253 COUNTY OF ELGIN 253 By-Law No :rº--INCºRPORß:r~2'.HE_n1LAG~_ºE_PORL ST AN1&L1Ji :r!:i~_Qº1!!'l:rLOF¿LGI~ Council 1:7 June 1874 WHEREAS by the eighth section of the Municipal Institutions Act 36th Victoria Chapter 48 of the Province of Ontario it is enacted as follows: Passed in When the census returns of an unincorporated Village with its immediate neighbourhood taken under the direction of the Council of the County in which the Village and its neighbourhood are situate show that the same contain over Seven hundred and Fifty in- habitants and when the residences of such inhabitants are sUfficiently near to form an incorporated Village, then a petition by not less than One hundred resident free- holders and householders of the Village and neighbourhoo~i of whom not fewer than one half shall be freeholders, the Councilor Councils of the County or Counties in which the Village and neighbourhood are situate shall by By-Law erect the Village and neighbourhood into an Incorporated Village apart from the Township or Townships in which the same are situate by a name and with boundaries to be respectively declared in the By-Law and shall name in the By-Law the place for holding the first election and the Returning Officer who is to hold the same,provided always that no Town or Village incorporated after the passing of said Act the population of which does not exceed One Thousand souls shall extend over or occupy within the limits of the incorporation an area of more than Five hundred acres of land AND WHEREAS the census of the Unincorporated Village of Port Stanley in the County of Elgin with its immediate neighbourhood has been taken under the direction of the Council of the County of Elgin and the returns thereof show that the said Village and its neighbourhood contain over Seven hundred and Fifty inhabitants whose residences (Cont'd) Page 2 are sufficiently near to form an Incorporated Village and comprised within an area of not more than five hundred acres. 253 By-Law No AND WHEREAS more than one hundred resident freeholders and householders of the same village and neighbourhood of whom not fewer than one half are freeholders have presented their petition to the said County Council praying that the said village and neighbourhood may be erected into an Incorporated Village apart from the Townships of 'Yarmouth and Southwold by the name of "Village of Port Stanley", and with:,.' the boundarie s herein after declared comprising within an area of not more than five hundred acres. AND WHEREAS the Council of the County of Elgin deems it expedient to grant the prayer of the said petition BE IT THEREFORE enacted by the Council of the Corporation of the County of Elgin under and by virtue of the authority aforesaid. That the Unincorporated Village of Port Stanley and its said neighbourhood be and is hereby erected into an Incorporated Village apart from the Townships of Yarmouth and Southwold in which said village is situate under the name of the "Villgge of Port Stanley", and with the boundaries or limits hereinafter declared and set forth to be a body corporate having all the powers and privileges of a separate Municipality. That the said village hereby incorporated shall pomprise: Commencing at the north east angle of/lòt number one in the first concession of the Township of Yarmouth and at the·· southerly limit of road allowance between fi~st and second concessions or Hill Street THENCE westerly òn the southerly limit of Hill Street, thirty-nine chains more or less to the intersection of the west limit of London and Port Stanley GravèlRoad or Oolborne Street with the southerly limit of Elgin Street on lot number sixteen in the second concession north of Lake Road, Township of Southwold. ) (Cont'd Page 3 THENCE north sixty-eight degrees west two cha:i.ns more or less to the centre of Kettle Creek 253 By-Law No THENCE westerly following the windings of said creek to where the easterly limit of a road on lot number fifteen in said second concession north of Lake Road, and known as Mill Street, intersects the westerly limit of Kettle Creek. THENCE south thirty-five degrees west on the easterly limit of Mill Street three chains, twenty-six links more or less to an angle in said road or street. THENCE south eight degrees east on the easterly limit of a laid out road on lot lettered D, or continuation of Mill Street. Thirty-eight chains more or less to the southerly limit-õf Lake Road THENCE westerly on the southerly limit of Old Lake Road, sixteen chains more or less to the centre of lot No. 15 south of Old Lake Road. THENCE southerly parallel to the west limit of said lot number fifteen, eighteen chains more or less to the southerly limit of the present travelled Lake Road or less THENCE westerly on the southerly limit of present. travelled Lake Road forty-six chains more to the westerly limit of lot. number fourteen southerly on the westerly limit of lot seven chains to Lake Erie THENCE number fourteen, THENCE easterly along the shores of Lake Erie to the easterly limit ofilot number one in the first concession of the said Township of Yarmouth. THENCE northerly on the easterly limit of said lot number one, sixty-six chains more or less to the place of beginning. AND IT IS ALSO enacted that the first election of Reeve and Councillors for the Municipality hereby erected shall be held at the Union School House in Port Stanley in the said Village of Port Stanley on the first (Cont'd) By-Law No. 253 Page 4 Monday in January, one thousand eight hundred and seventy-five, being the first Monday in January next, after the end of three months after the passing of the By-Law. And that Joseph R. Bostwick of Port Stanley shall be Returning Officer to hold the first election for the said Village of Port Stanley. And that until the Council for the said Village of Port Stanley be organized, the Councils of the said Townships of Yarmouth and Southwold shall continue to have the same powers in the said village as heretofore, and all other officers and servants of the said townships shall nntil dismissed or until successors are appointed continue in their respective offices until such organization with the same powers, duties and liabilities as heretofore And that this By-Law shall take effect from and after the date of the passing thereof. The following lands and the boundaries or limits hereinafter declared of the said Village of Port Stanley shall be determined thereby, that is to say: Lot number fourteen south of present travelled Lake Road, Township of Southwold. Part of lot number fifteen south of Old Lake Road in said Township of Southwold. Lot number six.teen south of Old Lake Road. Lot number six.teen in first range north of Lake Road in said Township of Southwold. Part of lots numbers fifteen and sixteen in second range north of Lake Road and Part of lot lettered "D", Township of Southwold and Lot number one in the first concession of the Township of Yarmouth. And more particularly described as follows.
