Mr. Muszynski reported that they have a year of data and the wind resource is
sufficient to support the project. They are continuing to talk to the landowners.
No detailed environmental assessment has been completed to date. They have
started to set up a co-op and have 5 directors and 20 members. Their company
will form a partnership with the co-op. The co-op will contribute 15%to the
project and own 15%of the project. The proposal is for 20-25 wind turbines.
He outlined the changes to the large FIT programs. Consultation is underway
and the new requirements will be released in the fall.
He is formulating a"roadmap"on consultation process and will submit a draft for
Council's consideration.

The proposed amendment would change the zoning of the lands lying on the west side
of Blacks Road, south of Marsh Line from the Agricultural(A1)Zone to the Rural

amendment would also fulfill a condition imposed by the County of Elgin Land Division
Committee in granting Application for Consent E 7113 to dispose the surplus farm

The lands proposed to be rezoned Rural Residential Three(RR3)comprise an area of
2,887 square metres(0.8 acres), a frontage of 36.6 metres(120 ft)and a depth of 79.1
metres(259 ft).The parcel is occupied by a single unit dwelling (erected 1890),
workshop and a detached garage. No change in use is proposed.The lot would satisfy
the minimum lot area, maximum lot area and minimum lot frontage requirements(1,850
sq. m,4,000 sq m and 30 m respectively)of the RR3 zone.All other requirements are
capable of being satisfied. Permitted uses of the RR3 zone include a single unit
detached dwelling, bed and breakfast establishment, home occupation and an
accessory use.
The lands proposed to be rezoned 'site-specific'Agricultural(A1-#)comprise an area of
20 hectares(49 ac), a frontage of 300 metres(984 ft)and a depth of 540 metres(1,772
ft). The parcel is without buildings or structures and has been cleared for agricultural
purposes No change in use is proposed.The lot would satisfy the minimum lot area and
lot frontage requirements(19 ha and 150 m respectively)of the All zone.

The proposed amendment would change the zoning of undeveloped lands lying at the
intersection of Furnival Road and Gray Line in the Hamlet of Port Glasgow, comprising
part of Lot 7, Concession XIV,from the'site-specific' Lakeshore Residential—Holding
(LR-3-H)Zone to the Trailer Park—Holding (TP-H)Zone.The amendment would permit
the expansion of the existing and adjacent Lakewood Trailer Estates trailer park to the
east with lands for the addition of 77 new trailer units and new washroom, shower and
laundromat facilities.The lands at the comer of Furnival Road and Gray Line may be
developed for commercial purposes, in which case a different zoning for these lands
may be required.
The subject lands comprise an area of 3.9 hectares(9.6 acres), a frontage of 934
metres(440 ft)on Furnival Road (County Road No. 103)and a depth and flankage of
288 metres (945 ft)on Gray Line. The parcel is without buildings or structures and has
been cleared and historically cultivated for agricultural purposes. The proposed
expansion would be accessed by a singular entrance from Gray Line and an internal
road system(private)connected to the existing park and serviced by the municipal
water supply and a private communal waste disposal system.
Permitted uses of the Trailer Park(TP)Zone include a campground or trailer park and a
dwelling unit or single unit detached dwelling as an accessory use.A maximum density
of 20 travel trailers per hectare(8 units per acre) is permitted. Application of the holding
(H)symbol will be considered to prevent premature development until such time as a

site plan agreement has been entered into and until engineering studies with respect to
water supply, sanitary waste disposal and'stormwater management are prepared and
approved by the Municipality.
The subject lands are designated 'Lakeshore Area' in the West Elgin Official Plan. The
policies of the Plan with respect to the Port Glasgow area are currently under appeal.
The subject lands are designated 'Seasonal Residential' in the proposed Port Glasgow
Secondary Plan.
The Planner noted that he felt that the appeal at the Ontario Municipal Board did not
include these lands and therefore we can go forward. Such things as servicing, site
plan agreement will be finalized prior to lifting the holding symbol. A separate septic
system will be designed for this development.
In response to a question from Councillor Miller, Ms. Dupuis noted that the proposed
rental cabins are trailers on wheels.

The lands proposed to be rezoned Residential First Density(R1), shown as Parcel 1 on
the attached key map, comprise an area of 981 square metres(10,560 sq ft) and is
without frontage. The parcel is vacant and is being added to the owner's abutting
residential lot to the north.The enlarged lot is increased in size to 2,060 sq m (0.5 ac),
while the frontage of the lot(at 26.8 m or 88 ft), remains unchanged. The enlarged lot
would satisfy the minimum lot area and minimum lot frontage requirements(580 sq. m
and 15 m respectively)of the R1 zone.
The lands proposed to be rezoned Residential First Density(R1), shown as Parcel 2 on
the attached key map, comprise an area of 2,163 square metres(0.5 ac)and a frontage
of 28.1 metres(92.3 ft). The parcel is occupied by a storage shed and is being added to
the abutting residential lot to the west owned by Larry and Carla Okolisan. The enlarged
lot is increased in size to 4,947 sq m (1.2 ac) and increased in frontage to 61 metres
(200 ft).The enlarged lot would satisfy the minimum lot area and minimum lot frontage
requirements(580 sq. m and 15 m respectively)of the R1 zone.

of 21.8 hectares(53.8 ac) and a frontage of 514 metres(1,686 ft). The parcel,which is
devoid of buildings or structures, is proposed to be added (merged in name and title)to
the abutting agricultural lot to the east(Steve&Agnes Simon). The enlarged lot,
comprising an area of 44.2 hectares(109.2 acres),would continue to be used for
agricultural purposes.The lot would readily satisfy the minimum lot area and minimum
lot frontage requirements(19 ha and 150 m respectively)of the Al zone. The'site-
specific'(A1-49)zoning would maintain consistent zoning on the enlarged parcel. The
Al-49 zoning prohibits a dwelling from being erected consistent with the existing zoning
which was applied by amendment in 2004.
The lands remaining, comprising an area of 53.9 hectares(133.3 ac), are without
buildings and structures and would continue to be used for limited agricultural purposes
with a large portion of the parcel being wooded. No change in use is proposed and the
existing 'site-specific'Agricultural(A1-48)zoning (which restricts the maximum number
of dwellings to one)would continue to apply.

PURPOSE: To consider a proposed amendment to the Zoning By-law for the purposes of disposing a
surplus farm dwelling.
The proposed amendment would change the zoning of the lands lying on the south side of Queens Line (County
Road No. 104) east of the Village of Rodney from the 'site-specific' Agricultural (A1-56) Zone to a `site-specific'
Special Agricultural (A24)Zone and to a 'site-specific' Agricultural (A1-69)Zone. The amendment would also
fulfill a condition imposed by the County of Elgin Land Division Committee in granting Application for Consent
El 04/12 to dispose the surplus farm dwelling situated on the lands.
The lands proposed to be rezoned `site-specific' Special Agricultural (A24) comprise an area of 5,829 square
metres (1.4 ac), a frontage of 48.2 metres (158 ft) and a depth of 121 metres (397 ft). The parcel is occupied by a
single unit dwelling and two storage barns. No change in use is proposed. The lot would satisfy the minimum lot
area and maximum lot area requirements (4,000 sq. m and 1.0 ha respectively) of the A2 zone, but would have
slightly less than the minimum lot frontage requirement of 50 metres. A 'site-specific' (A24) zoning would permit
this deficiency. All other requirements are capable of being satisfied. Permitted uses of the A2 zone include a
single unit detached dwelling, home occupation and an accessory use.
The lands proposed to be rezoned 'site-specific' Agricultural (A1-69) comprise an area of 15.4 hectares (38 ac)
and a frontage of 220 metres (723 ft) on Queens Line (County Road No. 104). The parcel is devoid of buildings
and structures and has been cleared for agricultural purposes. The parcel is to be merged in name and title with
abutting agricultural lands to the east owned by Parezanovic Farms inc. The enlarged parcel would satisfy the
minimum lot area and lot frontage requirements (19 ha and 150 m respectively) of the Al zone. The `site-specific'
(i.e. A1-69) zoning would prohibit a dwelling on the lands as stipulated by the PPS and the Municipality of West
Elgin Official Plan.
The subject lands are designated 'Agricultural' in the Municipality of West Elgin Official Plan. The proposed
Amendment is considered to be in conformity with the Plan.
ANY PERSON may attend the public meeting and/or make a written or verbal representation either in support of, or in
opposition to, the proposed amendment. IFA PERSON OR PUBLIC BODYthat riles an appeal of a decision of the Council of
the Corporation of the Municipality of West Elgin in respect of the proposed zoning by-law does not make oral submissions at

The above-referenced public meeting is to consider a proposed amendment to the Township of
Aldborough Zoning By-law with respect to the abovenoted lands. An Application for Re-zoning has been
filed by the owner of the lands, Parezanovic Farms Inc., in partial fulfillment of conditions imposed by the
Elgin County Land Division Committee in granting a related Application for Consent(E104112) on January
16th, 2013 for the purposes of creating a lot to dispose a surplus farm dwelling.
The subject lands are situated on the south side of Queens Line east of the Village of Rodney. The
proposed change in zoning is from the 'site-specific' Agricultural (A1-56) Zone to the 'site-specific
Agricultural (Ai-69) Zone and to the 'site-specific' Special Agricultural (A2-29)Zone.
The lands proposed to be rezoned A2-29 comprise the lot on which is situated the surplus farm dwelling.
The parcel satisfies the minimum lot area and maximum lot area requirements (4,000 sq m, 1.0 ha
respectively) of the A2 zone but has slightly less (i.e 48.2 m) than the minimum lot frontage requirement
of 50 metres. The proposed A2-29 zoning would allow for this deficiency. The lands proposed to be
rezoned Al-69 comprise the balance of the farm which is being consolidated with abutting lands to the
east. The enlarged parcel satisfies the minimum lot area and minimum lot frontage requirements (19 ha &
150 m) of the Al zone. The Al-69 zoning prohibits a dwelling being erected on the lands as stipulated by
the Provincial Policy Statement(PPS) and the West Elgin Official Plan.

WHEREAS the County of Elgin Land Division Committee has granted permission to the creation of a lot
(Application for Consent E104112) to dispose a surplus farm dwelling consistent with the Provincial Policy
Statement and in conformity with the West Elgin Official Plan;
WHEREAS the County of Elgin Land Division Committee in granting its permission has imposed conditions
pertaining to the zoning of the lot being created and the lands being retained including a restriction that no further
residential development be permitted on the retained lands;
WHEREAS the lands are not currently zoned for the purposes what they are intended to be used for;
NOW THEREFORE the Council of the Corporation of the Municipality of West Elgin enacts as follows:
1. THAT Section 5.3 to By-law No. 90-50, as amended, of the former Township of Aidborough being the
Exceptions of the Agricultural (Al) Zone, is hereby amended by deleting subsection 5.3.56 in its entirety.
2. THAT Section 5.3 to By-law No. 90-50, as amended, of the former Township of Aldborough being the
Exceptions of the Agricultural (Al) Zone, is hereby amended by deleting subsection 5.3.69 in its entirety
and replacing it with the following:

shall be deemed not to have come into force until the appeal has been finally disposed of, whereupon the

Clachan Road - Part of Lot 1, Broken Front Concession — east side of Clachan Road
south of the Thames River
1. Purpose
• to sever a 60.7 hectare (150 acre) parcel into two smaller parcels, both of which would be used for
agricultural purposes (refer Figure 1);
• the lands proposed to be conveyed have a frontage of 726 metres (2,382 ft) on Clachan Road, a
depth of 520 metres (1,706 ft) and an area of 41 hectares (101 acres). The parcel is devoid of
buildings and structures and is cultivated with the exception of a mature woodlot in the easterly
portion of the parcel. No change in use is proposed;
• the lands proposed to be retained would have a frontage of 308.7 metres (1,013 ft) on Fleming
Line, a depth and flankage along Clachan Road of 637.6 metres (2,092 ft), and an area of 19.8
hectares (49 acres). The parcel is occupied by a single unit dwelling, four sheds of various sizes
and a large barn. The parcel is primarily cleared for agricultural purposes (pasture). No change in
use is proposed;
• neighbouring lands comprise a mix of agricultural uses interspersed with pockets of wooded areas.
No potentially conflicting land uses are apparent.
2. Provincial Policy Statement(PPS) and Official Plan

• under the Provincial Planning Statement (PPS), the creation of lots for agricultural uses is
restricted in prime agricultural areas and may only be permitted provided they are of a size
appropriate for agricultural uses common in the area and provided they are sufficiently large to
maintain flexibility for future changes in the type or size of agricultural operations (Section 2.3.4.1);
• the PPS defines "prime agricultural area" as areas where prime agricultural lands (i.e. specialty
crop lands and/or Canada Land Inventory Classes 1, 2, and 3 soil) predominate and where there is
a local concentration of farms which exhibit characteristics of ongoing agriculture (p. 34). Soils
mapping for the Municipality of West Elgin prepared by the Ontario Institute of Pedology indicates
that the subject lands are classified as Class II in terms of their soil capability for agriculture, with a
significant portion identified as River Valleys &Tributaries (where a ranking is not assigned). A local
concentration of farms which exhibiting characteristics of ongoing agriculture exists in the area;
• the parcels being created are appropriate for the type of agricultural uses (Le. cash crop) common
in the area. At approximately 40 ha and 20 ha respectively, the parcels are sufficiently large to
maintain flexibility for future changes in the type or size of agricultural operations;
• the Ministry of Agriculture, Food & Rural Affairs, however, has not been supportive of the splitting
of agricultural lands which would result in parcels being created raving an area much less than
about 40.5 hectares (100 ac). While an actual figure for minimum farm size has never been
stipulated in the PPS, a "recommended minimum farm parcel size" of 40 ha is included in a
guideline document published by the Ministry; namely A Guide To Lot Creation In Prime
Agricultural Areas (OMAFRA, 2009). The lands being retained have an area of only 19.8 hectares
(49 acres). The proposed severance would unlikely be supported by the Ministry;
• the PPS does allow for lot adjustments in prime agricultural areas for legal or technical reasons
which include corrections of deeds and minor boundary adjustment which do not result in the
creation of a new lot. While it might be argued that the application would be for the purposes of
correcting a deed, the severance, if granted, would result in the creation of a new lot;
• the subject lands are designated 'Agricultural' in the West Elgin Official Plan. The severing of
agricultural land into smaller parcels is permitted in accordance with the following policy:
To discourage the severing of prime agricultural land into smaller parcels, the minimum
area of both the severed and the retained parcels shall generally be 40 hectares. Where
parcels smaller than 40 hectares are being proposed, they may be permitted subject to the
following factors being taken into account.

a) the need to discourage the unwarranted fragmentation of farmland;
b) the lots to be created are of a size appropriate for the type of agricultural activity
common in the area;
c) whether the resulting parcels would constitute viable farm units,
d) the severed and retained parcel are large enough to maintain flexibility for future
changes in the type or size of agricultural operations;
e) whether the size of the parcels would have a detrimental impact on agricultural
productivity, operating efficiencies or future farming options;
f) the boundaries of the parcels being created and their effect on the intended use of the
lands for agricultural purposes;
g) previous lots created out of the parcels including land dedications or expropriations;and
h) the inadvertent merging of the parcels as a result of the introduction of subdivision
control in 1970. (Section 6.2.7)
• upon taking into account the above-noted factors into account, there is not considered a significant
breach if the consent was granted;
• the owner's solicitor has advised that, as a result of the terms of a will, the farm was placed in the
name of Darlene Lather and her three children. It is intended that the lands being conveyed be sold
to a local farm family (McIntyre), while the lands being retained would continue to be the principle
residence of Darlene Lather with the lands rented out for use as pasturelands. This rationale, while
having merit, cannot be reconciled with the relevant policies in either the Official Plan or the PPS.
Conformity with the Official Plan is not capable of being demonstrated based on the information or
rationale provided.
3. Zoning By-law
• the subject lands are zoned Agricultural (A1). Both the lands being conveyed and retained would
satisfy the minimum lot area and lot frontage requirements (19 ha and 150 m) of the Al zone. A
variance or re-zoning would not be required;
• although it has been indicated that a basis for granting the application exists insofar as the parcels
satisfy the minimum requirements of the Zoning By-law, compliance with the By-law does not in
and off itself constitute a sufficient planning rationale for granting the severance;

• while the intentions of the owners are clear and the lands being conveyed and retained would
remain in agricultural use, it is difficult to reconcile the proposed severance with the guidelines of
OMAFRA or the 40 ha minimum of the West Elgin Official Plan. The following requirement of the
Planning Act[Section 51(24)]with respect to the subdivision or severance of land would not appear
to be satisfied:
"(c) whether the plan (severance)conforms to the official plan. . .
• on the other hand a merger in title of the lands being retained with the abutting farm to the east
would be desirable and would eliminate the creation of an undersized agricultural parcel
5. RECOMMENDATION
That the proposed application for consent of D. Lather, M. Lather, S. McDonald & B Taylor not be
supported and the Elgin Land Division Committee be advised accordingly.
REASONS
i) Consistency with the Provincial Policy Statement would not be maintained;
ii) Conformity with the West Elgin Official Plan would not be maintained;
iii) The matters set out in the Planning Act would not be satisfied.

The property is in the name of Darlene Lather and her daughters, Mary Lather, Sharon
Macdonald and Brenda Taylor as tenants in common each as an undivided 25%interest. Due to
the death of Archibald Lather(the spouse of Darlene Lather) on August 13, 1984 without a Will
and the death of Frederick Lather(the brother of the late Archibald Lather who died with a Will
without beneficiaries) on the 5'of September, 1984, there was involvement of the Office of the
Children's Lawyer in these Estates,resulting in the home farm having to be placed in not only
the name of Darlene Lather,but also in the names of her three children, each as to an undivided
25% interest. The farm is currently rented or sharecropped for income. Mrs. Lather would Iike
to sell the severed parcel to a local farm family consisting of Allan McIntyre,Johnathon
McIntyre and Alex McIntyre, while retaining the 49 acre parcel which contains her principal
residence and outer buildings. Mrs. Lather will continue to farm the retained parcel by renting it
out as a pasture farm. We note this severance Application still complies with the requirements of
the Zoning by-law for the Township of West Elgin and we request same to be granted.

1. That RFP from Spectrum to be approved in principle and be presented
to each council - $681,065.40.
2. That an allowance of 15% of the Capital Cost for unforeseen costs -
$102,159.81.
3. Voice Link to St. Thomas Fire for voice only for Mutual Aid
Requirments - $7,070.00.
4. Cost sharing agreement of 1/7 the capital cost and ongoing
maintenance of the Elgin Communication System is share by each
municipality in Elgin County and to be managed the Municipality of
Central Elgin.
INTRODUCTION:
In 2009 a committee was established to look for alternatives to upgrade the
communications systems for the Fire Services in Elgin County. The estimate for
this upgrade (before an RFP was prepared) was estimated to be $1,500,000.00
and municipality has been planning for the replacement of the communication
system with a reserve to date of$200,000.00 for the Municipality of West Elgin
share of the capital project.
DISCUSSION:
An Request for Proposal (RFP) was issued April 24, 2013 and closed June 21,
2013 and two proposals were received.
A review was completed of the technical documents, after scoring was
completed the pricing of the two options were opened. The RFP Review,
Summary and Recommendation is attached to the report.
It is recommended to award the contract to Spectrum Communications who
scored the highest on the Technical Review and was the lowest bid with the
following:
1. Capital for the Elgin Communication System $681,065.40(+HST)
2. Link to St.Thomas Fire (Mutual Aid Co-Ordination) $ 7,070.50(+HST)
3. Capital cost of West Elgin (Station Radio Upgrades) $ 25,200.00(+HST)
4. Annual Maintenance Cost will be:
Annual Industry Canada License Fees $ 5,044.00(+HST)
Monthly Site Fees $ 2,400.00(+HST)
Monthly Telephone Fees (Tillsonburg) $ 200.00(+HST)
The Committee met with the Mayor's, CAO's and Fire Chiefs to review the
recommendations and the following was approved to be brought back to each
Municipal councils:
1. That RFP from Spectrum to be approved in principle and be presented to
each council - $681,065.40.
2. That an allowance of 15% of the Capital Cost for unforeseen costs -
$102,159.81.
3. Voice Link to St. Thomas Fire for voice only for Mutual Aid Requirments -
$7,070.00.
4. Cost sharing agreement of 917 the capital cost and ongoing maintenance
of the Elgin Communication System is share by each municipality in Elgin

The Reserve set-up for the Fire Communications will meet the Municipality West Elgin's

Report to: Lower Tier Councils in Elgin County
Date., July 12,2013
On April 24th, 2013, 2013 a Request for Proposals was issued by the Ad hoc Elgin County Fire
Communication Committee for professional consulting/engineering services and the supply of a
digital two-way radio communication system for the seven municipal fire services in Elgin
County. A subcommittee composed of the fire chiefs; an elected representative, Councillor
Stephen Carr from Central Elgin; and a Chief Administrative Officer, Kyle Kruger from Bayham,
was established to evaluate the proposals and identify a preferred proponent. The evaluation
subcommittee met twice to evaluate the two proposals received.
The full Ad hoc Elgin County Fire Communication Committee met on Wednesday, July 10th,
2013 to receive a report from the proposal evaluation subcommittee. The subcommittee
identified Spectrum Communications Ltd. as the preferred proponent. The Committee is
recommending that each lower-tier council pass the following resolutions:
BE IT RESOLVED THAT the Council of the
accepts the proposals from Spectrum Communications Ltd., London, dated June 21,
2013:
• for the design/build of a Digital Two-Way Simulcast Radio Communications and
Simulcast Two-Way Paging System; and
• for the "voice only" link to the St. Thomas Fire Department
subject to the execution of an agreement between Spectrum and the participating
municipalities;
AND FURTHER THAT Council agrees to fund one-seventh of the cost of the proposals and
a 15% contingency allowance.
BE IT RESOLVED THAT the Council of the
is agreeable to The Municipality of Central Elgin maintaining and licensing the new
digital communication system on behalf of the seven municipalities AND THAT ongoing
maintenance costs and licence, site and telephone fees be equally allocated between
the seven municipalities.
A copy of the proposals and the reports from the proposal evaluation subcommittee was
provided to each municipality through the Committee.
The Ad hoc Elgin County Fire Communication Committee is requesting each council to confirm
its acceptance of the recommended proposals by the end of August 2018 as Spectrum's
proposal includes a 90 day deadline for acceptance.

RECOMMENDATION:
That the Municipality of West Elgin establish a contract position for Fire
Inspector; AND Further that a contract be entered with Gary Wilson for the
period ending December 31, 2013 to be the Fire Inspector under the direction of
the Fire Chief of Rodney and West Lorne.
INTRODUCTION:
The Fire Protection and Prevention Act prescribes that:
2.(1)"Every municipality shall,
(a) establish a program in the municipality which must include public
education with respect to fire safety and certain components fire prevention; and
(b) provide such other fire protection as it determines may be necessary in
accordance with its needs and circumstances."
DISCUSSION:
A number of municipalities in Elgin County have been researching and
developing a Business Case for a Fire Safety Inspection Officer to be shared in
Elgin County.
It is expected that there are changes coming to the Fire Protection and
Prevention Act as it relates to Fire Inspections, Until these changes are known, it
is recommended that we put in temporary measures to meet the current
legislation.
Our Volunteer Fire Departments do a great job of providing services to the
Municipality of West Elgin, however there a number of higher level Fire
Inspections that need to be done and additional support or training is required.
There is a Volunteer from Port Stanley Fire Station in the Municipality of Central
Elgin has the training and certification to provide Fire Inspections.
A proposal from Gary Wilson (Central Elgin — District Chief) has provided a
proposal to provide Fire Inspection on a request basis at a rate of$40.00 per
hour plus mileage.

RECOMMENDATION:
That Council approve the Recreation Department,including the West Elgin Recreation Committee,
to develop and Implement a Managed Forest Plan.Further that this plan be developed in
conjunction with the Lower Thames Valley Conservation Authority and the Ministry of Natural
Resources.
INTRODUCTION:
On April 22 2023 the Kiwanis Club of Rodney held a meeting at Joes Bush to try and map a future of
the woodlot.It is my understanding that this meeting met with a wide variety of responses as to
what should be done to preserve this area.
DISCUSSION:
Joes Bush is a SO acre parcel of"bush"that was left to the Municipality of West Elgin (originally
Rodney)for primarily passive recreational purposes,as parkland and to be maintained in its
natural state.
The intent of the legacy was to maintain a bush area for the residents of West Elgin.As was evident
in the meeting of April 22 2013 at Joes Bush there is a wide variety of opinions and ideas as to how
the bush is to be maintained and for what purposes.After consulting with the Lower Thames Valley
Conservation Authority,to simply ignore the Bush and let nature take its course may not be in the
best interest of either the Municipality or Joes Bush.
There seems to a good deal of interest in maintaining trails in this area,passive recreational use,
and a great deal of interest in promoting it as an educational area for the schools to use,as well as
family orientated activities.The Municipality will want to promote this area but it is important to be
very specific as to the activities that are sustainable,and thus to the user groups to whom the area
would be promoted,i.e.hikers,education etc.
While this area is a great community asset,liability,maintenance of the trees,and trail conditions
also need to be examined.Once the Public,for whatever purposes are invited into an area the
standard of care increases.Therefore to adopt a"hands off"approach is not practical nor very
smart,to adopt a clear cut"log the bush"mentality is also not very practical,and in fact would be
very detrimental to the health of the bush.
What I would like to propose to Council is that the Recreation Department work in conjunction with
the Lower Thames Valley Conservation Authority and develop a Managed Forest Plan.The Plan
z
would take into account the end result,a healthy managed forest,yes there may need to be some
tree removal,or trimming,and basic tree maintenance.Also there would be included a plan to
develop or maintain a trail system that people could use for passive recreation. Some activities in
this area would have to be prohibited,hunting,ATVs,and snowmobiles.
The end result would be a healthy safe forested area that could be used for nature walks,passive
recreation,and as an educational resource.
The Community Partnerships could be endless,nature groups could help provide the educational
programs,service clubs possibly some manpower,the general public possibly some manpower,
however the management needs to come from the Municipality,under the guidance of the
Conservation Authority. The Municipality is the owner of the property and as such will assume the
liability should things deteriorate.

RECOMMENDATION:
THAT a by-law to adopt the Sale and Disposal of Land Policy be brought forward.
INTRODUCTION:
Section 270 (1) of the Municipal Act requires the municipality to adopt and
maintain policies with respect to its sale and other disposition of land, amongst
other things.
BACKGROUND:
By-law No. 2002-41 (attached), a by-law to provide for procedures for the sale of
land, was adopted by Council on November 28, 2002 under Section 268 of the
Municipal Act. Section 268 was repealed in 2006 and replaced by Section 270.
Section 270 is less prescriptive and gives the municipality more flexibility.
DISCUSSION:
Attached is a draft policy for the Sale and Disposition of Land that has been
authored after review of other municipal policies.
The changes include the following:
• An appraisal is no longer legislated. Section 3.02 allows Council the
flexibility to direct that an appraisal is not required. This could be used in the
case of land vested in the municipality through the tax sale process.
• A survey is no longer required.
• Appraiser is no longer defined
• Advertising is in the Chronicle and on our web (Section 3.04), London Free
Press has been deleted;
• Exemptions have been expanded. For example, section 3.07(vi) includes
lands for municipal capital facilities.
• Section 3.07 (b) give Council the option to direct the policy be followed for a
particular exemption.

BY-LAW 2002-41
BEING A BY-LAW TO PROVIDE FOR PROCEDURES FOR
THE SALE OF LAND OWNED BY THE CORPORATION OF
THE MUNICIPALITY OF WEST ELGIN
WHEREAS Section 268 of the Municipal Act, 2001, S.O. 2001, c.25 requires that
every municipality shall pass a by-law establishing procedures regarding the sale
of land;
AND WHEREAS Council of the Corporation of the Municipality of West Elgin
shall by by-law or resolution declare the land to be surplus;
AND WHEREAS Council shall obtain at least one appraisal of the fair market
value of the land;
AND WHEREAS Council shall give notice to the public of the proposed sale;
AND WHEREAS every municipality shall establish and maintain a public register
listing and describing the land owned or leased by the municipality, save and
except for those land which are exempt under section 268(11) of the Municipal
Act, or regulations made pursuant thereto, as the same may be amended from
time to time;
AND WHEREAS the Minister, by regulation, has prescribed classes of land for
which the provisions of section 268 shall not apply;
AND WHEREAS the Minister, by regulation, has prescribed certain public bodies
for which an appraisal is not required;
NOW THEREFORE, the Council of the Corporation of the Municipality of West
Elgin hereby enacts as follows:
1. That at any time Council shall by resolution declare any of its land to be
surplus to the needs of the municipality, and the Clerk shall be authorized to
take action as described in Schedule"A"of this by-law attached hereto.
2. That this by-law and Schedule"A"shall apply to all classes of land owned by
the municipality, save and except those outlined in Schedule "B" of this by-
law attached hereto.
3. That upon the sale of land of the Corporation, the Municipal Clerk may
include in the deed or transfer for any such sale a "Certificate of Compliance"
in the form set out in Schedule"C"of this by-law attached hereto.
4. That By-law 98-41 is hereby repealed.
5. That this by-law shall come into effect on January 1, 2003,

1. Obtain approval from other agencies involved, if necessary.
2. Obtain a survey of the land proposed to be disposed of from an independent
surveyor in accordance with the laws of the Province of Ontario if deemed
appropriate.
3. Obtain an appraisal of the land proposed to be disposed of from an
independent qualified appraiser who shall:
(a) be a registered member in good standing of the Appraisal Institute of
Canada,
(b) not be directly connected with any real estate brokerage firm (i.e. a real
estate agent, etc.)
(c) conduct business primarily in or near the local municipality where the
proposed property to be disposed of is located.
4. Should the method be to sell the property by tender or request for quotations:
(a) costs incurred or required to dispose of the proposed land including
legal fees, survey, appraisal, encumbrances, advertising,
improvements, etc. shall be established
(b) an estimated bid amount shall be established which shall be based on
the appraised value and shall be increased to include the amount of
costs referred to in clause 4(a) above
(c) an advertisement shall be placed in a publication or newspaper having
general circulation in the municipality and which is intended to provide
coverage through the entire geographic area of the municipality.
Advertisements in newspapers outside the Municipality of West Elgin
shall include, The London Free Press. The advertisement shall include
a brief description of the property including a small location sketch and
shall specify the dates involved with the sale.
(d) the tender or quotation documents shall be submitted to the Municipal
Clerk and shall include the statement that the 'highest or any offer may
not necessarily be accepted'.
(e) advertisements shall provide a minimum of three full calendar weeks
from the time it is published until the tender or quotation is received by
the municipality.
5. Should the method be to engage a real estate firm or broker:
(a) an appropriate advertisement shall be placed in a publication or
newspaper having general circulation in the area where the property is
located. Advertisements in any other newspapers shall include the
London Free Press. The advertisement shall include a brief description
of the property including a small location sketch.
(b) the Offers to Purchase shall be submitted to the Municipal Clerk on
behalf of the Municipal Council.
(c) the Council shall determine by negotiation the real estate commission
payable to the Municipality.
6. Should an alternative method be determined by Council:
(a) an appropriate advertisement shall be placed in a publication or
newspaper having general circulation in the area where the property is
located. Advertisements in any other newspapers shall include the
London Free Press. The advertisement shall include a brief description
of the property including a small location sketch.

1 PURPOSE:

(a) "Appraisal' means an opinion of the fair market value;
(b) "Council' means the Council of the Corporation of the Municipality of West Elgin;
(c) "Disposal' shall mean the sale of real property;
(d) "land" includes building and estate or interest in land or any nature including without
limitation an easement, restrictive covenant or right of way;
(e) "Municipal'or"Municipality" or"Municipally" means the Corporation of the Municipality of
West Elgin;
(f) "Purchaser" includes a lessee or grantee of Land;
(g) "Surplus land" means any land or interest/rights owned by the Municipality of West Elgin
declared surplus to the needs of the municipality;
(h) "Sale" means the sale of land, which includes a lease of 21 years or longer and is also
deemed to include surface, mineral, and/or timber interests/rights.
3 PROCEDURE
3.01 Declaration
(a) Council shall, at any time, by resolution, declare any of its real property to be surplus to the
needs of the Municipality.
(b) Obtain approval from other agencies, it necessary.
3.02 Appraisal
(a) Prior to the disposal of real property and where there is no exemption under this policy,
Council shall obtain at least one appraisal of the fair market value of the real property from
an independent qualified appraiser, or from a real estate firm or broker. Council may, by
resolution, on a case by case basis, direct that any appraisal is not warranted for a piece of
property.
3.03 Method of Sale
(a) Should the method to sell real property by tender, request for quotation, or public auction,
once the surplus property is officially declared by Council,
i) The costs associated with the disposal of real property including legal fees, survey,
appraisal, advertising, etc., shall be determined by the Treasurer.
ii) The tender or quotation document shall be submitted to the Clerk, and shall include
the statement that"the highest or any offer may not necessarily be accepted"
iii) The sale by public auction document shall include a minimum bid reserve.

(b) Should the method be to sell real property through a real estate firm or broker, once the
surplus property is officially declared by Council;
i) The Offers to Purchase shall be submitted to the Clerk, and shall be presented at the
next regular meeting of Council, for Council's acceptance or dismissal.
ii) Council shall determine, by negotiation, the real estate commission payable.
3.04 Advertising and Notice
(a) Advertising for disposal of real property, regardless of method of disposal shall be placed in
the Chronicle and on the municipal web site. The advertisement shall include a brief
description of the property and/or small location sketch. The date and time associated with
each sale, shall also be included in the advertisement.
(b) A notice shall also be posted at the site of the proposed sale, if it is to be sold by tender,
request for quotation, or by public auction. In the case of the land being sold by engaging
the services of a real estate firm or broker, a"For Sale" sign(s)will be sufficient site notice.
(c) If the property is to be sold by public tender or request for quotation, all advertising or
notices shall be undertaken at least 30 days prior to the regular Council meeting at which
the proposed disposal will be discussed.
(d) If the property is to be sold by public auction, all advertising or notices shall be undertaken
at least 30 days prior to the date of public auction.
3.05 By-law
(a) Prior to completion of the sale of lands, the municipality shall pass a by-law, which by-law
includes the following information:
i) Date the resolution declaring lands surplus was passed;
ii) The final sale price;
iii) The purchaser;
iv) Road closing requirements (if applicable).
3.06 Certificate of Compliance
(a) At the completion of the transaction to dispose of the real property, the Clerk may issue, at
the request of the purchaser, a Certificate of Compliance. The said certificate shall certify,
to the best of his or her knowledge and belief that the Municipality has complied with the
provision set out in the Municipal Act. The form of certificate is attached hereto, as
Schedule"A".
3.07 Exemptions
(a) This Policy shall apply to all classes of land owned by the Municipality, save and except the
following exemptions:
I) Disposals conducted in connection with a Planning Act application or approval which
disposal may be addressed and dealt with in a consent agreement, a subdivision
agreement or site plan agreement;
ii) Disposal to a County or District Municipality or the Crown in Right of Ontario or
Canada or any agency thereof;
iii) Disposal of an easement to a public utility;
iv) Municipal tax sales(Part X1 of the Municipal Act, 2009);
V) Sales pursuant to section 106 of the Municipal Act, 2009;
vi) Sales pursuant to section 110 of the Municipal Act, 2009;
vii) Land 0.3 metres or less in width acquired in connection with an approval or decision
under the Planning Act,

viii) Highways, roads and road allowances;
ix) Land formerly used for railway branch lines if sold to an owner of land abutting the
former railway land,
X) Land that does not have direct access to a highway if sold to the owner of land
abutting that land;
xi) Land repurchase by an owner in accordance with the Expropriations Act;
xii) Land sold under section 107, 108 and 109 of the Municipal Act, 2001;
xiii) Easement granted to public utilities or to telephone companies;
AV) At the discretion of Council.
(b) Council may, be resolution, on a case by case basis, direct that any disposal exempted
hereunder be conducted in accordance with this policy.
4 ADMINISTRATION:
4.01 The Administrator shall ensure this policy is followed.

horse and buggy to shuttle people between camp and downtown. The cost will be $5

On August 1 I to 17,the Waterfront Regeneration Trust,a registered charity,will publicly launch the newest section
of the provincially significant Waterfront Trail as part of the 2013 Great Waterfront Trail Adventure(GWTA). The
GWTA is a fully supported,seven day,recreational bike tour from Lakeshore to Fort Erie. Over 150 end to end
participants will join us in celebrating this exciting milestone for the Waterfront Trail.They range in age from I4 to
74 and come from Alberta,Ontario, Quebec,New York,Connecticut,Pennsylvania,California, Idaho,Maryland,
Ohio.
Participants will arrive in Elgin County on Wednesday August 14'h and overnight in Port Stanley. On Thursday
August 15 they will continue from Port Stanley to Turkey Point.The attached itinerary shows the Elgin County
stops on August 13-14 and you are welcome to join us for any part.

The August 11 to 17 inaugural tour represents the culmination of a three-year initiative undertaken by the
Waterfront Regeneration Trust with funding from the Ministry of Tourism and the Ministry of the Environment to
expand the 800 km Waterfront Trail into southwest Ontario and further along the Great Lakes. Southwest Ontario
Tourism provided funding for the directional signage,which is currently being installed.Thanks to the spirit of co-
operation among the communities and the foundational work in place locally and regionally to develop trails and

accomplished in 3 years. This is the largest single expansion of the Waterfront Trail and makes it 1400 kilometres
from Quebec to Windsor.
It has been a pleasure working with representatives from the County—Alan Smith,Lindsey Morritt and Kathryn
Russell and Clayton Wafters to identify and sign a route through the County for the Waterfront Trail that builds on
the fantastic work by the lower tier communities. Lindsey Morritt and Carol Gates of the Port Stanley BIA have
developed a wonderful itinerary for our time in Elgin and have involved local businesses and attractions such as the
Ojibwa.
In addition to working with the municipalities,we are proud to work with Carolinian Canada Coalition. Significant
parts of the Waterfront Trail along Lake Erie are part of the Erie Coastal Stewardship Eco Trail network that they
are spearheading to protect and promote the unique Carolinian ecosystem.
The GWTA is designed to showcase our WOW—Wonderful Ontario Waterfront communities and promote use of

| am writing to follow up On a telephone conversation which we had yesterday, which in
itself is a follow up to a phone call and letter which | sent tothe Municipal office in May of
2012. Unfortunately when | left West Elgin Secondary last yunnrner all ofrnye|mctronicfi/es
were erased, so / do not have a copy of that letter.
The reason for both letters is my concern for the safety of students and the general
public near the intersection of County Road 76 (Graham Road) and Marsh Line. The current
speed limit when approaching that intersection from the west is 80 kph. Throughout the day,
but especially in the morning and in the hours after school is dismissed this is a very busy area,
with a great deal of pedestrian, car and bus traffic, as well as Canada Post delivery vehicles. |
believe that the current situation creates a dangerous situation which has a high potential for a
potential tragedy.
Students walk to and from VVE5S and VVE5ES, some are picked up and dropped off by
buses at the entrance to the subdivision, mail delivery is made, people enter and leave the
subdivision and stop to pick up their mail: all this happening while regular traffic zooms along
at a potential 80 kph right up to the stop sign at the intersection. With so much happening
drivers can also easily become distracted, adding to the potential for an accident to occur.
| urge the municipal council, roads department (to vvhonl | was requested to write last year
after my initial telephone inquiry about this matter) and the county, if necessary, to alter the
speed limit to 60 or 50 kilometers per hour in that final stretch of Marsh line for severa I

Our group portray the Royal Scots First Regiment of Foot, Light Company who were one
of the units that participated in the battle on March 4, 1814.
To commemorate the event the following will occur on Saturday March 8, 2014
1. Memorial Service to remember the soldiers who died and were left on the battle
field after the conflict(16 British and 5 American)
2. Dedication of a Memorial Plaque telling of the events (5 ft X 14 ft Concrete and
granite)

3. Dedication of the site as a Memorial Park. The Battle site is currently owned by
the County of Middlesex it is in the process of being transferred to the

West Elgin Township Council June 27, 2013re(
As a service club we participated this year in the Car Show that is organized
by Gail and Pete Hack on June 8th. Gail invited us to serve breakfast from
the Rodney Recreation Centre to everyone that was attending the show. We
used the kitchen facilities at the Recreation Centre and had lots of fun
serving food and having conversations with the crowd. We would like to
thank council for the use of the Kitchen and equipment. We served about
100 customers that morning.
After discussing the venue for the show and how it had been in the past on
the Main Street of Rodney with many people that Saturday morning, it was
clear that many people would have preferred to have it up town again on
Main Street. It was a beautiful day on June 8h and the park was in great
shape with lots of room to park cars. Unfortunately the crowd was just not
there like the other years. Since it was the first time we were directly
involved we do not have a benchmark on how busy it could be. Gail claims
that she served close to 200 last year up town.
It does not matter to us where it is located but our members feel we should
try to create the best event to draw the most people when anyone puts on a
function. As a service club of Rodney we feel strongly about always
promoting a positive image for the town and township. We feel strongly that
the car show should be allowed to take place up town as it has in the past.
We may attract more people and cars to the show, certainly catch a few more
people driving into town that did not realize a show was on, and help some
business's take advantage of the extra people traffic that is walking around
on Main Street.
Please consider allowing the car show to be on main street again in the
future.

Dear Ms. Bryant,
The Ontario Urban Forest Council is trying to raise the awareness of the Emerald Ash Borer, EAB, as it continues
to kill Ash trees unabated across the natural distribution area of all species and varieties of Ash,with the
exception of Blue Ash, in the Province of Ontario.
Recently the Canadian Food Inspection Agency,CFIA indicated it was moving to Regulate EAB in Ontario up to
the French River area by Aril 2014 and focus CFIA efforts in areas north and west of there.This will create a
vacuum for help and information in the newly regulated areas of Central and Eastern Ontario.The Province in
our understanding is not mandated to deal with this Federal jurisdictional issue of preventing,detecting and
managing imported invasive species.
Please, if your Council has not already done so, consider the attached letter and resolution to pursue bringing
attention to this "creeping environmental disaster" affecting all property owners with Ash trees in the next two
months if possible.
As mentioned in the correspondence it will be the Municipal Taxpayer and Municipal Staff and financial resources
that will bear the brunt of dealing with this "uncosted aspect of International Trade", its' risk management issues
both on public and private lands.
Your Municipalities help in increasing attention at the various levels of government noted in the proclamation,
can lead to change that will hopefully provide tools and resources.This would help those Municipalities that are
now struggling to recover from this multi-year challenge created by EAB or will be soon driven by its' presence
for many years to come.

You may be aware that Ontario, along with many other jurisdictions, is being hit hard by
the imported pest Emerald Ash Borer,Agrilus plannipennis. It has already killed tens of
thousands of ash trees. The Municipal Arborists and Urban Foresters, a Committee of the
International Society of Arboriculture and the Ontario Urban Forest Council are working to
raise awareness about EAB and the environmental and economic fallout.
Public property owners, homeowners, businesses, institutions, and utilities will have to
deal with thousands of ash trees before they become a liability and bear the cost of
implementing programs to deal with this terrible loss to our urban forest.
Effective EAB programs involve the following:
• identifying ash trees, size and locations (an inventory)
• Monitoring the distribution of the pest within local areas
• Identifying and treating trees worthy of preservation
• Tree removal on public and private lands, and disposal of wood waste
• Replanting replacement trees.
Currently, neither the Federal nor Provincial Governments are providing sufficient
financial/management support to municipalities for implementation of any part of an EAB
program. With the CFIA recently announcing they were moving the EAB rekyulated zones
into the French River area by early next Year.Therefore, we have prepared the attached
proclamation calling for A FEDERAL and PROVINCIAL ROLE IN URBAN FORESTRY.
Attached is a proclamation we are sending to Clerks across Ontario. We are seeking your
Council's endorsement of this proclamation and would ask that you present this to your
respective Council for consideration. Thank you for your assistance in bringing this to your

A FEDERAL and PROVINCIAL ROLE IN URBAN FORESTRY
WHEREAS over 80%of Canadians now live in urban areas and have come to rely on the
environmental, ecological and economic benefits of urban forests;
AND WHEREAS the health of Canadians is sustained by their urban forests which provide services
through improving air quality, cooling city streets and buildings, acting as a windbreak, shading from
harmful UV rays, and filtering storm water, as well as beautifying our communities;
AND WHEREAS neither the federal nor provincial governments currently include urban forestry in
their mandates except in a limited role with respect to exotic, invasive pests;
AND WHEREAS the Canadian Food Inspection Agency has not been able to stop the spread of the
Emerald Ash Borer throughout Ontario and Quebec
AND WHEREAS the Emerald Ash Borer is expected to cost Canadians over$2 Billion dollars in
treatment and replanting;
AND WHEREAS Canadian forestry programs and research are solely focused on industrial forests and
do not at present include urban tree planting, appropriate species research, and insect control and
management; and
AND WHEREAS other jurisdictions such as the United States Forest Service and the European Urban
Forestry Research and Information Centre include urban forestry as a program and research area;
AND WHEREAS Canada engages municipalities in a number of substantial infrastructure programs;
THEREFORE BE IT RESOLVED that the Municipality of
calls on the Federal and Provincial governments to take leadership roles in recognizing the need to
support urban forestry, by establishing urban forestry mandates and programs which includes
funding assistance to municipalities for the control and management of the Emerald Ash Borer- and
any future significant imported diseases and insects -as well as the creation and funding of programs
designed to support the on-going sustainable management of urban forests.
BE IT FURTHER RESOLVED That all municipalities across Ontario be encouraged to endorse
this proclamation and that this resolution be distributed to The Honourable Gerry Ritz, Minister of
Agriculture and Agri-Food; The Honourable Joe Oliver, Minister of Natural Resources; The

Every 5 minutes, a new case of dementia is reported in Canada. I am contacting your
municipality to discuss.the need for collaboration as Canadians to work together to
implement a national, provincial,and municipal dementia strategy to meet the growing
needs of all citizens in the next 30 years.
Alzheimer's disease and.related dementias are progressive.and degenerative diseases of
the brain that cause thinking,and memory to become impaired. Currently, over 50.0f0o0"
Canadians are living with Alzheimer's disease and related derildntias (including 200,000
Ontarians)and within the next generation this number is expected to rise to 1.1 million
people.The current-health care costs associated with these diseases are ever$1 S billion.
annually and this amount is steadily increasing.
Alzheimer's disease and related dement as have a momentous impact on those lining with
these diseases and also their caregivers, families,health care providers,.and communities.
Some of the consequences of people living.with Alzheimer's disease and related
dementias include the need for support from informal caregivers; the need for more in-
hom e supports to reduce thea use of hospital and long term care beds,the need for more
housing models including supportive housing, and financial assistance to ensure that
people at risk are recemvirig the subsidized support that they need.
Alzheimer's disease and related dementias are not a norm--d part of the aging process and
it affects us all, directly and/or indirectily. Many comitries have xeco:gni�ed the urgency
and impact of Alzhaftner's disease and related.dement as and have.developed strategies
accordingly, Canada:does not have a strategy for supporting the people,health care
system,and communities that are affected by Alzheimer'$:disease and related dementias.
T am asking that you discuss and pass a resolution in your municipality,such as the City
of Greater Sudbiity,,to support the people in,your area who are affected by dementia and
to also reduce,the burden of dementia in.:Your community,in the future.By building this

A Resolution in Support of a National Dementia Strate
Whereas Alzheimer's disease and other dementias are progressive, degenerative diseases of
the brain that cause thinking and memory to become seriously impaired;
Whereas Alzheimer's disease and other dementias most often occur in people over the age of
65 but can strike adults at any age; and
Whereas Alzheimer's disease and other dementias affect more than 500,000 Canadians
currently and that this figure is projected to reach 1.1 million within a generation; and
Whereas Alzheimer's disease and other dementias also takes their toll on hundreds of
thousands of families and care partners; and
Whereas an estimated further three million Canadians face the burden and challenges of
providing care for those suffering with Alzheimer's disease and other dementias; and
Whereas there is no known cause or cure for this devastating illness; and
Whereas the cost related to the health care system is in the billions and only going to increase,
at a time when our health care system is already facing enormous financial challenges; and
Whereas Canada, unlike many countries, does not have a national dementia strategy; and
Whereas there is an urgent need to plan and raise awareness and understanding about
Alzheimer's disease and other dementias for the sake of improving the quality of life of the
people it touches; and
Whereas MP Claude Gravelle Nickel Belt has introduced Bill C-356,An Act respecting a National
Strategy for Dementia, as he works for broad, all party and non partisan support for an issue
that touches us all. His legislation calls for a national plan that includes the development of
strategies in primary health care, in health promotion and prevention of illness, in community
development, in building community capacity and care partner engagement, investments in
research and other(advisory board, objectives, investment in research, and caregivers and
more)
Now therefore,the City of INSERT YOUR TOWN HERE calls on all levels of government and the
Federation of Municipalities to adopt a national dementia strategy, and urges all citizens of our
communities to become more aware and engaged concerning the far-reaching effects of this
devastating disease.

WHEREAS the Premier of Ontario has recently conveyed the Governments desire
to limit Industrial Wind Turbines (IWT) Projects to communities that are willing
hosts;
AND WHEREAS Warwick Township Council applauds the position of taken by the
Premier and the Government;
AND WHEREAS Warwick Township Council has outlined their concerns on
Industrial Wind Turbine and renewable energy projects in Ontario in a resolution
dated November 94, 2012 which forms an integral part of this resolution:
WHEREAS the Province of Ontario has enacted the Green Energy Act(2009) as
the framework for facilitation and approval of renewable energy projects within
Ontario including Industrial Wind Turbines, Solar projects, and Fit programs.
WHEREAS the Township of Warwick residents have expressed concerns on the
Industrial Wind Turbines and health impacts of renewable energy projects;
WHEREAS the Township of Warwick has one of the largest landfills in Ontario
(Twin Creeks Landfill-Waste Management) with excess energy capacity; and the
Township of Warwick is working with Waste Management to ensure grid capacity
is available for energy from methane resources to enter grid capacity,
WHEREAS the Township of Warwick met with Minister Brad Duguid to be
proactive and relay its residents concerns as well as request clarification to the
economic impacts of the Samsung agreement and available grid capacity for
Southwestern Ontario;
WHEREAS Minister Brad Duguid referred the Township of Warwick to Hydro
One to confirm grid capacity for the Municipality to no avail,
WHEREAS the Township of Warwick has requested formal meetings and
responses with the Ministry of Energy Minister Chris Bentley to continue earlier
discussions and requests previously presented to the government,
WHEREAS Township of Warwick has been unsuccessful in being provided with
the opportunity to speak to the government in regards to the Green Energy
Act(2009);

WHEREAS more than 88 municipalities thorough Ontario have passed
resolutions, motions and by-laws expressing concerns with the Green energy Act
(2009),
WHEREAS more than 25% of Ontario municipalities have expressed concerns
with the way the government has implemented and managed the Green Energy
Act(2009);
WHEREAS the health and welfare of Ontario residents has not been
demonstrated in the Green Energy Act(2009);
WHEREAS the Township of Warwick supports a moratorium on all current and
future projects under the Green Energy Act(2009) until the federal health study
has been completed to the satisfaction that the health and well-being of the
Township of Warwick citizens is protected from any negative health impacts.
NOW THEREFORE BE iT RESOLVED THAT the Government of Ontario
formally address and is held accountable to all the issues of the Green Energy
Act(2009). - Carried.
AND WHEREAS Warwick Township Council is very concerned that the Green
Energy Act has substantially changed the rules for municipalities with respect to
wind farm developments by removing municipal control over development
application though the traditional zoning requirements under the planning act
approvals for wind project developments are not controlled by the Minister of
Environment through the Renewable Energy Approval process, a legislative
development that the Council strongly opposes;
AND WHEREAS Section 49 of the Electricity Act requires that a municipality
provide wind project developers without charge access to and use of its road for
both construction and maintenance of its turbines and electrical infrastructure,
including transmission lines;
AND WHEREAS future jobs of Ontario are going to hinge on efficient energy
costs,by subsidizing the cost of energy by these wind projects, we are limiting
future growth in Ontario;
NOW THEREFORE BE ITS RESOLVED THAT the province of Ontario, specifically
the Ministry of Environment, be now advised that the Township of Warwick is Not
a Willing Host for Industrial Wind Turbines,

would like to have our annual breakfast for the cactus cowboy day inside the West Elgin arena
this year. We are kindly asking if the facility fees could be waived for our fundraiser. All of

SUBJECT: 2013 Proposed Bridget (Revised Rates)
INTRODUCTION:
On February 12, 2013, Council passed the 2013 budget. The tax rates calculated were
erroneously based on a preliminary return roll as provided by Ontario Property Tax
Analysis (OPTA), the toolkit developed by the Ministries of Finance and Municipal
Affairs and Housing. The final return roll showed an increase in assessment growth
from 0.5% to 0.8% and results in a reduction in the previously approved tax rate, The
adjusted rate will be applied on the next tax instalment showing a reduction in the
amount required to be collected over that previously anticipated.
DISCUSSION:
The budget was approved at a tax rate of 0.591005%, which in light of the final return
roll needs to be revised to 0.587603%. Due to the increase in assessment growth the
impact on the average household has improved. The previous published impact on an
average house with average assessment growth of$72.50 (5.8%) has improved by
$6.87 to $65.63 (5.2%). On an average household with no change in assessment, the
increase is $34.15 (2.7%).
Error proofing to ensure that the final return roll is used in future calculations has been
put into place. The preliminary roll will still be used early in the budget process to allow
budget development to begin in the fall; however, the data will be clearly marked as
preliminary making it obvious that the final return roll has not been entered.
The details of the revised tax rates (Schedule C — Tax Rates) are attached.
CONCLUSION:
The increased assessment growth in the final return roll results in the previously
approved budget being spread over a larger base, resulting in a reduced tax rate with
an associated $6.87 reduction in taxes on an average home over the previously
reported figures. No changes to the approved budget are required. The next municipal
tax instalment will be adjusted to reflect a lower remittance than previously proposed.

THAT Schedule C of By-Law 13-04 be amended to reflected the revised tax rates; and,

"BEING A BY-LAW TO AMEND BY-LAW 13-04 BEING A BY-LAW TO PROVIDE FOR
THE ADOPTION OF THE 2013 BUDGET OF THE CORPORATION OF THE COUNTY
OF ELGIN AND TO ESTABLISH THE 2013 TAX RATIOS,AND TO ESTABLISH THE
2013 TAX RATES FOR THE COUNTY CONSTITUENT MUNICIPALITIES"
WHEREAS Section 289 of the Municipal Act, 2001, S.O. 2001, c.25, provides that
the Council of each upper-tier municipality shall in each year prepare and adopt estimates
of all sums required during the year for the purposes of the upper-tier municipality; and
WHEREAS the previously approved tax rates were based on preliminary
assessment data; and,
WHEREAS it is necessary to apply the final assessment to establish 2013 tax rates;
and
WHEREAS the return roll with final assessment data is now available.
NOW THEREFORE the Municipal Council of the Corporation of the County of Elgin
enacts as follows:
1. THAT the 2013 tax rates for the assessment in each property class set out in
Schedule"C", attached hereto, be approved and adopted by Council; and,
2. THAT the 2013 tax rates for the assessment in each property class set out in
Schedule"C"of By-Law 13-04 be amended as attached Hereto.

Hi Mr Wiehle,
I am a board member on the Elgin St Thomas Community Foundation(escf.ca , and we are running and event
called "Expedition Elgin" on Sunday 22nd September. It's a kind of Amazing Race" idea- last year we had 130
participants (and 40 volunteers) in teams running around St Thomas looking for clues,performing challenges,
trying to out-race other teams. The year before we highlighted Port Stanley. This year, we are in the glorious
town of WEST LORNE.
The event is our way of supporting and highlighting some of the great gems in our Elgin county.
There are many natural and historical landmarks in the county, and but unfortunately none of them are all that
close to each other! Our race is a foot-race only. So what we are trying to do is get Iocal community
organisations in and around West Lorne such as Backus Page House,the West Elgin Dramatics Society, the
Arts and Cookery Bank, the West Elgin Nature Club (to name a few)to bring a little bit of their expertise and
passion to our participants.
Each team member is given a kind of'passport', a mini-full-colour magazine, which they have to use to read
clues,negotiate challenges and write down answers. We also use this as a nice little advertising piece for future
events in our community at large.
If you have ideas or would like to get involved, please feel free to contact us. We don't want to miss any of the
great things going on in our county!
