345 COUNTY OF ELGIN By-Law No. 345 "TO CONFIRM BY-LAW NUMBER 282 OF THE TOWNSHIP OF DUNWICH Passed 9 June 1881. \i\JHEREAS By-Law Number 282 was passed by the Council of the Township of Dunwich on the nineteenth day of Nov- ember A.D. 1880, to stop up and dispose of that part of the original allowance for road. between the eleventh and twelfth concessions of the Township of Dunwich opposite lot number twenty-one and the westerly part of lot number twenty-two, in the said eleventh and twelfth concessions. BE IT THEREFORE enacted by the Corporation of the County of Elgin in County Council Assembled that By-Law Number 282 of the Township of Dunwich be and the same is hereby con- firmed. St. Thomas M. WHEREAS application has been made to the Municipal Council of the Township of Dunwich in the County of Elgin for the p~ssing of a By-Law for the closing up and sale of that part of the original allowance for road between the eleventh and twelfth concessions of the Township of Dunwich opposite lot number twenty-one and the westerly part of lot number twenty-two in the said eleventh and twelfth concessions. AND WHEREAS the same is useless to the public and is desirable that the same should be closed up and sold. AND WHEREAS due notice has been given by the clerk of the said Township of Dunwich of the application for said By-Law in accordance with the/first;·arld'>second"silbseètii.ons of the five hundred and sixth section of chapter one hundred and seventy-four of the Revised Statutes of the Province of Ontario. AND WHEREAS Peter Sutherland of the Township of Southwold in the County of Elgin, Yeoman is the owner of the land adjoining on one side of that.>paXt»(jf;..j;heootiginàl allowance for road lying opposite the westerly portion of lot number twenty-one in the said twelfth concession and William Bobier of the said Township of Dunwich, Yeoman is the owner of the land on one side of that part of the original allowance for road lying opposite the westerly part of lot number twenty-one in the said eleventh concession and on both sides of that portion of the original allowance lying opposite the easterly part of lot number twenty-one in the said twelfth concession commencing one chain west of the top of a hill of a deep ravine and on both sides that part of original allowance lying opposite the westerly part of lot number twenty-two in the said eleventh and twelfth concessions (Cont'd) 3 Page 345 282 - Tbwnship of Dunwich By-Law No. By-Law No. AND WHEREAS the said Peter Sutherland and William Bobier have made application to the said council to become the purchasers of said original allowance for road adjoin- ing their respective lands AND WHEREAS the said Council of the Corporation of the Township of Dunwiéh have for the considerations in this By-Law appearing determined to close up the said orig- inal allowance and to sell the same to the said Peter Suther- land and William Bobier, in accordance with their respective applications aforesaid. AND WHEREAS it has been agreed between the said Peter Sutherland and William Bobier and the said Council of the Corporation of the Township of Dunwich that so soon as this present By-Law shall have been confirmed by the Munici- pal Council of the County of Elgin, the Corporation of the Township of Dunwich and the Council thereof shall convey to the said Peter Sutherland and William Bobier, the said orig- inal allowance for road and the said Peter Sutherland and William Bobier shall as the equivalent and price of the said original allowance for road pay to the Council of the Cor- poration of the Township of Dunwich the sum of forty-two dollars in the following proportion the said Peter Sutherland to pay the sum of twenty-seven dollars and the said William Bobier to pay the sum of fifteen dollars. BE IT THEREFORE enacted by the Municipal Council of the Township of Dunwich that the original allowance for road in the preamble hereto described shall fromheneeförth cease to be a public highway and shall be and the same is hereby forever closed. AND BE IT FURTHER enacted by the said the Council of the Township of Dunwich that the said original allowance for road so closed as aforesaid shall be and the same is here- by sold to the said Peter Sutherland and William Bobier. AND THAT so soon after the confirmation of this By- Law by the said County Council of the County of Elgin as the said Peter Sutherland and William Bobier shall payor cause to be paid to the said the Council of the Corporation of the Township of Dunwich the said sum of forty-two dollars, the daid the Corporation of the Township of Dunwich and the Coun- cil thereof shall at the request and expense of the said Peter Sutherland and William Bobier, their heirs or assigns by a proper and sufficient conveyance, convey the said original (Cont'd) By-Law No. .345 Page 4 By-Law No. 282 Township of Dunwich allowance to the said Peter Sutherland and William Bobier, their heirs or assigns and the Reeve of the said Corporation is hereby authorized to affix the corporate seal of the said Corporation to such conveyance.
