The Clerk of this Council for the time being is hereby authorized to issue licenses under this By-Law with the Corporate Seal of the Council attached thereto, and deliver the same to persons applying therefore upon payment of the following fee: · · 2. The word "hawkers" in this sub-section shall include all person who being agents for persons not resi- dent within the County sell or offer for sale, tea, dry goods, watches, plated ware, silverware, furniture, carpets upholstery, millinery or jewellery, or carry and expose samples or patterns of any of such goods to be afterwards delivered within the County to any person not being a whole- sale or retail dealer in such goods, wares or merchandise · · Provided always that no such license shall be required for hawking, peddling or selling from any vehicle or other conveyance, any goods, wares or merchandise to any retail dealer or for hawking or peddling any goods, wares or merchandise the growth, produce or manufacture of this Province, not being liquors, within the meaning of the law relating to taverns or tavern licenses, if the same are being hawked or peddled by the manufacturer or producer of such goods, wares or merchandise or by his bona fide ser- vants or employees, having written authority in that be- half, and such servant or employee shall produce and ex- hibit his written authority when required so to do by any Municipal or Peace Officer · · 1. From and after the passing of this By-Law it shall not be lawful for any hawker, pedlar or petty chapman and other persons carrying on petty trades, or who go from place to place or to other men's houses on foot, or with any animal bearing, or drawing any goods, wares or merchandise for sale, or in or with any boat, vessel or other craft, or otherwise carrying goods, wares or merchandise for sale to carryon any of the said trades occupations, callings or business within any part of the County of Elgin, unless and until he shall have procured a license as hereinafter provided and any person so licensed shall be subject to the provisions of this By-Law · enacts The Municipal Council of the County of Elgin as follows: - · Passed November 20th 1896. t ----.- AND OTHERS TO LICENSE " REGULATE AND GOVERN By-Law No COUNTY OF ELGIN 561 HAWKERS PETTY CHAPMEN Received and read a first, passed November 20th 1896. Any person contravening any of the provisions of this By-Law shall for such offence, on conviction before one or more Justices of the Peace for the County of Elgin forfeit any pay a fine of not less than ten dollars and not more than fifty dollars, in the discretion of the Justice or Justices together with the costs, and if not paid forthwith the same shall be levied by distress and sale of the goods and chattels of the offender and in case of there being no distress out of which the penalty can be levied, the Justice may commit the offender to the common jail of the said County of Elgin for any time not exceeding twenty-one days, unless such fine and costs, including the costs of the com- mittal, shall be sooner paid.
