WHEREAS
itA by-law of, the counoil bíl a township, passed under
the authority conferred by clause (0) of subseotion 1,
in the case of a township in unorganized territory,
shall not have any foroe unless and until approved by
a Judge of the Distric'G Court of the distriot in whioh
the to;Vllship is situated, and in other cases unless and
until oonfirmed by a by-law of the council of the county
in which the township is situate passed at an ordinary
meeting of 'Ghe counoil held not sooner than three months
or later than one year after the passing òf the by-law
of the counoil of the township" and

AND WHEREAS Chapter 266,Seo. 495, subseotion (1) olause (0) of
the Revised Statutes of Ontario 1937 provides that the Counoil of
a Township may pass a by-law for stopping up any highwai or part
of a' highway and for leasing or selling the soil and freehold of a
stopped up highway Or part of a highway;
AND vVHERmAS the aforementioned road is not at present in use by
the travelling publio and whereas it would cost the Township a
oonsiderable sum of money ,to ma~e this road safe for publio
travel:
AND WEEREAS the persons through whose land this portion of said
road now runs, have other ne ans of outlet and in oonsiderat ion of
oertain sums of money, are agreeable that this road be stopped up
and olosed; r
AND WHERF..AS it is of oonsiderable benefit. to the Township as a
whole that the aforesaid portion of road be stopped up and olosed:
TEEREFORE IT IS ENCA'l'ED BY 'lHE COUNèIL OF THE ,CORPORATION OF
THE COUNTY OF ELGIN:
1. That, that portion of road whioh runs through and between lots
5 and 6, oonoession 4, Township of Bayham, oommencing where said
roads join on the north side of the GRIFFINS' CORNER - Calton road,
namely at or near top of 'l'ribe Hill, to the point where said road
èrosses the east boundary line of Lot 5, Conoession 4, namely at or
near top of Bell Hill and whioh road runs through what is oommonly
knowµ. as the Tribe and Bell properties, be and the same is hereby
stopped up and olosed~
2. That the portions of the road so stopped up and olosed shall
be sold and vonveyed to the owners of the lands through which the
said road passes acoording to the amounts situate in th~ lands of
each of the said owners.
3. That the Reeve and Clerk are hereby authorized to exeou't¡e and
deliver conveyance of the said lands under the Corporate Seal of
the Municipality to the said parties upon payment of the expenses of
said vonveyances in oonneotion therewith.
Read a third time and passed at County Counoil Chambers, st. Thomas
this 19th day of January 1945.
