Passed 13th November 1895 WHEREAS by section 495, sub section 2 of "The Consolidated Municipal Act", i tis enacted. That the Council of any county, city and town separated from the County for Municipal purposes may pass By-Laws for licensing, regulating and governing auctioneers, and other persons selling or putting up for sale goods. wares, merchandise or effects, by public auction. And for fixing the sum to be paid for every license and the time is shall be in force. 1 The County Council of the County of Elgin therefore enacts. That from and after the passing of this By-Law it shall not be lawful for any auctioneer or other person to sell or put up for sale in the said County of Elgin any goods, wares, merchandise or effects by public auction without having first obtained a license to be issued in the manner hereinafter provided. 2 That the Clerk of the said Council is hereby authorized to issue such license to applicants under the seal of the County Council of the County of Elgin upon payment of the sum of twelve dollars, and every such license shall be in force for one year from date of issue. 3 That no auctioneers license shall be transferable nor shall any person except the person named in the license sell or put up for sale any goods, wares, merchandise or effects by public auction thereunder. That any person violating the provisions of this By-Law shall on conviction thereof be liable to a penalty not exceeding twenty dollars nor less than twelve dollars and costs, which fine and costs if not paid forthwith shall be levied by distress and sale of goods and chattels of the offender, and in case of non payment or no distress to be found of which such fines can be levied, the person or persons so offending may be imprisoned with or without hard labor for any period not exceeding twenty-one days, pursuant to the provisions of said Act.
