221 COUNTY OF ELGIN By-Law No. 221 TO CONFIRM BY-LAWS NUMBER. TWO HUNDRED AND TWO AND TWO HUNDRED AND THREE OF THE COUNCIL OF THE TOvfflSHIP OF DUNWICH TO CONVEY CERTAIN ROAD ALLOWANCES THEREIN MENTIO~ED". WHEREAS by the second sub-section of section 345 of the Municipal Institutions Act 29 - 30 Victoria Chapter 51 of the Statutes of Canada it is enacted - That no By-law for the stopping up and sale of any Original Allowance for Road or any part thereof within the Municipality shall have any force until confirmed by a By-Law of the County Council of the County in which the Township is situate at an ordinary session of the County Council held not sooner than three months nor later than one year next after the passing thereof. AND \1HEREAS the Council of the Township of' Dunwich on the eighth day of January 1872 passed By-laws numbers 202 & 203 to convey certain parts of road allowances therein men- tioned and described in the copies of' said By-laws attached to this By-Law. AND WHEREAS it is deemed necessary that said By-IJaws should be confirmed. BE IT THEREFORE enacted by the Corporation of the County of' Elgin in Council assembled and under and by virtue of the authority aforesaid - That By-laws number 202 & 20J of the Council of the 'roV'ffiship of Dunwich be and the same are hereby confirmed. And that this By-law be:ill. force and take effect from and after the seventh day of June one thousand eight hundred and seventy two. TJ-j:E SIXTH CONCESSION OF SAID 'rOWNSHIP AND TO AUTHORIZE 'rHE CONVEYANCE OF THE ORIGINAL ROAD ALLOWANCE TO SAMUEL HARRIS" WHEREAS application has been made to the Municipal Council of the TO¥illship of Dunwich by Samuel Harris that the Coyne Road runs through his land and he has received no comp- ensation for the same. AND m{EREAS Wm. G. M. George, Esquire, Provincial Land Surveyor has reported to the Council of the Municipality of the said Township of Dunwich of the survey of the original road allowance. It is in the opinion of this Council of the said Township of Dunwich, useless to the public on account of an- other road laid out in lieu of the same they therefore deem it expedient to convey the said original road allowance to Samuel Harris on whose land the new road runs in lieu of the new or travelled road and for which no compensation has been paid to the said Samuel Harris for the land appropriated as a travelled ro ad ~ AND ~mEREAS notices as required by law have been given of the intention to make an application for this By-law to convey the said original road allowance to the said Sa.muel Harris by being posted in the immediate neighbourhood and in- serted in the Saint Thomas Home Journal. BE IT THEREFORE enacted by the Municipal Council of the Township of Dunwich by virtue and under authority of the 33rd section of the Municipal Institutions Act Chapter 54 of the Consolidated Statutes of Upper Canada that the road applied for and reported by Wm. G. M. George, Esquire, Provincial Land Surveyor between the south halves of lots six and seven in the Sixth Concession in the said Township of Dunwich be and the same is hereby established as in said report as follows by com- mencing at the southerly angle of said lot number seven thence southwesterly along the southwesterly limit of said lot number seven to the middle of said limit thence southwesterly across said road to the middle of the nor'.thca.sterly limit of said lot number·.six thence southeasterly along said northeasterly limit to the Concession Road in rear thence along the northwesterly side of said Concession Road to the place of begDrnning. (Cont'd) By-Law No. 221 Page 3 And it is also enacted under authority and by virtue of the 332nd section of the Municipal Institutions Act 22nd Victoria Chapter 54 of the Consolidated Statutes of Upper Can- ada that the Council of the Municipality of the said Township of Dunwich to convey the original road allowance in fee simple to Samuel Harris whose land is joining said road allowance in lieu of new travelled road laid out through his lands and the Reeve of the Municipality of the said Township of Dunwich is hereby authorized on behalf of the Council of the said Municip- ality of the said Township to execute a deed for the said road allowance as described above to the said Samuel Harris. And it is also enacted that the Reeve of the said Township of Dunwich is hereby authorized to attach the Seal of the Corporation to the said conveyance for said original road allowance as mentioned in this By-law. Passed in Council this eighth day of January 1872. And it is also enacted that this By-law shall be in force and take effect from and after the date and passing there- of. Barclay Municipal Clerk Cont'd) 4 221 By-Law No Page TOWNSHIP OF DUNWICH 202 By-Law No TO CONVEY TO CHARLES HUMPHREY THE ORIGINAL ROAD ALLOWANGE IN THE BETWEEN THE NORTH HALVES OF LOTS NUMBER SIX AND SEVEN SIXTH CONCESSION OF THE TOWNSHIP OF DUNWICH.IN 1£EU OF THE NOW TRAVELLED THROUGH THE NORTH HALF OF LOT NUMBER SIX ROAD IN THE SIXTH CONCESSION OF SAID TOWNSHIP AND TO AUTHORIZE THE HUMPHREY' WHEREAS application has been made to the Municipal Council of the Township of Dunwich by Charles Humphrey that the Coyne Road runs through his land and he has received no compensation for the same. CONVEYANCE OF THE ORIGINAL ROAD ALLOWANCE TO CHARLES AND WHEREAS Wm. G. M. George, Esquire, Provincial Land Surveyor has reported to the Council of the Municipality of the said Township of Dunwich of the survey of the original road allowance It is in the opinion of this Council of the said Township of Dunwich useless to the public on account of an- other road laid out in 1 ieu of the same they therefore deem it expedient to convey the said original road allowance to Charles Humphrey on whose land the new road runs in lieu of the said new or travelled road and for which no compensation has been paid to the said Charles Humphrey for the land approp- riated as a travelled road. AND WHEREAS notices as required by law have been given of the intention to make application for this By-law to convey the said original road to the said Charles Humphrey by being posted in the immediate neighbourhood and inserted in the St Thomas Home Journal. BE IT THEREFORE enacted by the Council of the Town- ship of Dunwich by virtue and under authority of the 331st section of the Municipal Institutions Act Chapter 54 of the Consolidated Statutes of Upper Canada that the road applied for and reported by Wm. G. M. George Esquire, Provincial Land Sur- veyor between the north halves of lots number six and seven in the sixth Concession in the said Township of Dunwich be and the same is hereby established as in said report as follows by be- gining at the post in the westerly angle of lot number seven in the Sixth Concession thence southeasterly along the south- westerly limit of said lot number seven to the middle of said limit thence southwesterly across said road to the northeasterly limit of lot number six thence northwesterly along said north- easterly limit to the Concession Road in front thence northeast- erly along said Concession Road to the place of beginning. And it is also enacted that the Reeve of the said Township of Dunwich is hereby authorized to attach the Seal of the Corporation to the said conveyance for said original road allowance as mentioned in this By-law.
