1420 ~~ BY-LAW NUMBER 1420 A BY-LAW TO FROVIDE for the granting of permits in moving heavy vehicles, loads, objects or structures. THE MUNICIPlili COUNCIL OF THE CORPORATION OF THE COUNTY OF ELGIN ENACTS AS FOLLOWS: 1- No, heavy vehicle, load, object, structure or contrivance, exceeding the limits prescribed by Section 17 or 33 of the Highw&y Traffic Act, Chapter 288, Re- vised Statutes of Ontario 1937, shall be moved over any highway under the jurisdiction of the said County unless and until a permit has been obtained from either the County '.."'" Engineer or the County Assistant Road Superintendent, or this County Council. 2- . The granting of such permit shall rest solely in the discretion of any of the above mentioned authorities, and shall be subject to such conditions, regulations, restrictions, privil~ges, covenants and bonds as the granting authority deems proper in each particular case after considering all of the circumstances. 3- All owners, drivers, operators and movers of any such vehicle, load, object, structure or contrivance for which a permit has been obtained pursuant to the above mentioned Section, shall nevertheless be responsible for all damages which may be caused to the highway or any other County property, by reason of the driving, op- erating or moving of such vehicle, load, object, struc- ture or contrivance. 4- In the case of all highways under the jurisdic- tion of the Municipal Corporation of the County of Elgin -2- the County Engineer, or the County Assistant Road SupÐrintendent, or the County Council may from time to time upon giving adequate notice, declare the provis- ions of SubsectiQns 3, 4 and 5 of Section 35 of the Highway Traffic Act, Chapter 288, R. S. O. 1937, to ex- tend and apply to all or any of such highways during any period of the year or that the provisions of Subsections 3 and 4 shall not apply to any or all of such highways. 5- Any person who violates anybf the provisions of this By-law shall incur for the flj,st offence a penalty of not less than $10. and not more than $50.; for the second offence a penalty of not less than $20. and not more than $100., and in addition his license or , permit may be suspended for any period not exceeding thirty days, and for any subsequent offence shall incur a penalty of not less than $50. and not more than $200., and shall also be liable to imprisonment for any term not exceeding thirty days and in addition his license or per- , mi t may be suspended for any period not exceeding six months. 6- All þy~laws or parts of by-laws inconsisteµt , , herewith, are hereby repe~led provided that no part of this by-law requiring approval of the Minister of High- ways of the Province of Ontario shall take effect until it has received such approval.
