305 COUNTY OF ELGIN By-Law No. J05 TO CONFIRM BY-LAW NUMBER 249 OF THE TOWNSHIP OF SOUTHWOLD TO STOP UP THE ORIGINAL ALLOWANCE FOR ROAD BETWEEN THE BROKEN FRONT AND THE FIRST CONCESSION OF SAID TOWNSHIP." Passed 6 June 1878. BE IT THEREFORE enacted by the Corporation of the County of Elgin under authority of the Muncipal Institutions Act. That By-Law Number 249 of the Township of Southwold passed on the 5th day of November 1877 to stop up and sell the original road allowance between the broken front and the first concession of the Township of Southwold from the middle of lot thirteen easterly to the River Thames and for the opening up of a new road through lot number seven east of the Routh Road to the River Thames in said Township of Southwold be and the same is hereby confirmed. SEVEN EAST OF THE ROUTH ROAD TO THE RIVER THAMES IN THE SAME TOWNSHIP." Passed 5th November A. D. 1877 WHEREAS it is enacted by Section four hundred and twenty-five subsection one of the Statutes of Ontario Chapter forty-eight, passed in the thirty-sixth year of Her Majesty's Reign entitled "An act respecting Munici- pal Institutions in the Province of Ontario" as follows - "425 - The Council of every County, Township, City, Town and Incorporated Village may pass By-Laws". (1) "For opening, making, preserving, improving, repairing, altering, diverting or stopping up roads, streets squares, alleys, lanes, bridges or other public communica- tions within the jurisdiction of the Council, and for enter- ing upon, breaking up, taking or using any land in any way necessary or convenient for the said purposes, subject to the restrictions in this Act contained; and for preventing and removing any obstruction upon any roads or bridges with- in its' jurisdiction" AND WHEREAS application has been made to the Council of the Township of Southwold to close up and sell the above described original road allowance, and to open up the above described new road. AND WHEREAS all the requirements of section four hundred and twenty-four and the subsection thereto of the above in past recited Act have been fully complied with. AND WHEREAS it hath been made to appear by the written report of James A. Bell, Esquire, Provincial Land Surveyor (which said report is hereto annexed) that the said original road allowance is crossed by a large gully and that it would not be advisable to open it up, and that (Cont'd) Page 3 ]05 By-Law No TOWNSHIP OF SOUTHWOLD 249 By-Law No good with very little expense AND WHEREAS the said Council have resolved to grant the application to close the said original road allowance and open up the said new road the said new road could be made BE IT THEREFORE enacted by the Council of the Cor- poration of the Township of Southwold that the original road allowance between the broken front and first concession of the Township of Southwold from the middle of lot number thirteen easterly to the River Thames, more particularly described as follows: Commencing at a point in the south easterly limit of the road allowance in front of the first concession, seventy- five links north easterly from the centre of lot number thir- teen; thence north forty-five degrees east twenty-three chains and fifty links more or less to the River Thames and having a width on the north east side of this line of one chain be, and the said road is hereby closed up and abolished; And also that the new road through lot number seven east of the Routh Road more particularly described as follows Commencing at a point where a post has been planted in the north westerly limit of the allowance for road between the first concession and the broken front on River Thames, and opposite a post planted in the centre of lot number thirteen in the first concession; thence north forty-five degrees west (parallel to the western boundary of the Township) into lot no. seven east Routh Road sixteen chains and seventeen links; thence north twenty-six degrees and thirteen minutes west, ten chains more or less to the River Thames, and having a width on the westerly side of this line of three rods be, and the said road is hereby opened as one of the roads of this Municipality sale and purchase of the above The conditions of the mentioned roads are as follows: The Council of Southwold agrees to pay Mr. White the sum of one hundred dollars and deed him the old original road allowance on the first concession from the middle of lot no. 13 to the River Thames north easterly. St. To the Municipal Council of the Township Gentlemen I beg to report that I have made a survey for a road from the first concession of Southwold through lot no. 7 east of Routh Road to the River Thames. I find no diffi- culty in the way of making this a good road, with very little expense. I have also examined the original road allowance between the first concession and the broken lots on the river, from the middle of lot no. I) easterly to the said river and am of opinion that it would not be ad- visable for your honourable body to open it, there being a very large gully to cross, it could only be done at very considerable cost. The following is a description of the proposed new road according to my survey. Com- mencing at a point where a post has been planted in the north westerly limit of the allowance for road between the first concession and the broken lots on River Thames, and opposite a post planted in the centre of lot no. 13 in the first concession: thence north, forty-five degrees west, (parallel to the western boundary of the Township) into lot number seven east Routh Road, thirteen chains and seventeen links: thence north twenty-six degrees and thirteen minutes west, ten chains more or less to the River Thames and having a width on the westerly side of this line of three rods and containing by admeasurement one acre and three quarters (1 3/4) be the same more or less. The following is a description of the road pro- posed to be sold. Commencing at a point in the south easterly limit of the road allowance in front of the first concession seventy-five links north easterly from the centre of lot no. I): thence north forty-five degrees west, one chain to the north westerly limit of the said road allowance; thence north forty-five degrees east along said north westerly limit twenty-three chains more or less to the River Thames: thence easterly along the river one chain more or less to the south easterly limit of the said road allowance; thence south forty-five de- grees west along said south easterly limit twenty-three chains fifty links more or less to the place of beginning containin& by admeasurement two acres and one third of an acre (2 1/) acres) be the same more or less. submi tted Bell S James A.
