196 COUNTY OF ELGIN 196 By-Law M.o TO MAKE REGULATIONS FOR THE PRESERVATION OF PUBLIC MORALS Passed in Council 9th November 1870. " IN THE COUNTY OF ELGIN WHEREAS under the provisions of the Act Twenty-nintn: and Thirtieth Victoria, Chapter Fifty-one, Section 284 of the Municipal Act of 1866, ammertdêd by 33rd Victoria, Chapter 26 Section four of the Statutes of the Province of Ontario, power is given to the Council of every Co~ty, City and Town to pass By-Laws for the preservation of the public morals BE IT THEREFORE enacted by the Corporation of the County of Elgin by virtue and under the authority aforesaid THAT it shall not be lawful for any person to give or sell intoxiaating drink to any child, apprentice or servant within this County without the consent of the parent, master or legal protector of such child, apprentice or servant. THAT it shall not be lawful for any person to post any ~ndecent placards, writings, or pictures or to write in- decent words or to make any indecent pictures or drawing on walls or fences in any streets or public places in the County of Elgin. THAT it shall not be lawful for any person to be drunk or to utter or make use of any profane oath or obscene blasphemous or grossly insulting language or other immorality or indecency in the said County of Elgin. THAT it shall not be lawful for any person or per- sons to keep a disorderly house or house" òf illc"fame.vtithin<· the County of Elgin. THAT it shall not be lawful for any person to keep a gambling house in said County and that all Fars Banks Rouge et Noir, Roulètte Tables and other devices for gambling found therein shall be seized and destroyed. THAT it shall not be lawful for vagrants or men- dicants to be found in the County of Elgin. THAT it shall not be lawful for any person to be found drunk or disorderly in any street, highway or public place in the said County of Elgin. THAT it shall not be lawful for any person to in- decently publicly expose his or her person or to be guilty of any indecent exhibition within the said County of Elgin. (cont'd) Page 2 196 By-Law No THAT it shall not be lawful for any person or per- sons to be horse racing on any of the pUblic streets or high- ways in the County of Elgin. THAT it shall not be lawful for any person to bathe or indecently expose his or her person by washing in any waters within this County, lying or running near any public highway between the hours of six o'clock in the morning and eight at night unless provided with and clothed in a proper bathing dress sufficient to prevent any indecent exposure of their persons. AND BE IT enacted by the authority aforesaid, that any person or persons guilty of a violation of any of the provisions of this By~Law,shall upon conviction before any Justice or Justices of the Peace having j.nrisdiction in the said County of Elgin, be liable to a fine of not more than twenty dollars nor less than one dollar exclusive of costs. In de~ault of payment to be levied and collected by distress and sale of goods and chattels of said offender or offenders and in case no goods and chattels are found belonging' to" the said offender or offenders as aforesaid on which to levy any fines or fees as aforesaid, it shall be lawful for any such Justice or Justices of the Peace in their discrètion"_ to.co.mmit the offender or offenders to the common jailor lockup house in the said County of Elgin for a period not exceeding twenty days nor less than one day with or without hard labour as the said Justice or Justices may determine, unless the fine and costs be sooner paid. AND IT IS further enacted that all fines and pen- alties imposed and collected under and by virtue of this By- Law shall belong to and be appropriated to the use of the Municipality in which the offence was committed. AND IT IS ALSO enacted that By-Law Number 157 of this Council is hereby repealed.
