708 / COUNTY OF ELGIN By-Law No. 708 "TO CONFIRM BY-LAW NO. 667 OF THE TOWNSHIP OF DUNWICH Passed 30th November 1906. WHEREAS the Municipal Council of the Township of Dunwich, on the 7th May 1906, passed a By-Law £or closing up and selling a certain road or highway through parts of lots number 7 in the eighth concession and lots numbers 7 and 8 in the ninth concession of the said Township of Dunwich. AND WHEREAS they have made application to have the same confirmed by this oouncil as provided in the Munic- ipal Act. OR HIGHWAY THROUGH PARTS OF LOTS GEORGE JEWELL AND WALLACE MORRISH SEVEN NUMBER A_CERTAIN ROAD TOWNSHIP OF DUNWICHJ,-AND EIGHTH CONCESSION OF THE IN THE NINTH CONCESSION OF THE_~~ID LOTS SEVEN AND EIGHT (8) IN_THE COUNTY OF ELGIN WHEREAS representation has been made that in the public interest it is no longer desirable to keep open and maintain a certain public road or highway through part of lot number seven in the eighth concession of the Township of Dunwich and lots numbers seven and eight in the ninth concession of the said Township of Dunwich, in the County of Elgin IN THE TOWNSHIP OF DUNWICH AND WHEREAS the respective owners of the portions of said lot seven (7) in the eighth concession aforesaid and lots seven and eight in the ninth concession of the afore- said Township through which said highway is laid out haG requested that the same be closed up and have offered to purchase the same at the sum of two hundred ($200) dollars which said sum the Council of the Township of Dunwich døem a fair and adequate price. AND WHEREAS public notice of intention by the Munic- ipal Council of the Township of Dunwich to pass a By-Law for the closing up and selling said public road or highway aforesaid has been duly given as directed in the Consolidated Municipal Act 190) AND WHEREAS notice of such intended By-Law has also been published in the "Advance" newspaper being a newspaper published in the Village of Dutton there being no newspaper published in the Township of Dunwich AND WHEREAS the Council deem it expedient to pass a By-Law for the purpose of closing up and selling of said public road or highway as hereinafter particularly described AND WHEREAS the said road or highway is wholly within the limits of the Township of Dunwich and the said road or highway was not laid out according to any Crown Plan or Survey (Cont'd) 4 Page Township of Dunwich 708 667 By-Law No By-Law No The NIunicip;:tl Council of the Corporation of thl9 Township of Dunwich as follows (1) That a certain public road or highway as now laid out and heretofore used through parts of said lot numbered seven (7) in the eighth concession of the Townl3hip of Dunwich and lots seven (7) and eight (8) in the ninth concession of the Township of Dunwich, in the County of Elgin and extending from the point of intersection therl90f with what is commonly called and known as the Coyne Road between lots six and seven in the eighth concession of the Township of DunwQch. enacts THEREFORE THENCE in an easterly and south easterly direction through parts of said lot seven in the eighth concession and lots seven and eight in the ninth concession to the northerly boundary of the road allowance between the ninth and tenth concession of the said Township of Dunwich be closed, stopped up and cease on, from ànd after the day of the final passing of this By-Law to be a pUblic road or highway of the Township of Dunwich. (2) That the said road as it is laid out and :z located through the southerly half of the northerly half of lot seven (7) in the eighth concession in the Township of Dunwich, be sold and conveyed to William Braddoh, the owner of the said last mentioned lands for the price or sum of five dollars, and that said road as laid out through the southerly half of said lot number aeven (7) in the eighth concession and through the north west four and three quarters acres of the south east quarter of lot number seven in the ninth concession, be sold and conveyed to William Morrish, ~he owner of said låst mentioned lands for the price or sum of seventy-five dollars, and that the said road as laid out through the north half of lot numger seven:dn the ninth concession aforesaid, be sold and conveyed to Wallace Manning the owner of said last mentioned lands, for the price or sum of seventy dollars, and that the said road as laid out through the south half of lot number eight in the ninth concession, be sold and conveyed to George Jewell and Charles Jewell, the owners of the last mentioned lands, for the price or sum of fifty-five dollars.
