234B COUNTY OF ELGIN By-:-Law No. 234B "TO APPOINT A SPECIAL COMMITTEE FOR THE PURPOSE OF MAKING ALTERATIONS IN THE GAOL AND GAOL YARD OF THE COUNTY OF ELGIN AND THE ERECTING OF A REGISTRY OFFICE FOR SAID COUNTY" . Passed JOth January 1873. WHEREAS the County Council of the County of Elgin having been required by the Inspector of Prisons to make certain alterations in the jail premises of said county, and the works being now under contract and in'course of construction, it is deemed necessary to appoint a committee to carryon said works and attend to the completion as may be required by the Inspector of Prisons. BE IT THEREFORE enacted by the Corporation of the County of Elgin1n council assembled. That Samuel Shepard, Joseph Marlatt and Thomas M. Nairn be and hereby appointed a Special Committee to enter into agreements and make contracts for the completion of the alterations required to be made in the jail premises and as required by the Inspector of Prisons and also to pro~ure such iron work as may be necessary and make alterations in the plans and specifications if expedient and also to cover the roof of prison and Gaoler's house with slate or other suitable material. And that the Warden or Chairman of said committee be and is hereby authorized and required to execute contracts or agreements for said works and material on behalf of this Council and said committee and attach the Corporate Seal thereto which contracts shall be as binding on the part of the County as if executed in öpen Council. And that the County Treasurer is hereby author- ized and required to pay to the contractor or contractors for said works on the order of the Chairman of said committee such sums of money as may be certifed by the Architect or person in charge of said works, that work has been performed or material delivered, retaining fifteen per cent of the full value of the original contract for said works until the final completion and approval of the work performed under such contracts. (Cont'd) 234B By-Law No Page 2 AND IT IS ALSO enacted that said committee are hereby authorized to order the payment of all works and material required whether included in the original contract or otherwise, and to employ the Architect or such other person as they may consider necessary and requisite to superintend the operations and order payment for such service as they may consider just and reasonable. . AND WHEREAS it is deemed necessary in order to comply with the requirements of the Registry Act and erect a fire-proof Registry Office upon a plan and on a site ap- proved of by His Excellency the Lieutenant Governor in Còun- cil. BE IT THEREFORE enacted by the Corporation of the County of Elgin that T. M. Nairn, Joseph Marlatt and Samuel Shepard be a committee to receive tenders and make agree- ments or contracts for the erection of a Registry Office in the court house yard upon a plan and on a site :..selected by the County Council and approved or that may be approved by His Excellency the Governor in Council. AND THAT the Warden of the county isiherêby auth- orized and required to execute contracts for said work as may be approved of by said committee and attach the Corporate Seal of the county thereto.
