797 COUNTY OF ELGIN By-Law No. 797 "TO CONFIRM BY-LAW NO. 866 OF THE TOWNSHIP OF MALAHIDE Passed 16th ãune, 1911. WHEREAS By-Law Number 866 of the Township of Malahide closing and stopping up that part of the Highway running over and across the south half of lot no. 11, 12, 13, 14 and 15 in the first concession of the said Township of Malahide, was passed in Council on the sixth day of February 1911. AND WHEREAS it is desirable that said By-Law should be confirmed by this Council, The Elgin County Council therefore enact that By- Law Number 866 of the Township of Malahide be and is hereby confirmed. OF THE SAID TOWNSHIP OF MALAHIDE". WHEREAS printed notices of the intended By-Law have been posted up for one month and upwards in six of the most conspicuous places in the immediate neighborhood of the said Highway, and published weekly for four weeks in the Aylmer Sun, a newspaper published in the Town of Aylmer, situated within the said Township. AND WHEREAS owing to the drifting sand the continual breaking away of the Lake Bank forming ravines and gullies adjacent to and extending across the said Highway, rendering it dangerous for public use, it is deemed expedient to for- ever close and stop up the said Highway. BE IT THEREFORE enacted by the Municipal Council of the Corporation of the Township of Malahide as follows: 1. That from and after the passing of this By-Law (and the confirmation thereof by the Council hereinafter mentioned) all that part of the Highway running over and across the south half of lot number eleven, twelve, thirteen fourteen and fifteen, in the first concession of the said Township of Malahide, shall be stopped up and forever closed and the said part shall cease to be a Highway, and the said part of the said Highway shall be disposed of, sold and con- veyed as hereinafter provided. 2. From and imm~diately after the confirmation of this By-Law by the County Council of the Gounty of Elgin, and on payment of the sum of one dollar within ten days thereafter by the party owning the adjoining lands on both sides of the said portion of the said Highway first entitled thereto, to the Treasurer of the Corporation of the Township of Malahide for the uses thereof, the Reeve and Clerk of the said Township may execute a conveyance in fee simple of the said part of the Highway so stopped up and closed to the respective party owning the adjoining lands and affix the Corporate Seal of the Township thereto conveying the said part of the said Highway in fee simple. In default of payment by the said adjoining owner of the sum above mentioned within the period aforE)- said, the said part of the Highway so closed and stopped up and so directed to be conveyed, shall be sold and disposed of in such way as thE) Council of the Corporation may by By-Law or resolution approve or direct. 4.
