544 COUNTY OF ELGIN By-Law No. 544 TO LICENSE.... REGULATE AND GOVERN HAWKERLPE~~Y CHA!:MEN AND QTHER§". Passed 13th November 1895 The Municipal Council of the County of Elgin enacts as follows:- I From and after the passing of this By-Law it shall not be lawful for any Hawker or Petty Chapman and other persons carrying on petty trades or who go from place to place, or to other mens houses on foot or with any animal bearing or drawing any goods, wares or merchandise for sale or in or with any boat, vessel or other craft or otherwise carrying goods, ware s , or merchandise for sale to carryon any of the said trades, occupations, callings or business within any part of the County of Elgin unless and until he shall have procured a license as hereinafter provided and any person so licensed shall be subject to the provisions of this By-Law. Provided always that no such license shall be required for hawking, peddling or selling from any vehicle or other conveyance any goods, wares or merchandise to any retail dealer, or for hawking or peddling any goods, wares or merchandise the_growth, produce or manufacture of this Province not being liquors with the meaning of the law relating to taverns or tavern licenses if the same are being hawked or peddled by the manufacturer or producer of such goods, wares, or merchandise or by his bona fide. Servants or employees having written authority in that behalf and such servant or employee shall produce and exhibit his written authority when required so to do by any Municipal or Peace Officer. 2 The word "Hawkers", in this sub section shall include all persons who, being agents for persons not resident within the County, sell or offer for sale, tea, dry-goods, watches, plated ware, silver (Cont'd) · · · · · · · · · · · · · · (Cont'd ) · · 5 Any person contravening any of the provisions of this By-Law shall for such offence, on conviction before one or more Justices of the Peace for the County of Elgin forfeit and pay a fine of not less than twenty dollars and not more than fifty dollars, in the discretion of the Justice or Justices, together with the costs, and if not paid forthwith the same shall be levied by distress and sale of the goods and chattels of the offender, and in case of there being no distress, · Each Hawker, Petty Chapman or other person aforesaid carrying on any such trade, occupation calling or business within the said County of Elgin for which a license is required under this By-Law shall upon demand by such Municipal or Peace Officer forthwith exhibit his license to such Officer 4 Each license shall be in force for one the date of issue and no longer · year from To sailor travel with any craft, seventy-five dollars · boat To travel with one horse or other animal thirty dollars, and for every additional horse or other animal ten dollars vessel or other · 3 To travel on foot the sum of ten dollars The Clerk of this Council for the time being is hereby authorized to issue licenses under this By-Law with the Corporate Seal of the Council attached hereto and deliver the same to persons applying therefor upon payment of the following fee · ware, jewellery or carry and expose samples or patterns of any of such goods to be afterwards delivered within the County to any person not being a wholesale or retail dealer in such goods, wares or merchandise · 2.
