1024 \ .~. B Y LAW No. 1024. To authorize the Oounty Road Superintendent -to rel)resent the Oouncil in all matters refer:red to in "The Highway Obnstructions Removal Act of 1920" The Elgin Oounty Council enacts: 1. That the County Road Superintendent may enter into an agreement with the owner of any lands adjacent to a highway under the jurisdiction of the council for the removal of any tree, shrub., brush, hedge, fence, signboard building or other object growing or standing on the highwa;y or on lands adjoining the higl1way and which may cause the drifting or accumulation of snow or may injurioU$ly affect the highway or obstruct the vi.siGn of drivers of vehicles or pedestrians upon the highway. 2. That the said superintendent may, with the approval of the council having jurisdiction over the high- way, enter into an agreeI)1i:mt with the owner of the lands as to the amount of compensation to be paid to such owner for damages caused to him by reason of such remGval. 3. That when the said superintendent is of the opinion that the removal of any tree, shrun, brush, hedge, fence, signboard, building, or other object growing or stal ing upon a highway, or on lands adjacent to the hi gl1way , wi: cause t'-'e drifting or accumulation of snow or is injurious to the road-bed or is a dangerous obstruction to the visiOJ of drivers of vehicles or pedëstrians on the higl1way, and he is unable to agree with the owner of such lands for the removal of the same, or as to the amount of compensation t, be paid therefor, the road superintendent may, with the approval of the council having jurisdiction over the high- way, a.pply to the judge of the county court of the county in which the lands affected are situated, and upon such notice to the owner of the lands affected, as the judge ma direct for an order granting authority to the road super- .'\ intendent to enter upon the lands affected ana. to remove any object with respect to which the application is made and the judge, upon such application, may make such order and may fix the amount of compensation to be paia. to the ?wner and give such directions as to costs as in his opinion ma~ be equitable.
