BY-LAW NO. ].002..: -- For licensiQg, reß~latipg and governipg hawkers, pedlars, petty cha,pmen e,ncl. others itf The Council of the Corpor8.tion of the County of Elgin emcts as follows,- 1- From and after the passÌ1'Jg of this by-law it shall be necessary for every hawker, pedlar or petty chapman and other persons .carrying on petty trades or who go from place to place or. to other men I s houses on foot or with a.ny anima.l, vehicle, boat, vessel or other craft beariQg or drawing goods, wares or mercllandise for sale or who go from place to place or to other men's houses to take orders for coal oil or other oil, which is to be delivered afterwa.,rds from a tank car. moved on r a railway line or who go frœn place to place or to a particular place to make sales or deliveries of coal '-' oil or other oil frœn such tank car to procure and obta,in a license for transa.ctimr or carrying on all such trade, business or callip~ within the limits of the Corpbratipn of the· County of Elgin and any person so , , licensed shall be subject to the provisions of this by-law and any such license shall be issued under the Corpora,te Seal oftha sa.id County and issued and signed Treasurer" by .the .~ of the said County. 2~ No such license shal¡ be required for hawking, peddling or selling goods, wares or merchandise to a retail dealer or for hawking, peddling or sellirg goods, wares or merchandise, the growth, produce or mamfa.cture of Ontario, not being liquors within the meaning of The Liquor License Act, if the same are hawked or peddled by the mamfacturer or producer of them or by his bona fide servants or employees having written Ð.uthority so ;',~ to do and such servant or employee shall e~1ibit his authori ty when required so to do by any municipal or 'I:."^ ~¡ 'i; -2-- peace of Hcer. 3· All licenses issued under this By-law shall be in force for one year from th~ date of issue a.nd no longer and every licensee under this By-law shall at all times while carryirg on his business have his license with him and shall upon dema.nd exhibit it to any municipal or peace officer and if he fails to do so shall, unless the same is aåcounted for satisfactorily, incur a. penalty of not less than $1.00 or more than $5.00 and if any peace officer dema,nds the production of a license by any person to whom the "Py-l8,w apnl:ies ?1"d the demand :is not complied wi th it shall be the duty of the peace officer and he shan have power to arrest such person without a warrant and to take him before the nearest justice of the peace tJlere to be dealt with according to law. 4. "Hawkers" in this By-law shall include agents~ for personsnQt resident within the county, who sell or offer for sale tea, coffee. spices, bakirg powder. dry goods, watches, plated ware, silverware, furniture, carpets. upholstery, millinery (coal oil, tinware, carpet sweepers and electricalapplia.nces), or jewellery, specta.cles or eyeglasses, or who carry a.nd expose samples or patterns of a.ny such article, which is to be a.fterwards delivered wi thin the county to a person not beix¡g a wholesa.le or retail dealer in such a.rticle. 7. ?XMpt as herdnothel'\'lise provided a. DY person contravenirg arry of the provisidm of this By-law shall for such offence on conviction before one or more Justices of the Peace in and for the County of Elgin forfeit and pay a fine of not less than Five , -_.---- ____________Dollars and not more than . , Fifty. Dollars in - I ---- the discretion of the Justice or Justices exclusive of costs and if not paid forthwith, the same shall be levied by distress and sale. of the goods and chattels of .the offender and ih case of there beirg nbdistress out of which the penalty can be levied the Justice may commit the. offender to the common jail of the County of Elgin for any period not ---~ - -4~ exceedi:r.g Twenty~one days unless such fine and costs_ includi:r.g the costs of committal and conveyance of the offender to the jail are sgoner paid and in aid of the provisions of this By-Iaw_ it is hereby declared that the Provisions of The Ontario Summary Convictions Act shall apply hereto. 8.
