~.TO APPOINT AN
1887
WHEREAS By-Law No. 174 of the County Council of
the County of Elgin was passed to establish a new road in
lieu of part of the County Line between the Townships of
Bayham and Middleton.

AND WHEREAS By-Law No. 409 was passed on the 5th
day of June 1885 to amend By-Law No. 174 by opening up a
new road leading to said County Line on lot number 21 in the
eleventh concession of the saidi'Township of Bayham and to
relinquish all jurisdiction over a portion of the road
established by said By-Law No. 174 now used insteadcof said
County Line.
AND WHEREAS the County of Norfolk was notified
on 6th June 1885 that the County of Elgin had passed By-Law
No 409
AND WHEREAS the County Council of the County of
Norfolk has omitted to pass a By-Law in similar terms and
whereas under Section 540 of the Consolidated Municipal Act
when the Council for six months after notice of the By-Law,
omit to pass a By-Law in similar terms the duty and liabili-
ties of each municipality in r~spect to the road or bridge
shall be referred to arbitration under the provisions of
this Act
AND WHEREAS under Section 387 of the said Act,
the appointment of arbitration for a corporation shall be
under the corporate seal and authenticated in like manner as
a By-Law
AND WHEREAS this Council has deemed it expedient
to appoint an arbitrator to decide the duty and liabilities
of each municipality in respect to the roads and bridges in-
cluded in By-Law No. 409
BE IT THEREFORE enacted by the County Council of
the County of Elgin -
That Archibald W. Campbell of the City of St.
Thomas, civil engineer be and is hereby appointed an arbitra-
tor on behalf of the County of Elgin to decide the duty and
liability of the Counties of Elgin and Norfolk in respect to
the roads and bridges mentioned in By-Law No. 409 and as pro-
vided for in Section 540 Consolidated Municipal Act 1883
