficiently near to form an Incorporated Village. AND WHEREAS more than one hundred resident freehold- ers and householders of the said Village and neighbourhood, of whom one-half at the least are freeholders, have presented their petition to the said Council praying that the said Village and neighbourhood may be erected into an Incorporated Village, apart from the said Township, by the name and with the bound- aries hereinafter declared. AND WHEREAS it is desirable to grant the prayer of the said petition BE IT THEREFORE enacted by the Council of the Cor- poration of the County of Elgin 1st. THAT the said Village and neighbourhood be and the same are hereby erected into and created an Incorporated Village by the name of "The Village of Aylmer" and with the boundaries or (cont'd) 195 By-Law No Page 2 limits hereinafter declared to be a body corporate, separate and apart from the Corporation of the Township of Ma1ahide in which the same are situate having all the powers and privileges of a separate and independent Municipality and subject to the provisions of any and all ò£0the statutes of the Province of Ontario or of the Dominion of Canada, now or hereafter to be enacted and in force affecting the Municipal Institutions of the said Province of Ontario. ' 2nd. THAT the said Village hereby incorporated shall comprise the following lands and the boundaries or limits shall be de- termined thereby, that is to say; All and Singular the north half of the north half of Lot Number nine, the north half of Lot Number ten and the north half of Lot Number eleven and the north quarter of the north half of Lot number twelve in the sixth concession of the Township of Malahide in the County of Elgin and Province of Ontario and the south quarter of the south half of Lot Number nine, the south three quarters of Lot Number ten, the south three quarters of the south half of Lot Number eleven, and the south half of the south half of Lot Number twelve in the seventh concession of the said Township of Mala- hide, in all containing by admeasurement five hundred acres. Jrd. THAT the first election of Council Lors for the Municipality hereby erected shall be held at the Town Hall in the said Vil- lage of Aylmer; and that James Sutherland Hallowell shall be the Returning Officer to hold the same 4th. THAT until the Council so to be elected shall be organ- ized, the Council of the Corporation of the said Township of Malahide shall continue to have the same powers in the said Village and neighbourhood as heretofore, and all other officers and servants of the said Township having jurisdiction in the said Village and neighbourhood shall until dismissed or until successors be appointed continue in their respective offices (until such organization) with the same powers, duties, and liabilities as heretofore.
