198 COUNTY OF ELGIN By"':Law No. 198 TO CONFIRM BY-LAW NUMBER 184 OF THE MUNICIPALITY OF THE TOWNSHIP OF DUNWICH". WHEREAS on the sixteenth day of August A.D. 1870 the Council of the Township of Dunwich passed By-Law Number one hundred and eighty-four to establish a road through part of Lot 21 fun the eighth concession and part of Lot 21 in the ninth concession of the Township of Dunwich and to authorize the conveyance of the original road allowance in lieu thereof as mentioned in copy of said By-Law Number 184 hereunto annexed. AND WHEREAS by the second Subsection of Section 354 of the Act 29-30 Victoria, Chapter 51, it is enacted that no such By-Laws shall have any force until confirmed by a By-Law of the Council of the County in which the Township is situate at an ordinary session of the Coun~y Council not sooner than three months nor later than one year next aften the passing thereof. AND WHEREAS the Township of Dunwich being one of the Townships situate within the County of Elgin. BE IT THEREFORE enacted by the Corporation of the County of Elgin in County Council assembled under and by vir- tue of the authority aforesaid THAT By-Law Number one hundred and eighty-four of the Municipality of Dunwich be and the same is hereby con- firmed. AND IT IS ALSO enacted that this By-Law shall be in force and take effect from and after the twenty-sixth day of January A.D. 1871. Passed in Council this 26th day of January A.D ;1;871. WHEREAS it has been represented by Malcom Campbell and John Lyons that part of the road allowance for road be- tween the eighth and ninth concessions across Lot 21 in said concessions are impracticable for a road on account of hills and have petitioned the Municipal Council of the Township of Dunwich to establish a road through part of Lot 21 in the 8th concession and Lot 21 in the 9th concession and in lieu thereof to grant the proprietors the original road allowance AND WHEREAS Jesse P. Ball, Provincial Land Surveyor has reported to the Council of the Municipality of the said Township of Dunwich of said new road as being good and sùffic- ient for the purposes of a public highway AND WHEREAS the original allowance of road between the eighth and ninthQoDncessions of said Township of Dunwich opposite Lot p1 is in the opinion of this Council of said Township of Dunwich useless to the public they therefore deem it expedient to convey the said original road allowance for road to the persons upon whose lands the new road runs in lieu of said new road. AND WHEREAS notice required by law has been given of the intention to make application for this By-Law to est- ablish a new road and to dispose of the said original road allowance by being posted up in the immediate neighbourhood of such original road allowance and inserted in the Home Journal BE IT THEREFORE enacted by the Municipal Council of the Township of Dunwich by virtue and under authQDity of the 332nd Section of the Municipal Institutions Act 22 Vic- toria, Chapter 54 of the Consolidated Statutes of Upper Can- ada. THAT the road applied for and reported on by Jesse Provincial Land Surveyor, through part of Lot 21 in (Cont'd) Ball p Page 4 198 By-Law No the eighth concession and ninth concession be and the same is hereby established as in said report to run as follows: Commencing in front of ninth concession about 75 links eastward of the centre as width of Lot No. 21 in said concession; thence north 57 degrees JO minutes east three chains; thence north 14 degrees JO minutes east two chains, 75 links to a post set in the road allowance between the 8th & 9th concessions; thence north two chains; thence north 42 degrees east one chain, thirty-nine links; thence north 73 degrees east one chain, 9 links; thence south eighty-seven degrees east two chains, 29 links to a post set near the cen- tre of said road allowance; said road to be three rods wide and the marked line in the survey the centre AND IT IS ALSO enacted that the Reeve of the Muni- cipality of Dunwich is hereby authorized to attach the seal of the Corporation of the said Township of Dunwich to the conveyance for said original allowances as mentioned in this By-Law. AND IT IS ALSO enacted that this By-Law shall be in force and take effect from and after the date and pas- aing thereof Township of Dunwich this sixteenth day of August 1870.
