699 COUNTY OF EIGIN By-Law No. 699 TO CONFIRM BY-LAW NO. 661 OF THE TOWNSHIP OF DUNWICH Passed June 9th 1906 WHEREAS the Municipal Council of the Township of Dunwich on the 15th December 1905, passed a By-Law for closing up and selling a road, on Part Lot 9, in concession 10, Dunwich. AND WHEREAS they have made application to have same confirmed by this Council, as provided in the Munici- pal Act. McKay County Clerk NOTE Attached is a copy of Township of Dunwich By-Law No 661 (Cont'd) By-Law 699 Page 2 TOWNSHIP OF DUNWICH By-Law No. 661 ItFOR CLOSING UP AND SELLING TO WILLIAM CHURCH A CERTAIN ROAD OR HIGHWAY THROUGH PART OF LOT NUMBER NINE (9) IN THE TENTH CONCESSION OF THE TOWNSHIP OF DUNWICH IN THE COUNTY OF EWIN". WHEREAS representations have been made that in the public interest it is no longer desirable to keep open and maintain a certain public road or highway through part øflot number hine (9) in the tenth concession of the Township of Dunwich. AND WHEREAS the owner of the portion of said lot number nine (9) through which said highway runs has requested that the same be closed up, and has offered to purchase the same at the sum of $40.00 which said sum the Council deem a fair and adequate price. AND WHEREAS public notice of intention by the Municipal Council of the Township of Dunwich to pass a By-Law for closing up and selling said public road or high- way aforesaid has been duly given as provided in the Con- solidated Municipal Act 190). AND WHEREAS notice of such intended By-Law has also been duly published in the "Advance" newspaper, being a newspaper published in the Municipal Corporation of the Village of Dutton there being no newspaper published in the Township of Dunwich. AND WHEREAS the Council deem it expedient to pass a By-Law for the purpose of closing up and selling public road or highway as hereinafter particularly defined. The Municipal Council of the Corporation of the Township of Dunwich therefore enacts as follows:- (1) That a certain public road or highway of part of ¡ot humber. nine (9) in the tenth concession of the Township of Dunwich in the County of Elgin described as follows, viz Commencing at a point on the southerly limit of the Talbot Road where said limit intersects the easterly limit (Cont'd) By-Law 699 Page 3 By-Law 661 (Township of Dunwich) of the road or highway running in a southerly and southwest- erly direction through said lot nine (9) to Lake Erie. Thence in a southerly and southwesterly direction along said easterly and southeasterly limit of said road ~eading through part of said lot to the westerly limit of $aid lot number (9). Thence northwesterly along said westerly limit of lot nine (9) three rods· more or less to the northerly limit of said road leading through part of said lot. Thence northeasterly and northerly along said northerly and westerly limit of said last mentioned road to the southerly limit of the Talbot Road. Thence easterly along the southerly limit of the Talbot Road, three rods more or less to the place of be- ginning, be closed and stopped up and cease, On from, and after the day of the final passing of this By-Law to be a public road or highway of the Township of Dunwich. (2) That said road as particularly described in the next preceding paragraph be sold and conveyed to William Church for the price or sum of $40.00 and that the Reeve and Clerk be and are hereby authorized and empowered to execute a proper and sufficient conveyance of said lands as hereinbefore described to the said William Church for the consideration hereinbefore mentioned; and to affix the Corporate Seal to such conveyance.
